का.आ. 1777(अ) .-चूंकि, केन्द्र सरकार को मैसर्स रिलायंस इंडस्ट्रीज लि. , धीरुभाई अम्बानी नॉलेज सिटी, एच ब्लॉक, थाणे बेलापुर रोड, कोपरखेरेन , नवी मुम्बई-400709 से, तेल निकालने के प्रयोग के लिए यू.एस.ए. से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है ;

और चूंकि, पैट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली, 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप- नियम ( 2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है, जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है ;

और जबकि, नागरविमानन महानिदेशक ने वायुयान ( खतरनाक वस्तुओं का वहन ) नियमावली, 2003 के नियम 3 के उप - नियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपने परमिट सं. 239-डीजी/2005 दिनांक 27 जून, 2005 द्वारा जो कि 26 दिसम्बर , 2005 तक वैध है इस प्रकार के विस्फोटकों को वायुमार्ग द्वारा ले जाने के लिए मैसर्स रिलायंस इंडस्ट्रीज लि. , मुम्बई को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है ।

अतः , अब, विस्फोटक अधिनियम, 1884 ( 1884 का 4 ) की धारा 14 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा पैट्रोलियम तथा विस्फोटक सुरक्षा संगठन और नागर विमानन महानिदेशक द्वारा की गई सिफारिशों के आधार पर केन्द्र सरकार एतद्वारा मैसर्स रिलायंस इंडस्ट्रीज लिमिटेड, मुम्बई को मैसर्स बेकर एटलस, 14000 बेटका रोड, हैम्सटैड, टैक्सास -77445, संयुक्त राज्य अमेरिका से मुम्बई हवाई अड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप- नियम ( 2 ) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है , नामतः :--

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः:-

( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्‌डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों , यदि कोई हों, का पालन किया जाएगा ;

(2) 1 जनवरी, 1996 से लागू हुई अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के 37वें संस्करण की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा;

(3) [नियम 31 के उप- नियम ( 2 ) के अलावा उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जाएगा;

(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;

( 5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अन्तरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा। उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

घिरे हुए क्षेत्र के अन्दर कोई धूमपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी ; तथा

(7 ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगरपालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

S.O. 1777 ( E ) . Whereas the Central Government has received a proposal made by M/s . Reliance Industries Limited, Dhirubhai Ambani Knowledge City , H Block , Thane Belapur Road , Koparkhairane , Navi Mumbai -400 709 , to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from United States of America for oillexploration purposes ;

And, whereas the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explo- sives shall be used for oil exploration purposes and , therefore , necessary exemption may be granted from the purview of sub - rule (2) ofrule 31 of the Explosives Rules , 1983 ( hereinafter referred to as the said rules) which prohibits import or export ofexplosives specified herein by air ;

And, whereas the Director General ofCivil Aviation has , in exercise of powers conferred by sub - rule ( 1 ) of rule 3 ofthe Aircrafts ( Carriage of Dangerous Goods ) Rules , 2003 , granted necessary permission with certain conditions to the M/s . Reliance Industries Limited , Mumbai to carry such explosives by air vide their permit number 239 - DG /2005 dated 27th June , 2005 valid up to 26th December, 2005;

Now, therefore, in exercise ofthe powers conferred by Sub - section (2) of Section 14 ofthe Explosives Act, 1884 (4 of1884), and on the recommendations made by the Petroleum and Explosives Safety Organisation and the Director General ofCivil Aviation , the Central Government hereby exempts the M/s . Reliance Industries Limited, Mumbai from the provisions of sub - rule (2) of rule 31 of the said rules, for import of the following explosives , the items and quantities of which are specified in the Table below , by air from M/ s . Baker Atlas , 14000 Betka Road , Hempstead, Texas -77445 , United States of America at Mumbai airport, namely :----

2. The explosives mentioned in the Table shall be imported subject to the following conditions , namely :-

(1) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions, if any, imposed by the said authorities shall be complied with;

(2) explosives conforming only to Division 1.4 and 4.1 of the Division relating to class 1 Explosives falling under 3,1 of Section 3 of 37th Edition of the International Air Transport Association Dangerous Goods Regulations , which became effective on 1st January, 1996, shall be imported;

(3) strict compliance with the relevant provisions relating to the possession , transport , use and import of explosives , [except sub - rule (2) of rule 31 ] of the said rules ;

(4) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing ;

(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number ofsecurity guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;

(6) smoking or use of naked light shall not be permitted within the cordoned area; and 4

(7) vans carrying the explosives shall proceed to the storage magazines licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any , shall be complied with during the transportation of the explosives .

और, जबकि, नागर विमानन महानिदेशक ने वायुयान ( खतरनाक वस्तुओं का वहन ) नियमावली, 2003 के नियम 3 के उप -नियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपने परमिट सं. 240- डीजी/2005 दिनांक 27 जून , 2005 द्वारा जो कि 26 दिसम्बर , 2005 तक वैध है इस प्रकारके विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मैसर्स रिलायंस इंडस्ट्रीज लि. , मुम्बई को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है ।

अतः अब विस्फोटक अधिनियम, 1884( 1884 का 4 ) की धारा 14 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन और नागर विमानन महानिदेशक द्वारा की गई सिफारिशों के आधार पर केन्द्र सरकार एतद्वारा मैसर्स रिलायंस इंडस्ट्रीज लिमिटेड, मुम्बई को मैसर्स बेकर एटलस , 14000 बेटका रोड, हैम्सटैड, टैक्सास-77445, संयुक्त राज्य अमेरिका से मुम्बई हवाई अड्डे पर निम्नलिखित विस्फटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप-नियम ( 2 ) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है , नामतः :-

( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तें, यदि कोई हों, का पालन किया जाएगा;

(2) 1 जनवरी , 1996 से लागू हुई अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के 37वें संस्करण की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा;

(3) [नियम 31 के उप - नियम ( 2 ) के अलावा ] उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जाएगा;

(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अन्तरण शुरू होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान औरं विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक किअन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

(7 ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्तेमें कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगरपालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

S.O. 1779 (E ) .-- Whereas the Central Government has received a proposal made by M/s . Reliance Industries Limited, Dhirubhai Ambani Knowledge City , H Block , Thane Belapur Road, Koparkhairane , Navi Mumbai -400 709 , to the Petroleum and Explosives Safety Organization for permission to import certain explosives by air from United States of America for oil exploration purposes ;

And, whereas the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explo- sives shall be used for oil exploration purposes and , therefore, necessary exemption may be granted from the purview of sub- rule (2) ofrule 31 of the Explosives Rules , 1983 (hereinafter referred to as the said rules ) which prohibits import or export ofexplosives specified herein by air ;

And, whereas the Director General of Civil Aviation has in exercise of powers conferred by sub -rule ( 1 ) of rule 3 of theAircraft (Carriage of Dangerous Goods ) Rules , 2003 , granted necessary permission with certain conditions to the M/s. Reliance Industries Limited, Mumbai to carry such explosives by air vide their permit number 240 - DG/2005 dated 27th June, 2005 valid upto 26th December , 2005;

Now, therefore , in exercise of the powers conferred by Sub - section (2) of Section 14 of the Explosives Act, 1884 (4 of 1884), and on the recommendations made by the Petroleum and Explosives Safery Organisation and the Director General ofCivil Aviation, the Central Government hereby exempts the M/ s . Reliance Industries Limited, Mumbai from the provisions of sub -rule (2) of rule 31 of the said rules , for import of the following explosives, the items and quantities of which are specified in the Table below , by air from M/s . Baker Atlas , 14000 Betka Road , Hempstead, Texas - 77445 , United States of America at Mumbai airport, namely:---

2. The explosives mentioned in the Table shall be imported subject to the following conditions , namely :-

(1) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any , imposed by the said authorities shall be complied with;

(3) strict compliance with the relevant provisions relating to the possession , transport , use and import of explosives , [ except sub - rule (2) of rule 31 ] of the said rules;

(4) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;

(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site ;

(6) smoking or use of naked light shall not be permitted within the cordoned area ; and

(7) vans carrying the explosives shall proceed to the storage inagazincs licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any , shall be complied with during the transportation of the explosives .
