सा.का.नि. 732(अ) .-केन्द्रीय सरकार का यह विचार है कि ऐसी परिस्थितियां उत्पन्न हो गईं हैं कि ओषधि तकनीकी सलाहकार बोर्ड से परामर्श के बिना नियम बनाना आवश्यक है ;
और केन्द्रीय सरकार, इन नियमों के बनने के छह मास के भीतर ओषधि तकनीकी सलाहकार बोर्ड से परामर्श करने का प्रस्ताव करती है ;
अतः , अब, ओषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार ओषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अधिनियम की धारा 12 और धारा 33 की अपेक्षानुसार उन सभी व्यक्तियों को जिनके उससे प्रभावित होने की संभावना है , जानकारी के लिए प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप पर उस तारीख से , जिसको उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अवधि की समाप्ति को या उसके पश्चात् विचार किया जाएगा;
आक्षेप या सुझाव , यदि कोई हो , सचिव ( स्वास्थ्य) स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, निर्माण भवन , नई दिल्ली -110011 को भेजे जा सकते हैं ।
आक्षेप या सुझाव पर जो उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से ऊपर यथानिर्दिष्ट अवधि की समाप्ति के पूर्व प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. इन नियमों का संक्षिप्त नाम ओषधि और प्रसाधन सामग्री (........... संशोधन ) नियम, 2005 है ।
2. ओषधि और प्रसाधन सामग्री नियम, 1945 के नियम 2 में खण्ड ( ख ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्: - ' (ख ) " केन्द्रीय अनुज्ञप्ति अनुमोदन प्राधिकारी " से केन्द्रीय सरकार द्वारा नियुक्त ओषधि नियंत्रक, भारत या संयुक्त ओषधि नियंत्रण ( भारत) अभिप्रेतहै । ' ।

NOTIFICATION
New Delhi , the 21st December, 2005
G.S.R. 732 (E ).-Whereas the Central Government is of the opinion that circumstances have arisen which render it necessary to make rules without consulting the Drugs Technical Advisory Board;
And whereas the Central Government propose to consult the Drugs Technical Advisory Board within six months of making these rules ;
Now, therefore, the following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945, which the CentralGovernment propose to make in exercise of the powers conferred by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ) , is hereby published as required by Sections 12 and 33 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of a period of thirty days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public .
Objections or suggestions , if any , may be addressed to the Secretary (Health ) , Ministry of Health and Family Welfare , Government of India, Nirman Bhavan , New Delhi - 110011 .
Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry ofthe period as specified above will be taken into consideration by the Central Government.
DRAFT RULES
1. (1) These rules may be called the Drugs and Cosmetics ( .......... Amendment) Rules , 2005 .
2. In rule 2 of the Drugs and Cosmetics Rules , 1945 for clause (b) , the following clause shall be substituted, namely:-
'(b) " Central Licence Approving Authority " , means the Drugs Controller, India or the Joint Drugs Controller (India) , appointedby the Central Government . ' .
