सा. का. नि. 733(अ).- औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप, औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 की अपेक्षानुसार, भारत के राजपत्र, असाधारण , भाग II , खंड 3 , उपखंड ( i ) , तारीख 13 दिसम्बर, 2004 में भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) की अधिसूचना संख्या सा.का.नि. 807 ( अ ) , तारीख 13 दिसम्बर , 2004 के अधीन प्रकाशित किया गया था, जिसमें उन सभी व्यक्तियों से, जिनके उससे प्रभाषित होने की संभावना थी, उस तारीख से, जिसको भारत के उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गईं थीं, पैतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे;
और, उक्त राजपत्र की प्रतियां तारीख 14-12-2004 को जनता को उपलब्ध करा दी गई थीं ;
और, उक्त प्रारूप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार ने विचार कर लिया है ;
अतः , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. (1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( छटा संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम, 1945 में, -
(i ) नियम 122 च के उप- नियम ( 1 ) में, " स्पष्टीकरण " का लोप किया जाएगा ;
(ii ) नियम 122 छ को उसके उप- नियम ( 1 ) के रूप में संख्यांकित किया जाएगा और इस प्रकार संख्यांकित उपनियम ( 1 ) के पश्चात्निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्: -

" (2 ) रक्त बैंक के प्रचालन या मानव रक्त संघटकों के प्रसंस्करण के लिए अनुज्ञप्ति देने या नवीकरण करने के लिए आवेदन केवल सरकार, भारतीय रेड क्रास सोसायटी, अस्पताल , राज्य/ संघ राज्य क्षेत्र रक्त संचरण परिषद् द्वारा अनुमोदित दातव्य न्यास या स्वैच्छिक संगठन द्वारा चलाए जा रहे रक्त बैंक द्वारा ही किया जाएगा :
स्पष्टीकरण: इस उप - नियम के प्रयोजन के लिए " नवीकरण " में औषधि और प्रसाधन सामग्री (.........संशोधन ) नियम , 2005 के प्रारंभ होने से पूर्व जारी की गई किसी अनुज्ञप्ति का नवीकरण सम्मिलित है ।
( ii ) उक्त नियमों की अनुसूची च के भाग XII- ख में, ' ज. विशेष रीजेंट्स ' शीर्षक के अधीन क्रम संख्यांक ( 5 ) पर प्रविष्टि के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:-
" ( 5 ) हैपेटाइटिस और एच.आई.वी. 1 और 2 के लिए एलिसा या रैपिड या आर पी एच ए की परीक्षण किटें । "

: मूल नियम, भारत के राजपत्र में अधिसूचना सं. एफ- 28-10/45- एच ( 1 ) , तारीख 21 दिसम्बर , 1945 द्वारा प्रकाशित किए गए थे और वर्ष 2005 में भारत के राजपत्र के भाग II , खंड 3 , उपखंड ( i ) में प्रकाशित निम्नलिखित अधिसूचनाओं द्वारा संशोधित किए गए, अर्थात्: - (1) सा.का.नि. 32 ( अ ) तारीख 20-1-2005
(2) सा.का.नि. 35 (अ ) तारीख 20-1-2005
(3) सा.का.नि. 79 ( अ) तारीख 14-2-2005
(4) सा.का.नि. 174 ( अ ) तारीख 16-3-2005
(5) सा.को.नि. 431 ( अ ) तारीख 30-6-2005

NOTIFICATION
New Delhi , the 21st December , 2005
G. $ . R. 733 (E) .-Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published, as required by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , in the Gazette of India , Extraordinary, Part II , Section 3 , Sub-section (i ) dated the 13th December , 2004 , under the notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health ) , number G.S.R. 807 (E ) , dated the 13th December, 2004, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of forty- five days from the date on which copies of the Official Gazette containing the said notificaion were made available to thepublic;
And, whereas copies ofthe said Gazette were made available to the public on 14-12-2004;
And, whereas objections and suggestions received from the public on the said draft rules have been considered by the Central Government ;
Now , therefore, in exercise ofthe powers conferred by Sections 12 and 33 of the said Act, the Central Government , after consultation with the Drugs Technical Advisory Board, hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945, namely:-
1. (1 ) These rules may be called the Drugs and Cosmetics (6th Amendment) Rules , 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945 ,--
(i) in rule 122F, in sub- rule ( 1 ) , ' Explanation ' shall be omitted;

(ii) rule 122G shall be numbered as sub- rule ( 1 ) thereof, and after sub -rule ( 1) as so renumbered, the following shall be inserted, namely :-
"(2) Application for grant or renewal of a licence for operation of Blood Bank or processing of human blood components shall be made by the Blood Bank run by the Government, Indian Red Cross Society, hospital , charitable trust or voluntary organization approved by a State /Union Territory Blood Transfusion Council only .
Explanation . For the purpose of this sub-rule, "renewal" shall include renewal of any licence issued prior tothe commencement of the Drugs and Cosmetics (.........Amendment ) Rules, 2005. "
(iii) In Schedule F to the said rules , in Part XII -B, under the heading ' J. SPECIAL REAGENTS ' , for the entry at serial number (5) , the following shall be substituted, namely,-
"(5) ELISA or Rapid or RPHA test kits for Hepatitis and HIV I and II . "
