सा.का.नि. 734(अ).- औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप , औषधि और प्रसाधन साम्रगी अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 की अपेक्षानुसार, भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना संख्या सा. का. नि. 808 ( अ ) , तारीख 13 दिसम्बर, 2004 के अधीन भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप- खंड ( i ) , तारीख 13 दिसम्बर, 2004 में प्रकाशित किया गया था, जिसमें उन सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से, जिसको उक्त अधिसूचना से युक्त राजपत्र की प्रतियाँ जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां 14-12-2004 को जनता को उपलब्ध करा दी गई थीं;
और केन्द्रीय सरकार ने उक्त प्रारूप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है;
अतः अब, केन्द्रीय सरकार, औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( सातवां संशोधन ) नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम, 1945 की अनुसूची ट में क्रम संख्यांक 33 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्:-

" (34) किसी अस्पताल या आयुर्विज्ञान संस्थान द्वारा उनके कैप्टिव उपभोग के लिए आण्विक छन्नी प्रक्रिया द्वारा वायु से उत्पादित 93 प्रतिशत यूएसपी आक्सीजन का उत्पादन ।
अधिनियम के अध्याय 4 और उसके अधीन बनाए गए नियमों के उपबंध जिनके नियमों के अधीन विनिर्माण अनुज्ञप्ति के अधीन होने की अपेक्षा की जाती है, परन्तु यह तब जब कि उत्पादन सुविधाएं, अधिनियम के अधीन नियुक्त किसी निरीक्षक द्वारा निरीक्षण के लिए खुली होंगी जो, यदि आवश्यक हो तो वह परीक्षण के लिए नमूने ले सकेगा । "

टिप्पण:-मूल नियम, भारत के राजपत्र में अधिसूचना सं. एफ.28-10/45 - एच ( 1 ) , तारीख 21 दिसम्बर, 1945 द्वारा प्रकाशित किए गए और अन्तिम संशोधन सा.का. नि. 40( अ) तारीख 29-1-2001 द्वारा किए गए । औषधि और प्रसाधन सामग्री नियम, 1945 जो 1-5-1979 तक यथा संशोधित हैं, स्वास्थ्यऔर परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) के प्रकाशन में अंतर्विष्ट हैं जिसमें औषधि और प्रसाधन सामग्री नियम 1940 (पीड़ीजीएचएस -61 ) भी हैं । वर्ष 2005 में ये नियम निम्नलिखित द्वारा संशोधित किए जाचुके हैं :

(2) सा.का.नि. 35 ( अ ) तारीख 20-1-2005
(3) सा.का.नि. 79 (अ ) तारीख 14-2-2005
(4) सा.का.नि. 174 (अ ) तारीख 16-3-2005
(5) सा.का.निं. 431 ( अ) तारीख 30-6-2005

NOTIFICATION
New Delhi , the 21st December, 2005
G.S.R. 734 (E) .-Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published, asrequired by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , in the Gazette of India , Extraordinary , Part II, Section 3 , sub -section ( i ), dated the 13th December , 2004 , under the notification of the Government of India in the Ministry ofHealth and Family Welfare (Department of Health ), number GSR 808 (E ) , dated the 13th December , 2004, inviting objections and suggestions from all persons likely to be affected thereby , before the expiry of a period of forty five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
Andwhereas copies of the said Gazettee were made available to the public on 14-12-2004 ;
Andwhereas , objections and suggestions received from the public on the said draft rules have been considered by the Central Government;
Now, therefore , in exercise of the powers conferred by Sections 12 and 33 of the said Act , the Central Govemment , after consultaiton with Drugs Technical Advisory Board, hereby makes the following rules further to amend the Drugs and Cosmetics Rules, 1945 , namely:-
1. ( 1) These rules may be called the Drugs and Cosmetics (7th Amendment) Rules , 2005 .
(2) They shall come into force on the date of their publication in Official Gazettee .
2. In the Drugs and Cosmetics Rules, 1945, in Schedule K, after Serial Number 33 and the entries relating thereto , the following shall be inserted, namely:-

"(34) Production of Oxygen 93 per cent USP, produced from air by the molecular sicve process , by a hospital or Medical Institute for their captive consumption.
The provisions of Chapter IV of the Act and the Rules made thereunder which require them to be covered by manufacturing licence under the rules, provided that the production facilities shall be open to inspection by an Inspector appointed under theAct, who can, if necessary , take samples for test" .

Foot Note : The Principal Rules were published in the Official Gazette vide notification No. F. 28-10 /45 -H ( 1 ) dated 21-12-1945 and last amended vide GSR 40 (E ) dated 29-1-2001. The Drugs and Cosmetics Rules , 1945 as amendedupto 1-5-1979 is contained in the publication of the Ministry of Health & Family Welfare (Department ofHealth) containing the Drugs and Cosmetics Act, 1940 (PDGHS - 61 ) . In the year 2005 these rules have been amendedby the following numbers:-
