सा.का.नि. 735(अ). औषधि और प्रसोधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप, औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23) की धारा 12 और धारा 33 की अपेक्षानुसार, भारत के राजपत्र, असाधारण, भाग II , खंड 3 , उप- खंड ( i ) , तारीख 2 फरवरी, 2005 में भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्यविभाग ) की अधिसूचना सा.का.नि. 51 ( अ ) , तारीख 2 फरवरी , 2005 के अधीन प्रकाशित किया था, जिसमें उन सभी व्यक्तियों से, जिनके उससे प्रभावित, होने की संभावना थी, उस तारीख से , जिसको उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना अन्तर्विष्ट है, जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां तारीख 3 फरवरी , 2005 को जनता को उपलब्ध करा दी गई थीं;
और उक्त प्रारूप नियमों के संबंध में जनता से कोई आक्षेप या सुझाव प्राप्त नहीं हुआ था;
अतः , अब , केन्द्रीय सरकार, उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम, 1940 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. (1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री (आठवां संशोधन ) नियम, 2005 है ।
होंगे। (2) यें राजपत्र में अन्तिम प्रकाशन की सरीख को प्रकृत
2. औषधि और प्रसाधन सामग्री अधिनियम, 1945 की अनुसूची श्रेणी में भाग- I के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:-
"भाग- I
कृष्ण तरलों और श्वेत तरलों को लागूउपबन्ध
रोगाणुनाशकों के लिए मानक भारतीय मानक ब्यूरो द्वारा समय- समय पर निर्धारित किए गए भारतीय मानक विनिदेशों [भाग -1061: 1997 ] के अनुरूप होंगे । "

टिप्पण:-मूल नियम राजपत्र में अधिसूचना सं. एफ 28-10/45- एच( 1 ) तारीख 21-12-1945 द्वारा प्रकाशित किए गए और वर्ष 2005 में राजपत्र के भाग 2, खंड 3 , उप- खंड ( i ) में प्रकाशित निम्नलिखित अधिसूचनाओं द्वारा संशोधित किए गए, अर्थात्: -
(1 ) सा.का.नि. 32 (अ ) तारीख 20-1-2005
(2) सा.का.नि. 35 (अ ) तारीख 20-1-2005
(3) सा.का.नि. 79 ( अ ) तारीख 14-2-2005

NOTIFICATION
2. In The Drugs and Cosmetics Rules , 1945, in the Schedule O , for Part I following shall be substituted, namely:--

"Part I
PROVISIONS APPLICABLE TO BLACK FLUIDS AND WHITE FLUIDS
The standards for disinfectants shall conform to the Indian Standards specification (IS 1061 : 1997 ) laid down from time to time by the Bureau of Indian Standards ."

G.S.R. 135(E) -Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules, 1945 was published, as required by Sections 12 and 33 of the Drugs and Cosmetics Act , 1940 ( 23 of 1940) , in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section ( i) dated the 2nd February, 2005, under the notification of the Government of India in the Ministry ofHealth and Family Welfare (Department ofHealth), number G. S. R. 51 (E) , dated the 2nd February, 2005, inviting objections and suggestions from all persons likely to be affected thereby, before the expiryofa period offorty- five days from the date on which copies ofthe Official Gazette containing the said notification weremade available to the public;
Andwhereas copies of the said Gazette were made available to the public on 3-2-2005;
Note: The principal rules were published in the Official Gazette vide notification No. F. 28-10/45 -H( 1 ) dated 21-12-1945 and amended in the year 2005, by the following notifications published in Part II, Section 3 , Sub -section (i) oftheGazette of India , namely:-
Andwhereas no objecțion or suggestion was received from the public on the said draft rules;
(1) GSR32(E) dated 20-1-2005
(2) GSR35 (E) dated20-1-2005
(3) GSR 79 (E) dated 14-2-2005
(4) GSR 174(E ) dated 16-3-2005
Now, therefore , in exercise ofthe powers conferred bySections 12and 33 ofthe saidAct, the Central Government, after consultation with the Drugs Technical Advisory Board, herebymakes the following rules further to amend the Drugs and Cosmetics , Rules, 1945, namely:-

1. (1) These rules may be called The Drugs and Cosmetics (811 Amendment) Rules, 2005.
