का.आ. 1799( अ). भारत सरकार, पर्यावरण एवं वन मंत्रालय की तारीख 4 फरवरी , 2003 अधिसूचना संख्या का.आ. 133 ( अ ) , (जिसे इसके पश्चात् उक्त अधिसूचना कहा गया ) के द्वारा केन्द्रीय सरकार में महाराष्ट्र राज्य में माथेरन और उसके आस- पास के क्षेत्र को पारिस्थितिक संवेदनशील अंचल के रूप में अधिसूचित किया और उक्त क्षेत्र में उद्योगों, प्रचालनों, प्रक्रियाओं एवं अन्य विकासात्मक कार्यों पर प्रतिबंध लगाया है;
अतः , अब, सरकार पर्यावरण ( संरक्षण ) अधिनियम, 1986 ( 1986 का 29 ) की धारा 3 की उप - धारा ( 2 ) के खंड ( v ) और पर्यावरण (संरक्षण) नियम, 1986 के साथ पठित उप - धारा ( 1 ) के नियम 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिसूचना में निम्नलिखित और संशोधन करती है, नामतः :-
उक्त अधिसूचना में, -
(1 ) पैरा 4, उप- पैरा ( एन ) में " के अतिरिक्त, एक एम्बुलेंस एवं एक अग्नि इंजन जो लगा हुआ है " शब्दों के बाद " रेलवे एवं रोपवे" शब्दों को जोड़ा जाए;
( 2 ) अनुबंध- क में कोष्ठक, शब्द एवं अंक " ( धारा 2 देखें ) " के लिए कोष्ठक, शब्द एवं अंक " ( पैरा 2 देखें ) " को प्रतिस्थापित कियाजाए;
(3 ) अनुबंध - ख में कोष्ठक, शब्द एवं अंक " ( धारा 2 देखें ) " के लिए कोष्ठक, शब्द एवं अंक " ( पैरा 2 देखें ) " को प्रतिस्थापित किया जाए;
(4) अनुबंध - ग में कोष्ठक, शब्द एवं अंक " ( धारा 2 देखें ) " के लिए कोष्ठक, शब्द एवं अंक " ( पैरा 2 देखें ) " को प्रतिस्थापित किया जाए;
(5) अनुबंध-घ में, -
(क ) कोष्ठक, शब्द, अंक एवं अक्षर " [ धारा 4 ( क ) ( iv ) ( 3 ) देखें] " के लिए ब्रैकेट, शब्द, अंक एवं अक्षर " [पैरा 4( क ) (iv) (3 ) देखें] " को प्रतिस्थापित किया जाए ।
( ख ) हरित अंचल -1 से संबंधित उपशीर्षक 3 में प्रविष्टि 3.1 की मद ( ट ) में " वाटर शेड प्रबंधन के लिए लघु रोक बांध " शब्दों के बाद " रोपवे " शब्द जोड़ा जाए;

(ग) नगरीकरणीय अंचल-2 से संबंधित उपशीर्षक 4 में,-
(i ) प्रविष्टि 4.1 के मद (एन ) में " वाटर शेड प्रबंधन के लिए लघु रोक बांध " शब्दों के बाद " रोपवे " शब्द को जोड़ा जाए;
( i ) प्रविष्टि4.2 में " पैरा " शब्द के लिए " प्रविष्टि " शब्द प्रतिस्थापित किया जाए ।

टिप्पणी:-प्रधान अधिसूचना को संख्या का.आ. 133 ( अ ) तारीख 4 फरवरी , 2003 के तहत भारत के राजपत्र, असाधारण में प्रकाशित किया गया था और तत्पश्चात् संख्या का.आ. 83 ( अ ) तारीख 16 जनवरी , 2004 के तहत संशोधित किया गया था ।

NOTIFICATION
New Delhi , the 16th December, 2005
S.O. 1799(E ) . Whereas by the notification of the Government of India in the Ministry of Environment and Forests, number S.O. 133 (E), dated the 4th February , 2003 (hereinafter referred to as the said notification) , the Central Government notified Matheran and surrounding region in the State of Maharashtra as an Eco - sensitive Zone and imposed restrictions onindustries, operations , processes and other developmental activities in the said region;
Now, therefore, in exercise of the powers conferred by Sub - section ( 1 ) read with clause (v) of Sub - section (2) of Section3 ofthe Environment (Protection) Act, 1986 (29 of 1986) and rule 5 of the Environment (Protection) Rules , 1986, the Central Government hereby makes the following further amendments in the said notification, namely:
Inthe said notification,--
(1) in paragraph 4, in sub -paragraph (n) , after the words " in addition, one ambulance and one fire engine as stand by" , the words "railways and ropeways " shall be inserted;
(2) in Annexure-A, for the brackets , words and figure " (see section 2) " , the brackets, words and figure "( see paragraph 2)", shall be substituted;
(3) in Annexure-B , for the brackets , words and figure " (see section 2) " , the brackets , words and figure " (see paragraph 2) " , shall be substituted;
(4) in Annexure-C, for the brackets, words and figure " (see section 2) " , the brackets , words and figure "(see paragraph 2) " , shall be substituted;
(5) in Annexure-D,-
(a) for the brackets , words , figures and letters " [ see Section 4 (a) (iv) (c) ] " the brackets , words, figures and letters "[ see paragraph 4( a) (iv) (3 ) ] " shall be substituted;
(b) in sub-heading 3 , relating to Green Zone- 1 , in item (j ) of entry 3.1 , after the words " small check dams for watershed management", the word " ropeways . " shall be inserted;
(c) in sub-heading 4, relating to Urbanisable Zone- 2 ,-
(i) in item (n) of entry 4.1 , after the words " small check dams for watershed management" , the word "ropeways." shall inserted;
(ii) in entry 4.2, for the word " paragraph " , the word ' entry' shall be substituted .
