सा.का.नि. 743( अ ).- केन्द्रीय सरकार, रेल अधिनियम, 1989 (1989 का 24) की धारा 87 की उपधारा (2) के खंड (घ) के साथ पठित उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और 1147 (स्था) , तारीख 18 अक्तूबर, 2004 द्वारा भारत के राजपत्र, भाग ।।, खंड 3 (i) में प्रकाशित रेल ( वैगनों की अतिभराई के लिए दंडांत्मक प्रभार) नियम, 2004 को, उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, उक्त अधिनियम की धारा 73 के अधीन वैगनों की अतिभ्रराई के लिए दंडात्मक प्रभार हेतु निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ (1) इन नियमों का संक्षिप्त नाम रेल (वैगनों की अतिभराई के लिए दंडात्मक प्रभार) नियम, 2005 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो,
(क) " अधिनियम" से रेल अधिनियम , 1989 (1989 का 24) अभिप्रेत है ;
(ख) " धारा" से अधिनियम की धारा अभिप्रेत है ;
(ग ) " वर्ग रेट" उस वस्तु के लिए वर्ग के अनुसार समानुदेशित किसी वस्तु को लागू भाड़ा दर अभिप्रेत है ;
(घ) " अनुज्ञेय वहन क्षमता " से धारा 72 की उपधारा (2) या उपधारा (3) के अधीन समान्य वहन क्षमता या जहां रेल प्रशासन ने धारा 72 की उपधारा (4) के अधीन परिवर्तित वहन क्षमता अवधारित की है वहां ऐसी परिवर्तित वहन क्षमता, इनमें से जो भी उच्चतर हो, अभिप्रेत है ।
(ङ) " अनुसूची" से इन नियमों की अनुसूची अभिप्रेत है ;
(च) " सामान्य भाड़ा" से अनुज्ञेय वहन क्षमता धन यथास्थितेि , एक टन या दो टन जैसा अनुसूची में विनिर्दिष्ट किया जाए तक लादी गई वस्तु के भार के लिए वर्ग रेट पर किसी वस्तु पर वसूलीय भाड़ा प्रभार अभिप्रेत है ;
(छ) इन नियमों में प्रयुक्त ऐसे शब्दों और पदों का जो अपरिभाषित है किंतु उन्हें अधिनियम में परिभाषित किया गया है, वही अर्थ होगा जो क्रमशः उन्हें अधिनियम में समनुदेशित किया गया है ।

3. अतिलदाई के लिए दंडात्मक प्रभार जहां वस्तुओं की आठ पहिया वैगन में अतिलदाई की जाती है वहां रेल प्रशासन यथास्थिति परेषक, परेषिती या पृष्ठांकिती से अनुज्ञेय वहन क्षमता के ऊपर लादी गई वस्तुओं के संपूर्ण भार के लिए अति लदाई के पता लगाने के स्थान को विचार में लाए बिना वैगन को खींचने वाली रेलगाड़ी के चलने के स्टेशन से गंतव्य स्थान तक तय की गई समस्त दूरी के लिए अनूसूची की स्थिति ' क ' और ' ख ' के भाग 1 , 2 और 3 में बथाउपबंधित दंडात्मक प्रभार वसूल करेगा परंतु यह कि यदि गाड़ी चलने के स्थान पर अतिलदाई का पता चलने की दशा में ग्राहक गाड़ी चलने के स्थान पर भार का समायोजन कर लेता है तो कोई दंडात्मक प्रभार उद्गृहीत नहीं किए जाएंगे ।

स्थिति- क
यदि किसी रेक में समग्र भारयोग रेक की सम्मिलित अनुज्ञेय वहन क्षमता से अधिक नहीं है तो दंडात्मक प्रभार निम्नलिखित के अनुसार उद्गृहीत किए जाने चाहिए :

बी.ओएक्स/बी . ओ एस टी/ बी ओ बी आर और बी ओ बी आर एन वैगनों को छोड़कर आठ पहिया वैगन में लदी हुई ' वर्धित सी सी' वस्तुओं के लिए
अतिभार की सीमा

अनुज्ञेय वहन क्षमता से परे लदे हुए संपूर्ण भार पर उद्गृहीत दंडात्मक प्रभार
यदि वस्तु का भार वैगन की अनुज्ञेय वहन क्षमता से अधिक है ;
(क) दो टम तक
* कुछ नहीं
(ख)दो टन से अधिक
उस वस्तु को लागू भाड़ा दर से दुगना
* शंकाओं को दूर करने के लिए इसके द्वारा यह घोषित किया जाता है कि ऐसी वस्तुओं के लिए समनुदेशित वर्ग को लागू दर पर सामान्य भाड़ा वस्तु के उस भार पर , जो दो टन तक की अनुज्ञेय वहन क्षमता से अधिक हो, वसूलीय होगा ।

बी.ओएक्स/बी. ओ एस टी/बी ओ बी आर और बी ओ बी आर एन वैगनों में लदी हुई ' वर्धित सी सी ' वस्तुओं के लिए
अतिभार की सीमा

* शंकाओं को दूर करने के लिए इसके द्वारा यह घोषित किया जाता है कि ऐसी वस्तुओं के लिए समनुदेशित वर्ग को लागू दर पर सामान्य भाड़ा वस्तु के उस भार पर , जो एक टन तक की अनुज्ञेय वहन क्षमता से अधिक हो, वसूलीय होगा ।
भाग III
सभी प्रकार के आठ पहिया वैगनों में लदी हुई ' सी सी ' वस्तुओं के लिए
अतिभार की सीमा

* शंकाओं को दूर करने के लिए इसके द्वारा यह घोषित किया जाता है कि ऐसी वस्तुओं के लिए समनुदेशित वर्ग को लागु दर पर सामान्य भाडा वस्तु के उस भार पर जो एक टन तक की अनुज्ञेय वहन क्षमता से अधिक हो, वसूलीय होगा ।
स्थिति- ख

* शशंकाओं को दूर करने के लिए इसके द्वारा यह घोषित किया जाता है कि ऐसी वस्तुओं के लिए समनुदेशित वर्ग को लागू दर पर सामान्य भाड़ा वस्तु के उस भार पर , जो दो टन तक की अनुज्ञेय वहन क्षमता से अधिक हो, वसूलीय होगा ।
भाग II
बी.ओएक्स/बी. ओ एस टी/ बी ओ बी आर और बी ओ बी आर एन वैगनों में लदी हुई ' वर्धित सी सी ' वस्तुओं के लिए

* शंकाओं को दूर करने के लिए इसके द्वारा यह घोषित किया जाता है कि ऐसी वस्तुओं के लिए समनुदेशित वर्ग को लागू दर पर सामान्य भाड़ा वस्तु के उस भार पर , जो एक टन तक की अनुज्ञेय वहन क्षमता से अधिक हो , वसूलीय होगा ।

NOTIFICATION
New Delhi , the 23rd December , 2005
G.S.R. 743 (E) . In exercise of the powers conferred by sub - section ( 1 ) read with clause(d) of sub- section(2) of Section 87 of the Railways Act , 1989 , (No. 24 of 1989) and in supersession of the Railways ( Punitive charges for overloading of wagon) Rules , 2004, published in the Gazette of India Part - II , Section 3 (i ) vide 1147 (E) dated the 18th October , 2004 , except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules for punitive charges for overloading of wagons under Section 73 of the said Act , namely: -
1. Short Title and Commencement.-
(1) These rules may be called the Railways ( Punitive charges for overloading of wagon) Rules , 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions . In these rules, unless the context otherwise requires , -
(a) "Act " means the Railways Act, 1989 (No.24 of 1989) ;
(b) " Section " means the section of the Act ;
(c) "class rate " means the freight rate applicable to a commodity as per the class assigned to that commodity;
(d) " Permissible carrying capacity " means the normal carrying capacity determined under sub- section (2) or (3 ) of Section 72 or where a railway administration has determined a varied carrying capacity under sub - section (4) of Section 72, such varied carrying capacity , whichever is higher ,
(e) " Schedule " means the Schedule to these rules ;
(f) "Normal freight " means the freight charge recoverable on a commodity at the class rate for the weight of the commodity loaded upto permissible carrying capacity plus 1 tonne or 2 tonnes , as the case may be , as specified in the Schedule ;
(g) Words and expression used and not defined in these rules but defined in the Act shall have the meaning respectively assigned to them in the Act.
3. Punitive charges for overloading.- Where the commodities are over - loaded in a 8- wheeled wagon, the railway administration shall recover punitive charges as provided in parts I , II and III of the situation ' A ' & ' B ' of the Schedule , from the consignor , the consignee or the endorsee as the case may be , for the entire weight of the commodities loaded beyond the permissible carrying capacity for the entire distance to be traveled by the train hauling the wagon from the originating station to the destination point, irrespective of the point of detection of overloading: provided that no punitive charges will be levied if the customer carries out load adjustment at the originating station itself in case of detection of overloading at originating point .

If the aggregated payload in a rake does not exceed the combined permissible carrying capacity of the rake , the punitive charges should be levied as per following:
Part-1
For Enhanced CC ' commodities loaded in in 8-wheeled wagons excluding BOX/BOST/ BOBR and BOBRN wagons
Extent of overloading
Punitive charges leviable on the entire weight loaded beyond the permissible carrying capacity
If the weight of commodity exceeds the permissible carrying capacity of the wagon;
(a) upto 2 tonnes
Nil*
(b) by more than 2 tonnes
2 times the freight rates applicable to that commodity.
* For removal of doubts , it is hereby declared that the normal freight at the rate applicable to the class assigned to the commodity shall be recoverable on the weight of the commodity exceeding the permissible carrying capacity upto 2 tonnes .
Part- 11
For 'Enhanced CC ' commodities loaded in BOX/BOST/ BOBR and BOBRN wagons
Extent of overloading
Punitive charges leviable on the entire weight loaded beyond the permissible carrying capacity
If the weight of commodity exceeds the permissible carrying capacity of the wagon;
Nil*
(a) upto 1 tonne
(b) by more than 1 tonne
2 times the freight rates applicable to that commodity.
*For removal of doubts , it is hereby declared that the normal freight at the rate applicable to the class assigned to the commodity shall be recoverable, on the weight of the commodity exceeding the permissible carrying capacity upto 1 tonne .

(b) by more than 1 tonne

* For removal of doubts , it is hereby declared that the normal freight at the rate applicable to the class assigned to the commodity shall be recoverable on the weight of the commodity exceeding the permissible carrying capacity upto 1 tonne .
Situation-B
