सा.का.नि. 744(अ) .- बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष, उपाध्यक्ष और सदस्यों को संदेय वेतन और भत्ते तथा सेवा के अन्य निबंधन और शर्तें ) नियम, 2003 का संशोधन करने से संबंधित निम्नलिखित प्रारूप नियम, जिसे केन्द्रीय सरकार बनाना चाहती है , साधारण खंड अधिनियम, 1897 ( 1897 का 10 ) की धारा 22 साथ पठित व्यापार चिह्न अधिनियम, 1999 ( 1999 का 47 ) की धारा 157 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की धारा 157 की उप- धारा ( 1 ) के अधीन अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए, जिनके इससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर, उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है, 15 दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
ऐसे आक्षेप या सुझाव पर, जो उक्त प्रारूप नियमों के संबंध में, उपरोक्त विनिर्दिष्ट अवधि की समाप्ति के भीतर किसी व्यक्ति से प्राप्त हो सकेंगे, केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
आक्षेप या सुझाव , यदि कोई हो, सचिव, भारत सरकार, वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) उद्योग भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ।
प्रारूपनियम
( 1 ) इन नियमों का संक्षिप्त नाम बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष , उपाध्यक्ष और सदस्यों को संदेय वेतन और भत्ते तथा सेवा के अन्य निबंधन और शर्तें ) संशोधन नियम , 2005 है ।
(2) ये 15 सितंबर , 2003 को प्रवृत्त हुआ समझा जाएगा ।
3. बौद्धिक संपदा अपील बोर्ड ( अध्यक्ष , उपाध्यक्ष और सदस्यों को संदेय वेतन और भत्ते तथा सेवा के अन्य निबंधन और शर्तें नियम, 2003 के, नियम 3 में, " अन्य सदस्य प्रतिमास बाईस हजार चार सौ रुपए - छह सौ छब्बीस हजार रुपए के वेतनमान के हकदार होंगे " शब्दों के स्थान पर " अन्य सदस्य प्रतिमास बाईस हजार चार सौ रुपए - पांच सौ पच्चीस- चौबीस हजार पांच सौ रुपए के वेतनमान के हकदार होंगे " शब्द रखे जाएंगे ।

NOTIFICATION
New Delhi , 23rd December, 2005
G.SR. 744 (E ). The following draft rules relating to amendment of the Intellectual Property Appellate Board (Salaries and allowances payable to; and other terms and conditions of service of the Chairman, Vice- Chairman and Members) Rules , 2003 which the Central Government proposes to make in exercise of the powers conferred by Section 157 ofthe Trade Marks Act , 1999 (47 of 1999 ) , read with Section 22 of the General Clauses Act, 1897 ( 10 of 1897 ) , is hereby published as quired under sub -section ( 1 ) of Section 157 of the said Act, for information of all persons likely to be affected hereby and notice is herby given that the said draft rules will be taken into consideration after expiry of a period of fifteen days from the date on which the copies of the Official Gazette in which this notification is published, are made available to the public;
Any objection or suggestion which may be received from any person in respect of the said draft rules within expiry ofthe period specified above will be considered by the Central Government.
Objections or suggestions , if any, may be addressed to the Secretary to the Government of India, Ministry of Commerce and Industry (Department of Industrial Policy & Promotion) , Udyog Bhavan , New Delhi - 110011 .
DRAFT RULES
(1) These rules may be called the Intellectual Property Appellate Board ( Salaries and allowances payable to , and other terms and conditions of service of Chairman, Vice - Chairman and Members ) Amendment Rules , 2005 .
(2) They shall be deemed to have come into force on the 15th day of September , 2003 .
3. In the Intellectual Property Appellate Board (Salaries and allowances payable to, and other terms and conditions ofservice ofthe Chairman , Vice- Chairman and Members ) Rules , 2003 , in rule 3 , for the words " other Members shall be entitled toapay in the scale ofRupees Twenty two thousand four hundred-six hundred-twenty - six thousand per month , the words " other Members shall be entitled to a pay in the scale of Rupees twenty- two thousand four hudnred-five hundred twenty- five- twenty- four thousand five hundred " shall be substituted.
