का.आ. 1819(अ) . जबकि मुम्बई डॉक लेबर बोर्ड, पिछले कई वर्षों से वित्तीय तंगी का सामना कर रहा था और वह अपने कर्मचारियों और रजिस्ट्रीकृत कर्मकारों को मज़दूरी का भुगतान करने में असमर्थ था;
और जबकिविभिन्न पहलुओं पर विचार करने के पश्चात् केन्द्रीय सरकार ने यह राय कायम की कि गंभीर वित्तीय आपात स्थिति विद्यमान थी, जिसके कारण बोर्ड अपने कृत्यों का अनुपालन करने में असमर्थ था;
और जबकि उक्त बोर्ड को, केन्द्रीय सरकार द्वारा , डॉक कर्मकार ( नियोजन का विनियमन ) अधिनियम , 1948 ( 1948 का 9 ) की धारा 6ख की उप- धारा ( 1 ) के खंड ( क ) के अनुसार, भारत सरकार के पहले के जल भूतल परिवहन मंत्रालय की तारीख 25 फरवरी, 1994 की अधिसूचना सं. का.आ. 204 ( अ ) द्वारा एक वर्ष की अवधि के लिए अधिक्रान्त कर दिया गया था और वे सभी अधिकार और कृत्य, ऐसे अधिक्रमण की अवधिके दौरान अध्यक्ष, मुम्बई पत्त्न न्यास , मुम्बई को दे दिए गए जिनका उक्त बोर्ड द्वारा प्रयोग या पालन किया जा सकता था ।
और जबकिकेन्द्रीय सरकार ने उपर्युक्त अधिक्रमण की अवधि को भारत सरकार के पहले के जल भूतल परिवहन मंत्रालय की तारीख 2 सितम्बर, 1995 की अधिसूचना सं. का.आ. 113 ( अ ) , तारीख 23 दिसम्बर, 1996 की अधिसूचना सं. का. आ. 892 ( अ ) , तारीख 30 दिसम्बर, 1997 की अधिसूचना सं. का.आ. 925 (अ ) , तारीख 24 दिसम्बर, 1998 की अधिसूचना सं. का.आ. 1114( अ) , तारीख 20 दिसम्बर, 1999 की अधिसूचना सं. का.आ. 1252 ( अ) और पोत परिवहन मंत्रालय की, तारीख 26 दिसम्बर, 2000 की अधिसूचना सं. का.आ. 1161 (अ ) , तारीख 31-12-2001 की अधिसूचना सं . का. आ. 4( अ ) , तारीख 31-12-2002 की अधिसूचना सं. का. आ. 1392 ( अ ) , तारीख 26-12-2003 की अधिसूचना सं . का.आ. 1467( अ ) और तारीख 13-12-2004कीअधिसूचना सं. का.आ. 1374 ( अ ) द्वारा बढ़ा दिया गया ।
और जबकि उपर्युक्त अधिक्रमण का विस्तार, 31 दिसम्बर, 2005 को समाप्त हो रहा है ;
अलग से और जबकि केन्द्रीय सरकार, उपर्युक्त अधिक्रमण की अवधि को बढ़ाना आवश्यक समझती है ।
अतः अब केन्द्रीय सरकार उक्त अधिनियम की धारा 6 ख की उप- धारा ( 3 ) के खंड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त बोर्ड के अधिक्रमण की अवधि को 31 दिसम्बर, 2006 तक या मुम्बई डॉक लेबर बोर्ड के पत्तन न्यास में विलयन के प्रवृत्त होने की तीरख तक, इनमें से जो पहले हो, बढ़ाती है ।
ऐसे अधिक्रमण की अवधि के दौरान अध्यक्ष , मुम्बई पत्तन न्यास द्वारा उन सभी शक्तियों और कृत्यों का प्रयोग या पालन किया जाएगा, जिनका उक्त बोर्ड द्वारा प्रयोग या पालन किया जा सकता था ।

NOTIFICATION
New Delhi , the 27th December , 2005
S: O. 1819 (E). Whereas the Bombay Dock Labour Board, Bombay was facing financial stringency for the last several years and was unable to pay wages to its employees and registered workers ;
And whereas after considering the various aspects , the Central Government formed an opinion that a grave financial emergency existed due to which the Board was unable to perform its functions ;
And whereas the said Board was superseded by the Central Government under clause (a ) of Sub - section ( 1 ) of Section 6B of the Dock Workers (Regulation of Employment) Act , 1948 (9 of 1948 ), vide Notification of the Government of India inthe erstwhile Ministry of Surface Transport , Number S.O. 204 (E ) , dated the 25th February, 1994, for a period of one yearandall the powers and functions which might be exercised or performed by the said Board were vested in the Chairman, Bombay Port Trust , Bombay during the period of such pupersession;
Andwhereas the Central Government extended the periods of supersession vide notifications of the Government of India in the erstwhile Ministry of Surface Transport number S.O. 113 (E ) , dated the 2nd September , 1995, S.O. 892 (Ε) , dated the 23rd December, 1996, S.O. 925 (E) , dated the 30th December, 1997 ; S.O. 1114 (E ) , dated the 24th December , 1998 ; S.O. 1252 (E) , dated the 20th December, 1999 ; and Ministry of Shipping Number S.O. 1161 (E) dated the 26th December, 2000 ; NotificationNo. S.O. No. 4(E) dated 31-12-2001 , S.O. No. 1392 (E) dated 31-12-2002 , S.O. No. 1467 (E) dated 26-12-2003 and S.O. No. 1374 (E) dated 13-12-2004 .
And whereas the extension of supersession expires on the 31st December, 2005;
Andwhereas the Central Government considers it necessary to extend the period of supersession ;
Now, therefore, in exercise of the powers conferred by clause (a) of Sub - section (3 ) of Section 6B of the said Act , the Central Government hereby extends the period of supersession of the Board till the 31st December, 2006 or the date of coming into force of the merger of Bombay Dock Labour Board with Mumbai Port Trust , whichever is earlier .
All the powers and functions, which may be exercised or performed by the said Board shall be exercised or performedby the Chairman , Mumbai Port Trust , Mumbai during the period of such supersession .
