विदेशी मुद्रा प्रबंध (विदेशी मुद्रा व्युत्पन्न संविदा ) ( संशोधन ) विनियमावली, 2005
सा.का.नि. 750 (अ) .-विदेशी मुद्रा प्रबंध अधिनियम, 1999 ( 1999 का अधिनियम 42 ) की धारा 47 के उप - खण्ड ( 2 ) के खण्ड ( ज ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय रिजर्व बैंक, विदेशी मुद्रा प्रबंध ( विदेशी मुद्रा व्युत्पन संविदा ) विनियमावली, 2000 ( दिनांक 3 मई, 2000 की अधिसूचना सं. फेमा 25/2000- आरबी ) में निम्नलिखित संशोधन करता है , अर्थात्: -
1. संक्षिप्त नाम और प्रारंभ
( i ) ये विनियम विदेशी मुद्रा प्रबंध ( विदेशी मुद्रा व्युत्पन्न संविदा) विनियमावली , 2005 कहलाएंगे ।
( ii ) ये जुलाई 7, 2003 * से लागू होंगे ।
2. विनियमावली में संशोधन.-
विदेशी मुद्रा प्रबंध ( विदेशी मुद्रा व्युत्पन्न संविदा ) विनियमावली, 2000 में, -
( i ) शीर्षक " आ. वायदा संविदा से इतर संविदा " के अंतर्गत अनुसूची I में पैरा 3 में :-
(क) उप पैराग्राफ ( 1 ) में, " भारत में निवास करने वाला कोई व्यक्ति विदेशी मुद्रा विकल्प संविदा कर सकता है " शब्दों के बाद " एक मुद्राके रूप में रुपए को न शामिल करते हुए " शब्दों को जोड़ा जाएगा ।
(ख) उप पैराग्राफ ( 2 ) के बाद निम्नलिखित नया पैरा जोड़ा जाएगा, अर्थात्: -
" ( 3) भारत में निवासी कोई व्यक्ति किसी लेन देन के संबंध में, जिसके लिए अधिनियम के तहत अथवा उसके तहत बनाए अथवा जारी किए गए नियमों अथवा विनियमों अथवा निदेशों अथवा आदेशों के तहत विदेशी मुद्रा की बिक्री और/ अथवा खरीद की अनुमति दी जाती

है, वायदा संविदा पर लागू शर्तों के समान शर्तों पर विनियम जोखिम कि हेजिंग के लिए किसी प्राधिकृत व्यापारी के साथ किसी विदेशी मुद्रा- रुपयाविकल्प संविदा कर सकता है । "
(ii ) पैरा 3 आ के बाद अनुसूची II , में निम्नलिखित नया पैराग्राफ जोड़ा जाएगा , अर्थात्: -
" 4. भारत में विदेशी प्रत्यक्ष निवेश करने वाला कोई विदेशी संस्थागत निवेशक, कोई अनिवासी भारतीय अथवा भारत से बाहर रहने वाला कोई व्यक्ति वायदा संविदा पर लागू शर्तों के समान शर्तों के तहत भारत में किसी प्राधिकारी व्यापारी के साथ विदेशी मुद्रा- रुपया विकल्प संविदा कर सकता है । "

पाद टिप्पणी : 1. * यह स्पष्ट किया जाता है कि इस विनियम के पूर्व प्रभावी होने से किसी भी व्यक्ति पर प्रतिकूल प्रभाव नहीं पड़ेगा ।
2. ये मूल विनियम मई 8 , 2000 के सं. सा.का.नि. 411 ( अ ) भाग II , खण्ड 3 , उप- खण्ड (1 ) में प्रकाशित किए गए तथा बाद में संशोधित किए गए, देखिए: -

Foreign Exchange Management (Foreign exchange derivative contracts) (Amendment) Regulations, 2005 G.S.R. 750 (E) .-In exercise of the powers conferred by clause (h) of Sub- section (2) of Section 47 of the Foreign ExchangeManagement Act, 1999 (42 of 1999 ) , the Reserve Bank of India makes the following amendments in the Foreign Exchange Management (Foreign Exchange Derivative Contracts) Regulations , 2000 (Notification No. FEMA 25 /RB - 2000 datedMay 3 , 2000) , namely:-
1. Short Title and commencement :-
(i) These Regulations may be called the Foreign Exchange Management ( Foreign Exchange Derivative Con tracts) (Amendment ) Regulations , 2005.
(i ) They shall come into force from July 7 , 2003.* .
2. Amendment of the Regulations :-
Inthe Foreign Exchange Management (Foreign Exchange Derivative Contracts) Regulations , 2000- (i) in Schedule I under the heading ' B. Contract other than Forward Contract ' in paragraph 3:
(a) in sub - paragraph (1 ) after the words " A person resident in India may enter into a foreign currency option contract", the words " not involving the rupee as one of the currencies " shall be inserted;
(b) after sub- paragraph (2) , the following new sub paragraph shall be inserted namely :--
"(3) Aperson resident in India may enter into a foreign currency - rupee option contract with an authorised dealer to hedge an exposure to exchange risk in respect of a transaction for which sale and/ or purchase of foreign currency is permitted under the Act or the rules or regulations or directions or orders made or issued भारत का राजपत्र : असाधारण

there under on the same terms and conditions applicable to forward contracts. "
(ii) In Schedule II after the paragraph 3B the following new paragraph shall be inserted, namely :---
"4. A Foreign Institutional Investor , a Non -Resident Indian or a Person Resident outside India having Foreign Direct Investment in India , may enter into a foreign currency -rupee option contract with an authorised dealer in India , under the same terms and conditions applicable to forward contracts ."
