सा.का.नि. 753 ( अ ).- राष्ट्रपति, भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों और इन निमित्त उन्हें समर्थ करने वाली सभी अन्य शक्तियों का प्रयोग करते हुए, आय -कर अपील अधिकरण सदस्य ( भर्ती और सेवा की शर्तें ) नियम , 1963 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम आय- कर अपील अधिकरण सदस्य ( भर्ती और सेवा की शर्तें ) दूसरा संशोधन नियम, 2005है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. आय- कर अपील अधिकरण सदस्य ( भर्ती और सेवा की शर्तें ) नियम, 1963 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) के नियम 2 के खंड ( ग ) में " 11 , 12 और 13 में अध्यक्ष सम्मिलित नहींहै, " अंकों और शब्दों के स्थान पर " 12 और 13 में अध्यक्ष, ज्येष्ठ उपाध्यक्ष और उपाध्यक्ष सम्मिलित नहीं है, " अंक और शब्द रखे जाएंगे ।
3. मूल नियम में, नियम 11 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
" 11. सेवानिवृत्ति- ( क ) अध्यक्ष की सेवानिवृत्ति की तारीख वह तारीख होगी जिसको वह पेंसठ वर्ष की आयु प्राप्त करता है ;
(ख ) ज्येष्ठ उपाध्यक्ष, उपाध्यक्ष और सदस्य कीसेवानिवृत्ति की तारीख वह तारीख होगी
जिसको वे बासठ वर्ष की आयु प्राप्त करते हैं ;
और मास की वह अंतिम तारीख नहीं होगी जैसा अन्य सरकारी सेवकों की दशा में है । "

NOTIFICATION
New Delhi , the 29th December, 2005
G.S.R. 753(E) . In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and of all other powers enabling him in that behalf, the President hereby makes the following rules further to amend the Income -taxAppellate Tribunal Members (Recruitment and Conditions ofService ) Rules , 1963 , namely :-
1. (1) These rules may be called the Income-tax Appellate Tribunal Members ( Recruitment and Conditions of Service ) Second Amend- ment Rules, 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Income-Tax Appellate Tribunal Members (Recruitment and Conditions of Service ) Rules, 1963 ( here- inafter referredtoas the principal Rules) , in rule 2, in clause (c), for the figures and words " 11 , 12 and 13 does not in- clude the President ; " , the figures and words " 12 and 13 does not include the President, Senior Vice -President and Vice- President " shall be substituted.
3. In the principal Rules , for rule 11, the following shall be substituted, namely:-
"11. Retirement The date of retirement of,--
(a) the President shall be the date on which he attains the age of sixty - five years;
(b) the Senior Vice - President , Vice-President and Member shall be the date on which they attain the age of sixty - two years ;
and not the last date of the month as in the case of other Government servants . "
