का.आ. 1842 ( अ ) .- पशुधन आयात अधिनियम, 1898 (1898 का 9 ) के खंड-3 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार, इसमें विनिर्दिष्ट तरीके से भारत में पशुमूल के पालतू पशु आहार उत्पादों के आयात को निषिद्ध, प्रतिबंधित अथवा विनियमित करती है और उक्त प्रयोजन के लिए निम्नलिखित आदेश बनाती है, नामतः-

1. संक्षिप्त नाम और प्रारंभ (1 ) इस आदेश का नाम पशु मूल के पालतू पशु आहार उत्पाद (भारत में आयात) आदेश , 2005 होगा ।

(2) यह सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगा।

2. परिभाषा- इस आदेश में जब तक संदर्भित न हो , निम्न अपेक्षित होगाः-

(क) ' खेप ' का तात्पर्य पशु मूल के पालतू पशु उत्पादों की ऐसी पूरी मात्रा से है जिसकी खेप एक पक्ष द्वारा दूसरे पक्ष को एक बार में भेजी गई हो और वह सफाई आयात प्रमाण - पत्र, सीमा शुल्क अथवा पोत प्रविष्टि बिल अथवा एयरवेज बिल अथवा इनवाइस द्वारा कवर की गई हो;

(ख) 'नामित सक्षम प्राधिकारी ' से तात्पर्य संयुक्त सचिव (व्यापार) , भारत सरकार, पशुपालन, डेयरी और मत्स्यपालन विभाग, कृषि मंत्रालय है;

(ग) ' फार्म " से तात्पर्य इस आदेश के साथ संलग्न फार्म है;

(घ) 'आयात ' से तात्पर्य भारत के प्रदेश में किसी नामित स्थान पर किसी प्रकार के पालतू पशु आहार उत्पाद को लाना है;

(ड. ) 'आयात जोखिम विश्लेषण " से तात्पर्य पशु मूल के पालतू पशु आहार उत्पाद के आयात को विनियमित करने का निर्धारण करने के लिए जैविक अथवा अन्य वैज्ञानिक और आर्थिक प्रमाण का विश्लेषण करने की प्रक्रिया और इसके विरूद्ध उठाए जाने वाले स्वच्छता और फिटो स्वच्छता उपाय है ;

(च) "निरीक्षण प्राधिकारी ' से तात्पर्य दिल्ली, मुम्बई , कोलकाता अथवा चैन्नई में पशु संगरोध प्रमाणीकरण केंद्र का प्रभारी अथवा सरकारी राजपत्र में अधिसूचना द्वारा सरकार द्वारा विनिर्दिष्ट कोई अन्य अधिकारी है;

(छ) ' प्रयोगशाला ' से तात्पर्य उत्पादों के परीक्षण के लिए भारत सरकार, कृषि मंत्रालय द्वारा स्वीकृत और अधिसूचित प्रयोगशाला है ;

(ज) ' पशु मूल का पालतू पशु आहार उत्पाद ' से तात्पर्य कुत्ते अथवा बिल्ली को आहार देने के लिए प्रयुक्त पौषणिक दृष्टि से पशु मूल के सभी प्रकार के खाद्य अवयव निहित किसी प्रकार का आहार और खुदरा बिक्री के लिए रखे गए कुत्ते अथवा बिल्ली के आहार से संबंधित आईटीसी- एचएस कोड 2309.10.00 के तहत शामिल आहार है;

(झ) ' प्रवेश का पत्तन ' से तात्पर्य ऐसा कोई समुद्री पत्तन, हवाई अड्डा अथवा भूमि सीमा चेकपोस्ट अथवा कोई ऐसा अन्य पत्तन है जिसे सरकारी पत्र में अधिसूचना द्वारा केंद्र सरकार द्वारा समय - समय पर विनिर्दिष्ट किया गया हो;

(ञ) 'विनियमित वस्तुओं से तात्पर्य ऐसी कोई वस्तुएं हैं जिनका आयात इस आदेश द्वारा विनियमित हो;

(ट) 'जोखिम विश्लेषण समिति ' से तात्पर्य पशुपालन आयुक्त, पशुपालन, डेयरी और मत्स्यपालन विभाग , कृषि मंत्रालय की अध्यक्षता में कार्यरत विशेषज्ञों की समिति है;

(ठ) 'स्वच्छता स्थिति ' से तात्पर्य विनिर्दिष्ट उत्पादों के लिए जोखिम विश्लेषण करने के बाद जोखिम विश्लेषण समिति द्वारा निर्धारित स्थिति है;

(ड) 'स्वच्छता आयात परमिट ' से तात्पर्य ऐसा सरकारी दस्तावेज है जिसके द्वारा विनिर्दिष्ट स्वच्छता अपेक्षाओं के अनुसार खेप के आयात को प्राधिकृत किया गया हो ;

(ढ) ' अनुसूची " से तात्पर्य इस आदेश के साथ संलग्न अनुसूची है;

3. पशु मूल के पालतू पशु आहार उत्पाद के आयात के लिए सामान्य शर्तें - पशु मूल के किसी पालतू पशु आहार उत्पाद को भारत में आयात करने के लिए केंद्र सरकार द्वारा निम्नलिखित शर्तों पर अनुमति दी जाएगी, नामतः-

( i) पशु मूल के पालतू पशु आहार उत्पाद की किसी खेप को उप धारा ( iv) के तहत जारी वैद्य स्वच्छता आयात परमिट के बिना भारत में आयात नहीं किया जाएगा ।

(ii) भूमि, वायु अथवा समुद्री मार्ग द्वारा पशु मूल के पालतू पशु आहार की खेपों का आयात करने के लिए परमिट देने के लिए सभी आवेदन पत्र नामित सक्षम प्राधिकारी को कम से कम एक महीने पहले फार्म ए अथवा फार्म बी, जैसा भी मामला हो, में 5 प्रतियों में भेजे जाएंगे और प्रत्येक मद के आयात के लिए आवेदन- पत्र इस आदेश में निर्धारित तरीके से फार्म ए अथवा फार्म बी, जैसा भी मामला हो में, अलग -अलग दिए जाएंगे ।

(iii) यदि विस्तृत आयात जोखिम विश्लेषण करने के बाद सक्षम प्राधिकारी इस बात से संतुष्ट हो जाते हैं कि आयात की जाने वाली खेप से भारत में पशुओं अथवा मनुष्यों अथवा दोनों के स्वास्थ्य पर प्रतिकूल प्रभाव नहीं पड़ेगा तो स्वच्छता आयात परमिट पशु मूल के पालतू पशु आहार उत्पाद के आयात के लिए जारी किया जाएगा ।

(iv) उत्पादों के आयात की अनुमति स्वच्छता आयात परमिट पर दी जाएगी जिसे पशुपालन , डेयरी और मत्स्यपालन विभाग द्वारा आयात जोखिम विश्लेषण के आधार पर अनुसूची 1 में विनिर्दिष्ट स्वच्छता स्थितियों की शर्त पर जारी किया जाएगा ।

(v) अभ्यावेदन करने वाले आवेदक को उचित नोटिस देने के बाद जारी करने वाले प्राधिकारी द्वारा परमिट को जारी करने से मना किया जा सकता है अथवा रोका जा सकता है और इसके कारण लिखित में दर्ज किए जाएंगे ।

(vi) आयात परमिट में विशिष्ट स्वच्छता शर्तें दी गई होनी चाहिए जैसा कि आयात परमिट के आधार पर भरी जानी वाली अनुसूची 1 में दिया गया है ।

(vii) अनुसूची- 2 में विनिर्दिष्ट देशों से पशु मूल के पालतू पशु आहार के उत्पादों के आयात पर रोक लगाई जाएगी ।

(viii ) परमिट में संगरोध निरीक्षणों, नमूनाकरण तथा परीक्षण के संबंध में आयात के बाद की आवश्यकताओं को भी निर्दिष्ट किया जाएगा ।

होगा । (ix) इस धारा के तहत जारी आयात परमिट छः माह की अवधि के लिए वैद्य

(*) आयात परमिट अहस्तांतरणीय होगा तथा केंद्र सरकार के अनुमोदन के अधीन लिखित में दिए गए कारणों के अलावा किसी अन्य कारण से आयात परमिटों में कोई बद‌लाव नहीं किया जाएगा ।

(xi) भारत में पशु मूल के पालतू पशु आहार उत्पाद दिल्ली, मुम्बई, कोलकाता अथवा चचैन्नई अथवा केंद्र सरकार द्वारा सरकारी गजट में अधिसूचित अन्य विशिष्ट स्थलों से स्थल मार्ग , समुद्री मार्ग अथवा हवाई अड्डों से आयातित किए जाएंगे।

4. पशु मूल के पालतू पशु आहार उत्पाद का निरीक्षण एवं परीक्षणः- (i ) प्रवेश स्थान पर पहुंचने पर स्वच्छता आयात परमिट तथा इस विभाग द्वारा समय - समय पर जारी सामान्य दिशा- निर्देशों में निहित विशिष्ट शर्तों के अनुसार जहाँ भी आवश्यक होगा , पालतू पशु आहार उत्पाद की खेप की पशु संगरोध एवं प्रमाणीकरण सेवा केंद्र के प्रभारी अधिकारी द्वारा अथवा पशुपालन, डेयरी और मत्स्यपालन विभाग , भारत सरकार द्वारा विधिवत प्राधिकृत किसी अन्य पशुचिकित्सा अधिकारी द्वारा जांच की जाएगी ।

(2) आवेदक को प्राधिकृत सक्षम प्राधिकरण द्वारा अनुमोदित प्रयोगशाला द्वारा खेप की जांच करानी होगी ।

(3 ) निरीक्षण तथा परीक्षण के बाद, जहाँ भी आवश्यक होगा, संबंधित संगरोध अथवा पशुचिकित्सा प्राधिकारी भारत में पशु मूल के पालतू पशु आहार उत्पाद के प्रवेश को संगरोध आधार पर प्रवेश देने की मंजूरी देगा अथवा , यदि जनहित में आवश्यक हुआ तो इसको नष्ट करने अथवा मूल देश को वापिस भेजने का आदेश देगा ।

(4) जहां भी पशु मूल के पालतू पशु आहार उत्पाद के संबंध में इन्फेक्शन मुक्त करने अथवा किसी अन्य उपचार की आवश्यकता होगी , आयातक भारत सरकार के पशुपालन, डेयरी और मत्स्यपालन विभाग द्वारा अनुमोदित एजेंसी के जरिए अपनी लागत से विधिवत प्राधिकृत संगरोध अथवा पशुचिकित्सा अधिकारी की निगरानी में खेप को इन्फेक्शन मुक्त अथवा अन्य उपचार कराएगा।

5. आयातक की जिम्मेवारीः- आयात करने वाले की यह जिम्मेवारी होगीः-

(i) पालतू पशु आहार उत्पाद को संबंधित पशु संगरोध तथा प्रमाणीकरण सेवा केंद्र पर अथवा पशुचिकित्सा अधिकारी द्वारा संगरोध अथवा अपनी ओर से विधिवत प्राधिकृत निरीक्षण स्थल , इन्फेक्शन मुक्त करने के स्थान अथवा उपचार अथवा परीक्षण स्थल पर लाएगा ।

(ii ) पशु संगरोध केंद्र पर खेप को खोलने, पुनः पैक करने तथा खेप चढ़ाने अथवा उतारने का कार्य करेगा तथा खेप पर सील लगाएगा; और

( iii) भारत सरकार के पशुपालन, डेयरी और मत्स्यपालन विभाग द्वारा विधिवत प्राधिकृत संगरोध अथवा पशुचिकित्सा अधिकारी के दिशा- निर्देशों के अनुसार, जैसा भी मामला हो, निरीक्षण तथा उपचार अथवा परीक्षण के बाद खेप को हटाएगा ।

6. शर्तों को शिथिल करने की केंद्र सरकार की शक्तिः केंद्र सरकार जनहित में तथा लिखित में दिए गए कारणों के लिए भारत में पशु मूल के पालतू पशु आहार उत्पाद के आयात के संबंध में दिए गए सभी अथवा किसी परमिट पर शर्तों को शिथिल कर सकती है ।

7. प्रवेश के बाद संगरोध की आवश्यकताएं :- ( 1 ) भारत में पालतू पशु आहार उत्पाद की खेप तथा कागजातों के पहुंचने पर उनकी केंद्र सरकार द्वारा नामित

निरीक्षण प्राधिकारी द्वारा जांच की जाएगी ।

(2) भारत में पशु मूल के पालतू पशु आहार की खेप पहुंचने पर, रोगों, कीटनाशकों के संबंध में जोखिम विश्लेषण के लिए परीक्षण हेतु तथा उसी प्रकार बिक्री से पूर्व भी खेप से नमूने लिए जाएंगे ।

(3) किसी रोग , कीटनाशक अथवा अन्य जोखिम कारक के सकारात्मक लक्षण पाए जाने पर भारत सरकार के पशुपालन, डेयरी और मत्स्यपालन विभाग द्वारा आयात करने वाली एजेंसी की लागत पर उचित कार्रवाई की जाएगी ।

(4) भारत में पशु मूल के पालतू पशु उत्पाद के पहुंचने पर आयात करने वाली एजेंसी केंद्र सरकार को तत्काल आश्वासन देगी ।

(क) आयातित उत्पाद कुत्तों तथा बिल्लियों के अलावा पशु आहार श्रृंखला के लिए नहीं होगी;

(ख) बच्चे हुए उत्पाद को जलाकर नष्ट कर दिया जाएगा; तथा

(ग) पशु मूल के पालतू पशु आहार उत्पाद पर लेबल लगाने का कार्य गंतव्य स्थान की स्थानीय अथवा क्षेत्रीय भाषा में होगा ।

स्वच्छता संबंधी शर्तें

1. निर्यातक देश हाइली पैथोजेनिक एविएन इंफ्लजूएंजा (एचपीएआई ) से मुक्त है।

2. निम्नलिखित को छोड़कर जुगाली करने वाले छोटे पशुओं के मूल के किसी घटक को पशु मूल के पालतू पशु आहार के उत्पादों में शामिल नहीं किया गया है, नामतः

(i) दुग्ध एवं दुग्ध उत्पाद;

(ii ) ओवाइन अथवा कैप्राइन मूल का प्रोटीन मुक्त टैलो; तथा

(iii) टीएसई समूह के रोगों से मुक्त देशों से आयातित ओवाइन अथवा कैप्राइन सामग्रियों अथवा अवयवों को पालतु पशु आहार में शामिल किया गया है तथा निम्नलिखित सूचना दी जाएगी; नामतः

(क) अवयवों का ब्यौरा;

(ख) प्रमाण-पत्रों की संख्या;

(ग) मूल देश;

(घ) अवयव के लिए प्रमाण - पत्र जारी करने वाले पशु स्वास्थ्य अधिकारी का नाम;

(ड. ) प्रमाण-पत्र को मंजूरी देने की तिथि;

3. 30 मिनट तक 70 डिग्री सेण्टीग्रेट तक आन्तरिक तापक्रम प्राप्त करने के लिए पशु मूल के पालतू पशु आहार उत्पादों के प्रमाणित सामग्रियों अथवा पशुमूल अवयवों को प्रसंस्कृत किया गया है अथवा इसका प्रसंस्करण पशुपालन, डेयरी और मत्स्यपालन विभाग में भारत सरकार द्वारा अनुमोदित माइक्रोबायलाजिकल सुरक्षा के बारे में समतुल्य गारंटी देने वाली एक वैकल्पिक पद्धति के माध्यम से किया गया है ।

पशु मूल के पालतू पशु आहार के आयात के लिए प्रतिबंधित देशों की सूची

1. यदि पशु मूल के पालतू पशु आहार उत्पाद में कुक्कुट अथवा किसी भी प्रकार के पक्षी मूल के कोई मीट अथवा इसके उत्पाद, खाद्य योग्य अथवा गैर- खाद्य योग्य अवयव अथवा टिस्सू पाया जाता है तो , इसकी शुरूआत हाइली पैथोजेनिक एवियन इंफ्लूएंजा वाले देशों से होती है ।

2. यदि पशु मूल के पालतू पशु आहार उत्पाद में जुगाली करने वाले छोटे पशु मूल के मीट अथवा इसके उत्पाद, खाद्य योग्य अथवा गैर- खाद्य योग्य अवयव अथवा टिस्सू पाए जाते हैं तो इसकी शुरूआत संचारित स्पांगिफार्म इन्सेफालोपेथी वाले देशों से होती है।

NOTIFICATION

NewDelhi , the 29th December , 2005

S.O. 1842 (E ). In exercise of the powers conferred by section 3A of the Live - stock Importation Act, 1898 ( 9 of 1898 ) , the Central Government hereby prohibits , restricts or regulates the import of pet food products of animal origin into India in the manner specified herein and for the said purpose makes the following Order , namely:-

1. Short title and commencement.-( 1 ) This Order may be called the Pet Food Products of Animal Origin ( Import into India) Order , 2005 .

(2) It shall come into force on the date of its publication in the Official Gazette .

2. Definitions . - In this Order , unless the context otherwise requires , -

(a) " consignment" means any quantity of pet food products of animal origin consigned from one party to another at one time shipment and covered by a Sanitary Import Certificate, bill of entry of custom or shipping or airways bill or invoice ;

(b) "Designated Competent Authority" means the Joint Secretary (Trade) , Government of India, Department of Animal Husbandry , Dairying and Fisheries , Ministry ofAgriculture ;

(d) " import " means an act of bringing into a designated place in the territory of India any kind of pet food product ;

(e) " Import Risk Analysis " means the process of evaluating biological or other scientific and economic evidence to determine for regulating the import of the pet food product of animal origin and the sanitary and phyto - sanitary measures to be takenagainst it ;

(f) " Inspection Authority " means the In- charge of animal quarantine certification centre at Delhi , Mumbai, Kolkata or Chennai or any other officer specified by the Government by notification in the Official Gazette;

(g) " laboratory" means any laboratory approved and notified by the Government of India in the Ministry of Agriculture for testing the products;

(h) "pet food product of animal origin" means any food containing all kinds of edible ingredient from animal origin from nutritional point of view used for feeding the dog or cat and covered under the ITC- HS Code 2309.10.00 relating to dog or cat food put up for retail sale;

(i) "port of entry" means any sea port , airport or land border check post or any other port as specified by the Central Government notification in the Official Gazette, from time to time;

(j ) "regulated article " means any article , the import of which is regulated by this Order;

(k) "Risk Analysis Committee " means the committee of experts functioning under the chairmanship of the Animal Husbandry Commissioner of the Department of Animal Husbandry, Dairying and Fisheries in the Ministry of Agriculture;

(1 ) " sanitary conditions " means the conditions laid down by the Risk Analysis Committee after conducting the risk analysis for the specified product ;

(m) "Sanitary Import Permit " means an official document authorizing importation of a consignment in accordance with specified sanitary requirements ;

(n) " Schedule" means a schedule appended to this Order .

3. General conditions for Import pet food product of animal origin.- Any pet food product of animal origin shall be permitted by the Central Government to be imported into India subject to the following conditions, namely: -

(i) No consignment of pet food product of animal origin shall be imported into India without a valid sanitary import permit issued under sub- clause (iv).

(ii) All applications for grant of permit to import consignments of pet food product of animal origin by land , air or sea shall be sent in five copies in Form A or Form B, whichever is relevant, at least one month in advance to the Designated Competent Authority and the application for the import of each item shall be made separately in Form A or B , as the case may be, in the manner laid down in this Order .

(iii) The sanitary import permit shall be issued for import of pet food product of animal origin if, after a detailed import risk analysis , the concerned authorities are satisfied that the import of the consignment shall not adversely affect the health of the animal or human beings or both in India.

agency approved by the Government of India in the Department of Animal Husbandry, Dairying and Fisheries , arrange for disinfection or other treatment of the consignment , under the supervision of a duly authorised quarantine or veterinary officer .

5. Responsibilities of importer. - It shall be the responsibility of the importer -

(i) to bring the pet food product to the concerned Animal Quarantine and Certification Services Station, or to the place of inspection , disinfection or treatment or testing as directed by the Quarantine or veterinary officer duly authorized on this behalf;

(ii) to open, repack and load into or unload from the Animal Quarantine Station and seal the consignment ; and

(iii) to remove the consignment after inspection and treatment or testing , as the case may be, in accordance with the directions of the Quarantine or veterinary officer duly authorized by the Government of India in the Department of Animal Husbandry, Dairying and Fisheries .

6. Power of Central Government to relax conditions . The Central Government may, in public interest , and for reasons to be recorded in writing relax any of the conditions specified in this Order relating to all or any permit granted in relation to the import of pet food product of animal origin into India.

7. Post entry quarantine requirement.- ( 1 ) On arrival of the consignment of pet food product of animal origin in India and the documents shall be examined by the Inspection Authority , nominated by the Central Government .

(2) On arrival of the consignment of pet food product of animal origin in India. samples shall be drawn for testing for risk analysis pertaining to diseases . pesticides and the like before the consignment is released for sale .

(3) In case of positive findings of any disease , pesticide or other risk factor , appropriate action shall be taken by the Government of India in the Department of Animal Husbandry, Dairying and Fisheries , at the cost of the importing agency.

(4) On arrival of the consignment of pet animal product of animal origin in India, the importing agency shall give an undertaking to the Central Government that at no point of time.

(a) the imported product shall not find way to animal food chain other than dogs and cats;

(b) left - over of the product should be disposed off through incineration ; and

(c) the labeling of the pet food product of animal origin shall be done in the local or regional language of destination.

Sanitary Conditions

1. The country of export is free from Highly Pathogenic Avian Influenza (HPAI ) .

2. No ingredient of ruminant origin is incorporated into the pet food product of animal origin except for the following, namely: -

(i) milk or milk products ;

(ii) Protein -free tallow of ovine or caprine origin ; and

(iii) The ovine or caprine materials or ingredients imported from the countries free from TSE group of diseases have been incorporated in the pet food and the following information shall have to be provided; namely: -

(a) details of ingredients;

(b) certificate number;

(d) name of animal health authority Issuing Certificate for the ingredient : and

(e) date ofendorsement of the certificate:

3. The certified materials or the animal origin components of the pet food product of animal origin has been processed at a temperature to attain an internal temperature of not less than 70° C for 30 minutes or been processed through an alternative method offering equivalent guarantees with regard to microbiological safety approved by the Government of India in the Department of Animal Husbandry, Dairying and Fisheries .

List of the countries prohibited for import of pet food of animal origin

1. In case the pet food product of animal origin contains the meat or its products , edible or non- edible organ or tissue from poultry or any other kind of bird origin, originates from countries positive for Highly Pathogenic Avian Influenza.

2. In case the pet food product of animal origin contains the meat or its products , edible or non-edible organ or tissue from ruminant origin originates from countries positive for Transmissible Spongiform Encephalopathy .
