का.आ. 1844(अ).- पेटेंट नियम, 2003 का और संशोधन करने के लिए क़तिपय नियमों का निम्नलिखित प्रारूप , जिसे केंद्रीय सरकार, पेटेंट अधिनियम , 1970 ( 1970 का 34) की धारा 159 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्रस्ताव करती है, जिन्हें उक्त धारा की उपधारा (3 ) द्वारा यथाअपेक्षित, सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप , उस तारीख से , राजपत्र में, अंतर्विष्ट अधिसूचना जनता को उपलब्ध करा दी जाती है, तीस दिन की अवधि की समाप्ति पर या पश्चात् विचार किया जाएगा ।
ऐसे आक्षेपों या सुझावों पर जो उक्त प्रारूप के संबंध में किसी व्यक्ति से पूर्वोक्त अवधि की समाप्ति के पूर्व प्राप्त हो सकेंगे, केंद्रीय सरकार द्वारा विचार किया जाएगा ।
आक्षेप या सुझाव, यदि कोई हो, सचिव, भारत सरकार, वाणिज्य और उद्योग मंत्रालय (औद्योगिक नीति और संवर्द्धन विभाग) उद्योग भवन, नई दिल्ली 110 001 को भेजे जा सकेंगे ।
प्रारूप नियम
1. (1 ) इन नियमों का संक्षिप्त नाम पेटेंट (दूसरा संशोधन) नियम, 2005 है ।
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पेटेंट नियम, 2003 (जिन्हें इसमें इसके पश्चात् मूल नियम कहा गया है) के नियम 4 के उपनियम ( 1 ) के खंड (i ) और खंड ( ii) में " धारा 39, धारा 65 और धारा 125 " शब्दों और अंकों के स्थान पर दोनों स्थानों पर क्रमशः " धारा 125" शब्द और अंक रखे जाएंगे ।
3. मूल नियमों के नियम 6 में उपनियम (1 ) के परंतुक का लोप किया जाएगा ।
4. मूल नियमों के नियम 7 के उपनियम (2) में, -
(क) खंड (क) गें, "नकद संदत्त " शब्दों के पश्चात्, "या इलैक्ट्रानिक द्वारा अभिप्रेत" शब्द अंतःस्थापित `किए जाएंगे ;

[PART II-SEC . 3( ii ) ] (ख) खंड (ख) में, फीस का "अनुज्ञात समय के भीतर फीसों का संदाय करने के लिए " शब्दों का लोप किया जाएगा ।
(ग) खंड (ग ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्:--
" (ग) जहां किसी दस्ताबेंज की बाबत कोई फीस संदेय है वहां सम्पूर्ण फीस उस दस्ताबेज के साथ लगेगी ";
5. नियम 10 में और मूल नियमों के स्पष्टीकरण में, " तीन मास " शब्दों के स्थान पर क्रमशः, "छह मास " शब्द रखे जाएंगे ।
6. मूल नियमों के नियम 12 में,
(क) नियम (1 क) में और स्पष्टीकरण में , " तीन मास " शब्दों के स्थान पर क्रमशः, " छह मास " शब्द रखे जाएंगे ;
(ख) नियम (2) में , "तीन मास " शब्दों के स्थान पर, "छह मासे " शब्द रखे जाएंगे ;
(ग) नियम (3) में, "तीन मास " शब्दों के स्थान पर " छह मास " शब्द रखे जाएंगे ।
7. मूल नियमों के नियम 24 में, निम्नलिखित परंतुक जोड़ा जाएगा, अर्थात् :--
" परंतु वह अवधि जिसके भीतर, नियंत्रक जर्नल में आवेदन प्रकाशित करेगा जो सामान्यतया उक्त अवधि की समाप्ति की तारीख से तीस दिन होगी या नियम 24क के अधीन प्रकाशन के लिए अनुरोध करने की तारीख से एक मास होगी ।" ।
8. मूल नियमों के नियम 24ख में, --
(क) उपनियम (1 ) में,-
(i) खंड ( i) में, " छत्तीस मास " शब्दों के स्थान पर, " अड़तालीस मास " शब्द रखे जाएंगे ;
(ii) खंड ( ii) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात् : --
" (ii ) वह अवधि, जिसके भीतर धारा 11 ख की उपधारा (3) के अधीन परीक्षा के लिए अनुरोध किया जाता है, यदि लागू है तो, पूर्विकता की तारीख से अड़तालीस मास होगी या भारत में आवेदन फाइल करने की तारीख से अड़तालीस मास या जो भी बाद में हो, 1 जनवरी , 2005 से बारह मास , होगी ।" ;
(iii) खंड ( iii) में, " छत्तीस मास " शब्दों के स्थान पर, " अड़तालीस मास " शब्द रखे जाएंगे ;
( iv) खंड ( iv) में, " छत्तीस मास " शब्दों के स्थान पर "अड़तालीस मास " शब्द रखे जाएंगे ;
(v) खंड (v) में, "धारा 11 ख के अधीन विनिर्दिष्ट अवधि या " शब्दों, अंकों और अक्षर के स्थान पर, "पेटेंट (संशोधन) अधिनियम , 2005 के प्रारंभ के पूर्व धारा 11 ख के अधीन विनिर्दिष्ट अवधि या " शब्दों, अंकों और अक्षरों को रखा जाएगा ;
(ख) उपनियम (2) में, --
(i) खंड ( i) के स्थान पर, निम्नलिखित खंड रखा जाएगा, अर्थात्:-
" (i) वह अवधि, जिसके भीतर नियंत्रक प्राप्त अनुरोध की बाबत आवेदन और विनिर्देशन तथा अन्य दस्तावेजों को परीक्षक को निर्दिष्ट करेगा, ऐसे अनुरोध सामान्यता फाइल करने की तारीख से तीस दिन होगा :
परंतु ऐसा निर्देश आदेश में किया जाएगा, जिसमें वह उपनियम (1) के अधीन अनुरोध फाइल किया गया है ।" ;
(ii) खंड ( ii ) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा , अर्थात् : -- [ भाग II- खण्ड 3 ( ii) ]

3 " (iii) वह अवधि, जिसके भीतर नियंत्रक परीक्षक की रिपोर्ट का निपटान करेगा, सामान्यता नियंत्रक द्वारा ऐसी रिपोर्ट को प्राप्त करने की तारीख से तीस दिन होगा ।" ;
(ग) उपनियम (3) में , "उसके प्राधिकृत अभिकर्ता " शब्दों के स्थान पर, " परीक्षा के लिए अनुरोध करने की तारीख से छह मास के भीतर उसके प्राधिकृत अभिकर्ता" शब्द रखे जाएंगे ;
(घ) नियम (4) में,
(क) उपखंड ( i) में , " छह मास " शब्दों के स्थान पर " नौ मास " शब्द रखे जाएंगे ;
(ख) खंड (i ) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् : --
" ( ⅳक) किसी ऐसे आवेदन को प्रस्तुत करने का समय, जिसमें आदेश देने के लिए परीक्षा की गई है और 1 जनवरी , 2005 पर या पश्चात् प्रथम परीक्षा रिपोर्ट जारी की गई है, लेकिन पेटेंट (दूसरा संशोधन) नियम, 2005 के प्रारंभ से पूर्व होगी , उस तारीख से, जिसको आवेदक को अपेक्षाओं का अनुपालन करने के लिए आक्षेपों का प्रथम कथन जारी किया गया था, छह मास होगी । " ;
(ग) उपखंड (ii) में , " खंड ( i ) " शब्द, अंक और कोष्ठक के स्थान पर " खंड (i) और खंड (i क) " शब्द, अंक और कोष्ठक रखे जाएंगे ।
9. मूल नियमों के नियम 26 में, " (1 ) " कोष्ठक और अंक का लोप किया जाएगा ।
10. मूल नियमों के अध्याय 6 में, " कार्यवाही का विरोध करना " शीर्षक के स्थान पर, निम्नलिखित शीर्षक रखा जाएगा, अर्थात्: --
"पेटेंट देने की कार्यवाही का विरोध करना " ।
11. मूल नियमों के नियम 55 में, --
(क) (i) पार्श्व शीर्षक के स्थान पर, निम्नलिखित पार्श्व शीर्षक रखा जाएगा, अर्थात् :--
" (1 ) पेटेंट का विरोध करना ।";
(ii) उपनियम (1 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थातु:--
"(1 ) धारा 25 की उपधारा (1 ) के अधीन विरोध करने के लिए अभ्यावेंदन और जिसके अंतर्गत कोई कथन और साक्ष्य, यदि कोई हो, अभ्यावेदन के समर्थन में और सुनवाई के लिए कोई अनुरोध भी है, यदि इस प्रकार की वांछा की गई है तो समुचित कार्यालय में फाइल किया जाएगा ।
(1 क) उपनियम (1 ) में अन्तर्विष्ट किसी बात के होते हुए भी, पेटेन्ट की धारा 11 क के अधीन आवेदन के प्रकाशन की तारीख से छह भास की अवधि की समाप्ति से पूर्व पेटेंट अनुदत्त नहीं किया जाएगा ।" ;
(ख) उपनियम (3 ) में, "प्रभाव " शब्द के स्थान पर, "ऐसे अभ्यावेदन की प्रति के साथ प्रभाव " शब्द रखे जाएंगे ;
(ग) उपनियम (4 ) में, "एक मास " शब्दों के स्थान पर "तीन मास " शब्द रखे जाएंगे ;
12. मूल नियमों के नियम 55 क में, " धारा 25 की उपधारा (3 ) " शब्दों, अंकों और कोष्ठकों के स्थान पर, "धारा 25 की उपधारा (2) " शब्द, अंक और कोष्ठक रखे जाएंगे ।
13. मूल नियमों के नियम 56 में,-
(क) उपनियम (1 ) में, " विरोध करने की सूचना " शब्दों के स्थान पर " नियम 55क के अधीन विरोध करने की सूचना" शब्द, अंक और अक्षर रखे जाएंगे ;

(ख) उपनियम (4) में, " धारा 25 की उपधारा (4) " शब्दों, अंकों और कोष्ठकों के स्थान पर, "धारा 25 की उपधारा (3 ) " शब्द, अंक और कोष्ठक रखे जाएंगे ।
14. मूल नियमों के नियग 71 में, उपनियम (2) के स्थान पर, निम्नलिखित उपनियम रखा जाएगा, अर्थात्:--
" (2) वह समय, जिसके भीतर उपनियम (1 ) के अधीन किए गए अनुरोध का नियंत्रक निपटारा करता है, रक्षा और परमाणु ऊर्जा आवेदनों से संबंधित आविष्कारों के मामलों में सिवाय, सामान्यता ऐसे अनुरोध को फाइल करने की तारीख से इक्कीस दिन की अवधि के भीतर होगी ।" ;
15. मूल नियमों के नियम 88 में, "मुद्रांकन " शब्द के स्थान पर, जो दोनों स्थानों पर, "अनुदत्त करना " शब्द रखे जाएंगे ।
16. मूल नियमों के नियम 134 के उपनियम (1 ) में,-
(क) खंड (क) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्:-
" (कक) धारा 8 के अधीन जानकारी के बारे में फाइल की गई है । " ;
:: (ख) खंड (ट) में, " राजपत्र " शब्दों के स्थान पर "शासकीय जर्नल " शब्द रखे जाएंगे ।
17. मूल नियमों के नियम 138 के उपनियम (1 ) में, " नियम 24, नियम 55 और नियम 80 (1 क) " शब्दों, अंकों और कोष्ठकों के स्थान पर " नियम 24ख, नियम 55 का उपनियम (4) और नियम 80 का उपनियम (1 क) " शब्द अंक, और कोष्ठक रखे जाएंगे ।
18. मूल नियमों की प्रथम अनुसूची में,-
(क) मद संख्यांक 1 , 2 , 3 और 4 तथा उनसे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित मदें और प्रविष्टियां रखी जाएंगी , अर्थात्:-

(ख) पैरा 10 के पश्चात्, " पेटेंट नियंत्रक" शब्दों के स्थान पर, " पेटेंटों का नियंत्रक" शब्द रखे जाएंगे ;
(ii ) प्ररूपं 5 में, पैरा 4 के पश्चात्, " पेटेंट नियंत्रकी' शब्दों के स्थान पर, " पेटेंटों का नियंत्रक" शब्द रखे जाएंगे ;
( iii) प्ररूपं 9 के पैरा 2 में, "पेटेंट संख्यांक के लिए आवेदन " शब्दों के स्थान पर, " पेटेंट आवेदन संख्यांक" शब्द रखे जाएंगे ;
(iv) प्ररूप 18 में, --
(क) पैरा 1 में मद (ग) के पश्चात्, निम्नलिखित मद जोड़ी जाएगी, अर्थात् : --
"(घ ) धारा 11 क के अधीन आवेदनों के प्रकाशन की तारीख ." ;
(ख) पैरा 4 के पश्चात्, "पेटेंट नियंत्रक " शब्दों के स्थान पर "पेटेंटों का नियंत्रक " शब्द रखे जाएंगे ;

(v) प्ररूप 21 के पैरा 1 में, " पेटेंट संख्यांक/ संख्यांक " शब्दों के स्थान पर, " पेटेंट संख्यांक " शब्द रखे जाएंगे ;
(vi) प्ररूप 25 में, " फीस नहीं" आरंभ में आते हैं, लोप किया जाएगा ।
20. मूल नियमों की तीसरी अनुसूची के स्थान पर, निम्नलिखित अनुसूची रखी जाएगी, अर्थात्: -

यह प्रमाणित किया जाता है कि पेटेंट अधिनियम, 1970 के उपबंधों के अनुसार तारीख 19/20..... से 20 वर्ष की अवधि के लिए ऊपर लिखित आवेदन में यथा प्रकटित मास , नामक आविष्कार के लिए पेटेंटी को पेटेंट अनुदत्त किया गया है ।

NOTIFICATION
New Delhi , the 30th December, 2005
S.O.1844(E) . The following draft of certain rules further to amend the Patents Rules , 2003 which the Central Government proposes to make in exercise of the powers conferred by section 159 of the Patents Act, 1970 (39 of 1970) is hereby published, as required by sub - section (3 ) of the said section , for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of a period of thirty days from the date of the Official Gazette , containing the notification , are made available to the public.
Any objections or suggestions which may be received from any person with respect to the said draft before the expiry of the aforesaid period will be considered by the Central Government.
Objections or suggestions , if any , may be sent to the Secretary to the Government of India , Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) , Udyog Bhavan , New Delhi - 110011 .
Draft Rules
1 . (1 ) These rules may be called the Patents (Second Amendment) Rules, 2005 .
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Patents Rules , 2003 (hereinafter referred to as the principal rules) , in rule 4, in sub - rule ( 1 ) in the clauses ( i ) and ( ii) , for the words and figures " section 39,65 and 125 " occurring at both the places , the word and figures " section 125 " , shall respectively be substituted;
3. In rule 6 of the principal rules, in sub- rule ( 1 ) , the proviso shall be omitted ;
4. In rule 7 of the principal rules , in sub- rule (2) , -
(a) in clause (a) , after the words " paid in cash " , the words " or through electronic means " shall be inserted;
(b) in clause ( b ) , the words " within the time allowed for payment of the fees " shall be omitted;
(c) for clause (c) , the following clause shall be substituted , namely: - "(c) Where a fee is payable in respect of a document , the entire fee shall accompany the document ." ;
5. In rule 10 and in the explanation of the principal rules , for the words " three months " , the words " six months " shall respectively be substituted;

(a) in rule ( 1A) and in the explanation, for the words "three months " , the words " six months " shall respectively be substituted;
(b) in rule (2), for the words " three months " , the words " six months " shall be substituted;
(c) in rule (3 ), for the words " three months", the words " six months " shall be substituted;
7. In rule 24 of the principal rules, the following proviso shall be added namely: - "Provided that the period within which the Controller shall publish the application in the Journal shall ordinarily be thirty days from the date of expiry of said period, or one month from the date of request for publication under rule 24A. ";
8. In rule 24B of the principal rules,
(a) In sub- rule ( 1 ) , -
( i) in clause (i) , for the words " thirty- six months " , the words " forty - eight months " shall be substituted;
(ii) for clause (ii ) , following clause shall be substituted, namely : -
" ( ii) The period within which the request for examination under sub- section (3 ) of section 11B to be made shall be forty - eight months from the date of priority, if applicable , or forty - eight months from the date of filing of the application in India or twelve months from the 1st day of January , 2005 , whichever is later.";
(iii) in clause ( iii ) , for the words " thirty - six months ", the words " forty- eight months " shall be substituted;
(iv) in clause (iv) , for the words " thirty- six months " , the words " forty- eight months " shall be substituted;
(v) In clause (v) for the words, figures and letter " the period specified under the section 11B or", the words, figures and letter "the period specified under the section 11B before the commencement of the Patents (Amendment) Act, 2005 or " shall be substituted;
(b) In sub- rule (2 ), -
(i ) for clause ( i ), the following clause shall be substituted, namely : -
:
" (i) The period within which the Controller shall refer the application and specification and other documents to the examiner in respect of the request received shall ordinarily be thirty days from the date of filing of such request ;
Provided that such reference shall be made in order in which the request is filed under sub- rule ( 1 ) . " ;
(ii ) after clause ( ii ), the following clause shall be inserted, namely : - "(iii) the period within which the Controller shall dispose off the report of the examiner shall ordinarily be thirty days from the date of the receipt of the such report by the Controller . " ;
(c) In sub rule (3 ) , for the words " his authorised agent " , the words " his authorised agent within six months from the date of the request for examination . " shall be substituted;
(d) In rule (4), -
(a) in sub clause ( i ), for the words " six months ", the words " nine months" shall be substituted ;

(c) in clause ( ii ), for the word, figures and brackets " clause (i ) " , the word figures and brackets " clauses ( i) and ( ia) " shall be substituted;
9. In rule 26 of the principal rules, the figure and bracket " ( 1 ) " shall be omitted;

"(1 ) Representation for opposition under sub - section ( 1 ) of section 25 shall be filed at the appropriate office and shall include a statement and evidence , if any, in support of the representation and a request for hearing if so desired.
(1A) Notwithstanding anything contained in sub- rule( 1 ), no patent shall be granted before the expiry of a period of six months from the date of publication of the application under section 11A. " ;
(b) in sub - rule(3 ) , for the word , " effect " , the words , " effect alongwith a copy of such representation " shall be substituted;
(c) in sub rule (4) , for the words " one month " the words " three months . " shall be substituted;
12. In rule 55A of the principal rules , for the words , figures and brackets " sub- section (3 ) of section 25 " , the words , figures and brackets " sub - section (2) of section 25 " shall be substituted;
