आ.अ. 73(अ).-यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61क में यह उपबंधित है कि मतदान मशीनों द्वारा मत ऐसी रीति से दिए और रिकार्ड किए जाएंगे जैसा कि भारत निर्वाचन आयोग ऐसे निर्वाचन क्षेत्रों के लिए प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए निर्दिष्ट करे; तथा
Ο.Ν. 73 ( E) .- Whereas , Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituency as the Election Commission may, having regard to the circumstances of each case specify ; and
2. यतः महाराष्ट्र राज्यमें आयोग ने 46 - सांगली संसदीय निर्वाचन क्षेत्र की परिस्थितियों पर विचार किया है और वह संतुष्ट है कि उपर्युक्त वर्णित संसदीय निर्वाचन क्षेत्र में मतदान के लिए पर्याप्त संख्या में इलेक्ट्रॉनिक वोटिंग मशीन उपलब्ध है, मतदान कर्मचारी इलेक्ट्रॉनिक वोटिंग मशीन के दक्षतापूर्वक संचालन करने के लिए प्रशिक्षित हैं तथा निर्वाचक भी इलेक्ट्रॉनिक वोटिंग मशीनों की कार्यप्रणाली से पूर्णतया परिचित हैं;
2. Whereas , the Commission has considered the circumstances in46- Sangli Parliamentary Constituency in the State ofMaharashtra, and it is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned Parliamentary Constituency, the polling personnel are well trained in efficienthandling of the Electronic Voting Machines and the electors are also fully conversant with the operation of theElectronic Voting Machines ;
3. अतः , अब , भारत निर्वाचन आयोग एतद्वारा महाराष्ट्र राज्य में 46- सांगली संसदीय निर्वाचन क्षेत्र को उस निर्वाचन क्षेत्र के रूप में उल्लिखित करता है जिसमें 28 दिसम्बर, 2005 को अधिसूचित लोक सभाके लिए उप निर्वाचनों में, निर्वाचनों का संचालन नियम, 1961 के अधीन मत निर्धारित रीति से इलेक्ट्रॉनिक मतदान मशीनों के माध्यम से डाले और रिकार्ड किए जाएंगे जैसा कि इस विषय पर आयोग द्वारा समय- समय पर अनुपूरक अनुदेश जारी किए जाते हैं ।
3.Now, therefore , the Election Commission of India hereby specifics 46- Sangli Parliamentary Constituency in the State ofMaharashtra, as the Constituency in which the votes at the current bye- election to the House of the People from the said State notified on 28th December, 2005 , shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules , 1961 , and the supplementary instructions issued by the Commission from time to time on the subject.
