सा.का.नि. 5( अ ).-केन्द्रीय सरकार, भारत- तिब्बत सीमा पुलिस बल अधिनियम, 1992 ( 1992 का 35 ) की धारा 156 की उप - धारा ( 2 ) के खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत - तिब्बत सीमा पुलिस बल ( दर्जी काडर ) , भर्ती नियम , 1999 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम भारत - तिब्बत सीमा पुलिस बल , ( दर्जी काडर ) भर्ती ( संशोधन ) नियम, 2006 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. भारत- तिब्बत सीमा पुलिस बल, ( दर्जी काडर ) , भर्ती नियम, 1999 की अनुसूची में,
( क) क्र.सं. 1 पर वर्णित पद के सामने, -
(i) स्तंभ 12 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:-
" पदोन्नति द्वारा : विभागीय परीक्षा उत्तीर्ण करने और गृह मंत्रालय द्वारा जारी यु.ओ. सं. 1: 45020/52/2001 - कार्मिक- II तारीख 30 जनवरी, 2002 के आदेश में यथा विनिर्दिष्ट चिकित्सा प्रवर्ग शेप -1 में आने के अधीन रहते हुए ऐसे उप निरीक्षक ( दर्जी) में, से जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवा की है और जिन्होंने नक्शा पठन, स्तर -1 किया है ।
टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, उपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी ली है । "
( ii ) स्तंभ ( 13 ) की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्: -
" समूह ' ख' विभागीय प्रोन्नति समिति निम्नलिखित से मिलकर बनेगी:-
अध्यक्ष
1. उप महानिरीक्षक
सदस्य
2. कमांडेट या सेकंड-इन-कमांड
सदस्य";
3. उप कमांडेट या सहायक कमांडेट

(ख) क्र.सं. 2 पर वर्णित पद के सामने, -
(i) स्तंभ 12 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-
" पदोन्नति द्वारा : ऐसे हैड कांस्टेबल ( दर्जी ) -
(क) जिसने हैड कांस्टेबल ( दर्जी ) की श्रेणी में दस वर्ष नियमित सेवा की हो;

या
(
ख) ऐसा हैड कांस्टेबल ( दर्जी ) जिसने उस श्रेणी में पांच वर्ष की नियमित सेवा सहित जिसने उस श्रेणी में और भारत- तिब्बत सीमा पुलिस बल में किसी अन्य श्रेणी में अठारह वर्ष नियमित सम्मिलित सेवा की हो ।
और जिन्होंने नक्शा पठन, स्तर- II किया है और विभागीय परीक्षा में अर्हित हो व गृह मंत्रालय द्वारा जारी किये गये यु.ओ. सं. 1-45020/52 /2001- कार्मिक- II तारीख 30 जनवरी , 2002 में यथा अंतर्विष्ट चिकित्सा प्रवर्ग शेप -1 में रहा हो ।
टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है । "
(ii) स्तंभ ( 13 ) की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-
" समूह ' ग ' विभागीय प्रोन्नति समिति निम्नलिखित से मिलकर बनेगी :-

(ग ) क्र.सं. 3 पर वर्णित पद के सामने,-
( i ) स्तंभ 12 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्: -
" पदोन्नति द्वारा : लांस नायक ( दजीं ) या कांसटेबल ( दर्जी ) विभागीय परीक्षा उत्तीर्ण करने और गृह मंत्रालय द्वारा जारी किये गये यु.ओ.सं. I : 45020/52/2001 - कार्मिक- II तारीख 30 जनवरी , 2002 के आदेश में यथा विनिर्दिष्ट चिकित्सा प्रवर्ग शेप -1 में आने के अधीन रहते हुए जिन्होंने उस श्रेणी या किसी अन्य श्रेणी में आठ वर्ष नियमित सेवा की है और जिन्होंने नक्शा पठन, स्तर- III किया है ।

NOTIFICATION
New Delhi , the 4th January , 2006
G.S.R. 5 (E) . In exercise of the powers conferred by clause (b) of sub -section (2 ) of Section 156 ofthe Indo - Tibetan Border Police Force Act, 1992 ( 35 of 1992) , the Central Government hereby makes the following rules to amend the Indo- TibetanBorder Police Force , Tailor Cadre Recruitment Rules , 1999 namely:-
1. (1 ) These rules may be called the Indo - Tibetan Border Police Force, Tailor Cadre Recruitment ( Amendment) Rules , 2006.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Schedule to the Indo -Tibetan Border Police Force, Tailor Cadre , Recruitment Rules , 1999, -
(A) against the post at serial number 1 ,-
(0) in column 12, for the entries , the following entries shall be substituted, namely :-
"By Promotion : Sub Inspector (Tailor) having 3 years regular service in the grade and have done Map Reading, Standard- I subject to passing the departmental test and being in medical category SHAPE - I as contained in the UO No. I. 45020/52/2001 - Pers - II dated the 30th January, 2002 issued by the Ministry of HomeAffairs .
Note : Where juniors who have completed their qualifying/ eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ eligibility service or two years , whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith theirjuniors who have already completed such qualifying/ eligibility service. "
(ii) in column ( 13 ) for the entries , the following entries shall be substituted namely:-
"Group ' B ' Departmental Promotion Committee consisting of:-
Chairman
1. Deputy Inspector General
Member
2. Commandant or Second- in-Command
3. Deputy Commandant or Assistant Commandant Member";
(B) against the post appearing at serial number 2,-
(1) in column 12 , for the entries , the following entries shall be substituted, namely:
"By Promotion : Head Constable (Tailor)-
(a) With ten years regular service in the grade ofHead Constable (Tailor) ; OR
(b) with five years regular service in the grade of Head Constable (Tailor) who had rendered eighteen years of combined regular service in that grade or any other grade ,
and have done Map Reading Standard- II subject to passing the departmental test and being in medical category SHAPE- I as contained in the UO No. 1. 45020 /52 /2001 -Pers - II dated the 30th January, 2002 issued by the Ministry of Home Affairs .
Note : Where juniors who have completed their qualifying/eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/ eligibility service . "
(ii) in column (13 ) for the entrics, the following entries shall be substituted namely :-
"Group 'C ' Departmental Promotion Committee consisting of:-
Chairman
1. Deputy Inspector General or Additional Deputy Inspector General
Member
2. Commandant or Second- in- Command
Member":

(C) against the post appearing at serial number 3 ,-
(1) in column 12, for the entries , the following entries shall be substituted, namely: ---
"By Promotion : Lance Naiks (Tailor ) or Constable (Tailor ) having eight years of regular service in the grade and have undergone Map Reading, Standard- III subject to passing the departmental test and being in medical category SHAPE - I as contained in the UO No. I. 45020 /52/ 2001 -Pers- II dated the 30th January , 2002 issued by the Ministry of Home Affairs .
Note : Where juniors who have completed their qualifying/eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service . "
(ii) in column ( 13) for the existing entries , the following entries shall be substituted namely :-
"Group' C' Departmental Promotion Committee consisting of:---
Chairman
1. Commandant
Member
2. Second - in-Command or Deputy Commandant
Member" ;
