सा.का.नि. १(अ).-केंद्रीय सरकार, राष्ट्रीय कर अधिकरण अधिनियम , 2005 की धारा 28 की उप - धारा ( 2 ) के खंड (ख ) के साथ पठित उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्: -
1. संक्षिप्त नाम और प्रारंभ . (i ) इन नियमों का नाम राष्ट्रीय कर अधिकरण ( अधिकारियों और कर्मचारियों का वेतन, भत्ते और अन्य सेवा शर्तें ) नियम, 2005 होगा;
( ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं:- इन नियमों में यदि प्रसंग में अन्यथा अपेक्षित
न हो,-
(क) " कर्मचारियों" से अधिकरण के कर्मचारी अभिप्रेत हैं,
(ख) " अधिकारियों " से अधिकरण के अधिकारी अभिप्रेत हैं ।
(ग ) " अधिकरण" से राष्ट्रीय कर अधिकरण अधिनियम, 2005 की धारा 3 के अधीन स्थापित किया गया राष्ट्रीय कर अधिकरण अभिप्रेत है ।
3. अधिकरण के अधिकारी और अन्य कर्मचारी- अधिकरण के अधिकारियों की प्रकृति और प्रवर्ग तथा उनके वेतनमान इस अधिसूचना से संलग्न अनुसूची में दिए गए अनुसार होंगे ।
4. सेवा की शर्तें अधिकरण के अधिकारियों एवं अन्य कर्मचारियों का वेतन, भत्ते , छुट्टी, कार्यग्रहण समय , कार्यग्रहण समय वेतन , भविष्य निधि, अधिवर्षिता की आयु, पेंशन एवं सेवानिवृत्तिलाभ,

चिकित्सा सुविधाएं और अन्य सेवा शर्तें उन्हीं नियमों और विनियमों के अनुसार विनियमित होंगी जो उसी स्थान पर तैनात समान वेतनमानों में कार्यरत- केंद्रीय सरकार के यथास्थिति समूह " क ", समूह " ख ", समूह " ग " और समूह " घ " के अधिकारियों और कर्मचारियों के लिए समय- समय पर लागू होते हैं ।

NOTIFICATION
New Delhi, the 9th January, 2006
G. S. R. 9(E). In exercise of the powers conferred by Sub-section (1) read with clause (b) of Sub- section (2) of Section 28 of the National Tax Tribunal Act, 2005 the Central Government hereby makes the following rules, namely:+
1.Short title and commencement.-( i ) These rules maybe called the National Tax Tribunal (Salary , Allowances and other Conditions of Service of the Officers and Exployees) Rules , 2005;
(ii ) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions:--- In these rules , unless the context otherwise requires ,
(a) " emplovees " means the employees of the Tribunal;
(b) " officers" means the officer of the Tribunal;
(c) "Tribunal ' means the National Tax Tribunal established under Section 3 of the National Tax Tribunal Act , 2005 .
3.Officers andother employees of the Tribunal.- Thenature and categories ofofficers and employees ofthe Tribunal and the scales ofpay attached thereto shall be as specified in the Schedule annexed hereto .

pay, provident fund , age of superannuation , pension and retirement benefits , medical facilities and other conditions ofservice, shall be regulated in accordance with such rules and regulations as are , from time to time, applicable to officers and employees of the Central Government belonging to Group ' A ' Group ' B ' , Group ' C ' and Group 'D' , as the case may be, and drawing the corresponding scales of pay and posted at the same station.
