सा.का.नि. 10(अ). दिल्ली विकास प्राधिकरण , दिल्ली विकास ( विविध ) नियम, 1959 के नियम ( 4 ) के साथ पठित दिल्ली विकास अधिनियम, 1957 ( 1957 का 61 ) की धारा 57 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा केन्द्र सरकार के पूर्व अनुमोदन से दि. वि. प्रा. में सहायक अभियंता ( सिविल ) और ( विद्युत ) के पदों की भर्ती की पद्धति को नियमित करने के लिए निम्नलिखित विनियम बनाता है: -
1. संक्षिप्त नाम एवं प्रवर्तनः-
(1) इन विनियमों को जैसाकि नीचे अनुसूची में दिया गया है, 'सहायक अभियंता (सिविल) और सहायक अभियंता (विद्युत) के भर्ती विनियम , दिल्ली विकास प्राधिकरण 2005' कहा जाएगा ।
(11 ) ये विनियम भारत सरकार द्वारा भर्ती विनियमों को अनुमोदित करने की तिथि अर्थात् 28.06.2004 से प्रभावी होंगे ।
2. निरर्हताः- कोई भी ऐसा व्यक्ति
(क) जिसने किसी ऐसे व्यक्ति से विवाह कर लिया हो अथवा विवाह करने का अनुबंध किया हो जिसका पति/ जिसकी पत्नी जीवित हो , अथवा
(ख) जिसने अपनी पत्नी / पति के जीवित रहते हुए किसी व्यक्ति से विवाह कर लिया हो अथवा विवाह करने का अनुबंध किया हो, उक्त किसी भी पद पर नियुक्ति का पात्र नहीं होगा ।
बशर्ते केन्द्र सरकार यदि इस बात से संतुष्ट हो जाए कि यह विवाह उस व्यक्ति और विवाह के दूसरे पक्ष पर लोगू स्वीय विधि (पर्सनल लॉ) के अंतर्गत अनुमेय है और ऐसा करने के अन्य कारण हैं, तो वह उस व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकता है ।

3 शिथिल करने की शक्ति
जब सक्षम प्राधिकारी की यह राय हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह लिखित रूप में कारण रिकार्ड करके किसी वर्ग अथवा व्यक्तियों की श्रेणी या पद के संबंध में इन नियमों के किसी प्रावधान में छूट दे सकता है ।
14 वचाव
इन विनियमों में ऐसा कुछ नहीं है , जिससे केन्द्र सरकार द्वारा इस संबंध में समय - समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछडे वर्गों, भूतपूर्व सैनिकों और अन्य विशेष श्रेणियों के व्यक्तियों को मिलने वाले आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रतिकूल प्रभाव पडे ।

NOTIFICATION
New Delhi , the 18th October, 2005
G.S.R. 10(E). In exercise of the powers conferred by Section 57 of the Delhi Development Act, 1957 (61 of 1957) read with Rule ( 4) of the Delhi Development (Misc. ) Rules, 1959, the Delhi Development Authority, with the previous approval of Central Government, hereby makes the following Regulations regulating the method of recruitment to the posts ofAssistant Engineer ( Civil ) and (Electrical) in the DDA.
Short title and commencement : - 1 .
(1) These Regulations as given in the schedule placed below may be called the " Recruitment Regulations of Assistant Engineer (Civil ) and Assistant Engineer (Electrical ) , Delhi Development Authority, 2005 .
(ii) These Regulations shall come into force with effect from 28.06.2004 the date on which Govt. of India approved the RRs .
Disqualification- No person 2.
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living , has entered into a contracted a marriage with any
shall be eligible for appointment to the above said post.
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.
3.Power to relax
:When the Appointing Authority is of the opinion that it is necessary or expedient so to do , it may by order, for reasons to be recorded in wiriting, relax any of the provisions of these regulations in respect of any class or category of persons posts. or

4. Savings
Nothing in these rules shall affect reservation relaxation of age limit and other concession required to be provided for the Scheduled Casts , the Schedules Tribes , the other Backward classes . Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
