सा.का.नि. 14( अ).- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय स्वास्थ्य सेवा नियम, 1996 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -
1. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय स्वास्थ्य सेवा (संशोधन) नियम, 2006 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय स्वास्थ्य सेवा नियम, 1996 , जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है, के नियम 5 के उपनियम (1 ) में खण्ड (घ) का लोप किया जाएगा ।
3. उक्त नियमों में, नियम 8 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
" 8. प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) द्वारा ड्यूटी पदों का भरा जाना:-
(1 ) नियम 7 में किसी बात के होते हुए भी, जहां सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह लेखबद्ध किए जाने वाले कारणों से और आयोग के परामर्श से, चिकित्सा अधिकारी या ज्येष्ठ चिकित्सा अधिकारी या साधारण ड्यूटी चिकित्सा अधिकारी उप काडर में मुख्य चिकित्सा अधिकारी और विशेषज्ञ श्रेणी 2 ( कनिष्ठ या ज्येष्ठ वेतनमान ) या गैरशिक्षण और लोक स्वास्थ्य उप काडर में विशेषज्ञ श्रेणी 1 और शिक्षण उप काडर में सहायक आचार्य या सहयुक्त आचार्य या आचार्य की श्रेणियों में कुल पदों के एक 101 G1/2006.

[PART II-SEC. 3 (i) ] सौ से अनधिक ड्यूटी पद ऐसे समुचित अधिकारियों से प्रतिनियुक्ति द्वारा जो केन्द्रीय सरकार ( जिसके अन्तर्गत रेल मंत्रालय और रक्षा मंत्रालय भी हैं ) या राज्य सरकारों या संघ राज्य क्षेत्र के अधीन सदृश पद धारण किए हुए हैं और अल्पकालिक संविदा द्वारा ऐसे समुचित अधिकारियों से भर सकेगी जो कानूनी निकायों, स्वशासी निकायों, अर्द्धसरकारी संगठन , विश्वविद्द्यलयों , मान्यताप्राप्त अनुसंधान संस्थाओं के अधीन सदृश पद धारण किए हुए हैं ।
(2) प्रतिनियुक्ति या संविदा की अवधि तीन वर्ष से अनधिक की अवधि होगी, जिसे विशेष परिस्थतियों में पांच वर्ष तक बढ़ाया जा सकेगा जो केन्द्रीय सरकार ठीक समझे ।

NOTIFICATION
New Delhi , the 13th January , 2006
G.S.R. 14 (E). In exercise of powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Central Health Service Rules , 1996 , namely: -
11 (1) 2006 . These rules may be called the Central Health Service (Amendment) Rules ,
(2) They shall come into force on the date of their publication in the official Gazette.
2 In the Central Health Service Rules , 1996, hereinafter referred to as the said rules. in the sub- rule ( 1 ) to rule 5. the clause (d ) shall be deleted
3 In the said rules, for rule 8. the following shall be substituted , namely- [भाग II- खण्ड 3 ( i) ]

3 "8. Filling ofduty posts by deputation (including short term contract):
( 1) Notwithstanding anything contained in the rule 7, where the Government is of the opinion that it is necessary or expedient so to do, it may for the reasons to be recorded in writing and in consultation with the Commission, fill not more than one hundred duty posts in all, in the grades of Medical Officer or Senior Medical Officer or Chief Medical Officer in the General Duty Medical Officer sub - cadré and Specialist Grade II (Junior and Senior Scale) or Specialist Grade I in the Non- Teaching and Public Health Sub Cadres and Assistant Professor or Associate Professor or Professor in the Teaching sub cadre by deputation of suitable officers holding analogous posts under the Central Government (including Ministries of Railways and Defence ) or State Governments or Union Territories and by short term contract of suitable officers holding analogous posts under the statutory bodies, autonomous bodies , semi -government organizations , universities or recognized Research Institutions.
(2) The period of deputation or contract shall be for a period not exceeding three years , which may, in special circumstances be extended upto five years , as the Central Government may think fit".
