का.आ. 45 (अ) .- केन्द्र सरकार एतद्द्वारा कर्मचारी भविष्य निधि तथा प्रकीर्ण उपबंध अधिनियम , 1952 ( 1952 का 19 ) की धारा 1 के खण्ड ( ख ) उप- धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कर्मचारी भविष्य निधि योजना, 1952 में संशोधन को विनिर्दिष्ट करती है, अर्थात्:-
S.O. 45(E) . In exercise of the powers conferred by clause (f) ofSub- section(3 ) ofSection 1 of the Employees' Provident Funds & Miscellaneous Provisions Act , 1952 , (19 of 1952), the Central Government hereby specifies to amend the Employees ' Provident Fund Scheme, 1952, namely:-
1. ( i ) इस योजना को कर्मचारी भविष्य निधि ( संशोधन ) योजना, 2004 कहा जाएगा ।
1. (1) This Scheme maybe called the Employees' Provident Fund (Amendment) Scheme, 2004.
(ii) यह सरकारी राजपत्र में अपने प्रकाशन की तिथि से प्रभावीहोगा।
(ii) It shall come into force with effect from the dateof itspublication in the Official Gazette.
2. पैरा 1 के उप - पैरा ( 3 ) में खण्ड (ग III ) के बाद निम्नांकित
2. In Para 1 , sub -para (3 ) after clause (C III) the following maybe added:-
कोजोड़ा जाए :-
(XXIV) With respect to the establishments engaged in Railwaysfor construction, maintenance, operation and commercial activities of Railways excluding Indian Railways exclusively managed by Government of India whose employees are in enjoyment of the Provident Fund, Pension and other retrial benefits under the Rules made by the Central Government ; specified in notification of the Govt. of India in the Ministry of Labour and Employment G.S.R. 401 dated 10-11-2005 published inPart II ofSection 3 Sub- section ( i ) of the Gazette of India dated 19-11-2005 comes into force from the date ofPublication .
(XXIV) भारत सरकार द्वारा अनन्य रूप से प्रबंधित भारतीय रेलवे को छोड़कर रेलवे के विनिर्माण, अनुरक्षण , प्रचालन तथा वाणिज्यिक क्रियाकलापों के लिए रेलवे से जुड़े ऐसे प्रतिष्ठानों केमामले में, जिनके कर्मचारी केन्द्र सरकार द्वारा बनाए गए नियमोंके तहत भविष्य निधि, पेंशन तथा अन्य पुनः विचारण लाभ ले रहे हैं, को भारत सरकार के श्रम और रोजगार मंत्रालय की दिनांक 10-11-2005 अधिसूचना सा.का.नि. 401 जो दिनांक 19-11-2005 को भारत के राजपत्र के भाग II- खण्ड 3 , उप- खण्ड ( i ) में प्रकाशित किया गया है, में विनिर्दिष्ट किया गया है जो इसे प्रकाशित किए जाने की तारीख से लागूहोगा ।
