का.आ. 165 (अ).- राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का० आ ० 637(अ) तारीख 4 सितम्बर, 1997 के साथ पठित औषध ( कीमत नियंत्रण) आदेश, 1995 के पैरा 9 के उप पैरा ( 1 ) और (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा भारत सरकार के रसायन और उर्वरक मंत्रालय ( राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण) के आदेश सं ० का० आ० 1336(अ) , तारीख 16 सितम्बर, 2005 को जहाँ तक उसका सम्बन्ध नीचे की सारणी के विनिर्मित पैकों से है, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है, नीचे की सारणी के स्तंभ (5 ) मे विनिर्दिष्ट कीमत को उक्त सारणी के स्तंभ (3 ) और (4) में की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ (2 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितयों में से प्रत्येक की , उत्पाद शुल्क और स्थानीय कर , यदि कोई है , को छोड़कर अधिकतम कीमत के रुप में नियत करती है ।

S.O. 165 (E ) -In exercise of the powers , conferred by sub - paragraphs ( 1 ) and (2 ) of paragraph 9 of the Drugs (Prices Control ) Order , 1995 , read with No. S.O. 637 (E ) dated the 4th September, 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers , ( National Pharmaceutical Pricing Authority ) No. S.O. 1336 ( E) , dated 16th September, 2005 , in so far as it relates to formulation packs mentioned in the table below , except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority hereby fixes the prices as specified in column ( 5) of the table below as the ceiling price exclusive of excise duty, and local tax, if any , for scheduled formulation specified in the corresponding entry in column (2) of the said Table with the strength and pack size specified respectively in the corresponding entries in column (3 ) and (4) thereof :

का.आ. 173 (अ).- राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का ० आ० 637 (अ) तारीख 4 सितम्बर , 1997 के साथ पठित औषध ( कीमत नियंत्रण) आदेश , 1995 के पैरा 9 के उप पैरा ( 1 ) और (2 ) और पैरा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा भारत सरकार के रसायन और उर्वरक मंत्रालय (राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण ) के आदेश सं ० का० आ० 1363(अ) , तारीख 24 दिसम्बर, 2002 , सं ० का० आ ० 1165 (अ ) , तारीख 20 अक्टूबर , 2004 और सं ० का० आ ० 1359 (अ) , तारीख 16 सितम्बर , 2005 को जहाँ तक उसका सम्बन्ध नीचे की सारणी के विनिर्मित पैकों से है, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है, नीचे की सारणी के स्तंभ (5 ) मे विनिर्दिष्ट कीमत को उक्त सारणी के स्तंभ (3) और (4) मे की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितयों में से प्रत्येक की , उत्पाद शुल्क और स्थानीय कर, यदि कोई है , को छोड़कर अधिकतम कीमत के रुप में नियत करती है ।

नोट :

1 . ड्रग एंड कोस्मेटिक एक्ट के सिड्यूल में आने वाली सभी कम्पोजिशन के विटामिन की विनिर्मित में, उत्पादक द्वारा, एक उत्पाद के लिए निम्न आदेश में स्तम्भ 2 के विनिर्मित के लिए अधिकतम कीमत के लिए निम्न सामन्जस्य किया जाता है जब प्रबलता में परिवर्तन होता है जो निम्न कारक (जिनमें स्वीकार्य मेप शामिल है) जोड़े या घटाये जा सकेंगे जो कि स्तम्भ संख्या 5 में दिये प्रकाशित अधिकतम कीमत के आध् गार पर निम्न तरीके से हो सकते है ।

प्रत्येक 10 गोलियाँ/ कैपसूल पत्ता/ ब्लिस्टर में

(i) प्रत्येक 500 यूनिट या उसके खण्ड के लिये विटामिन ए (ऐसिटेट ड्राई पाउडर) के लिए 0.0455 रु. जोड़े या घटाये जा सकेंगे ।

(ii) प्रत्येक 100 यूनिट या उसके खण्ड के लिये विटामिन डी ३ के लिए 0.0075 रु. जोड़े या घटाये जा सकेंगे ।

(iii) प्रत्येक 5 मिग्रा . या उसके खण्ड के लिये नियासिनामाइड के लिए 0.0315 रु. जोड़े या घटाये जा सकेंगे ।

(iv ) प्रत्येक 5 मिग्रा. या उसके खण्ड के लिये कैल्शियम पैन्टोथिनेट के लिए 0.0556. रु. जोड़े या घटाये जा सकेंगे ।

प्रत्येक 5 मिग्रा. या उसके खण्ड के लिये डी पैन्थोनोल के लिए 0.1124 रु. जोड़े या घटाये जा सकेंगे ।

(vi ) प्रत्येक 0.05 मिग्रा. (50 एमसीजी) या उसके खण्ड के लिये फोलिक ऐसिड के लिए 0.0010 रु. जोड़े या घटाये जा सकेंगे ।

vii ) प्रत्येक 1 एमसीजी या उसके खण्ड के लिये विटामिन बी 12 के लिए 0.0047 रु. जोड़े या घटाये जा सकेंगे ।

(xi ) प्रत्येक 10 मिग्रा. या उसके खण्ड के लिये विटामिन सी के लिए 0.1025 रु. जोड़े या घटाये जा सकेंगे ।

(xviii ) प्रत्येक 1 मिग्रा . या उसके खण्ड के लिये मेगनेसीस के ऐलिमेन्ट के लिए 0.0052 रु. जोड़े या घटाये जा सकेंगे ।

(xxiv) प्रत्येक 10 एमसीजी या उसके खण्ड के लिये क्रोमियम के मिनरल ऐलिमेन्ट के लिए 0.0012 रु. जोड़े या घटाये जा सकेंगे ।

II . उपरोक्त सभी, राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण द्वारा जारी 27.1.1998 के का. आ. 83 (अ ) के प्रबनध के विषय होंगे ।

कोई भी दूसरी विटामिन की विनिर्मित/प्रबलता जिसमें उपरोक्त सारणी के स्तम्भ 3 की कोई भी एक अनुसूचित औषधि या इसके अंश मे से एक हो तो यह क्र. सं. 1 या क्र. सं. 2 की अधिकतम कीमत विशेष नोट-। के संदर्भ में होगी । तत्पश्चात , जब तक की उत्पादक को उसी विनिर्मित का, राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण से निर्दिष्ट अधिकतम कीमत का आदेश प्राप्त नहीं हो जाता ।

IV. अगर कम्पनी, विभिन्न प्रकार की पैकिंग सामाग्री या उसमें विशेष लक्षण का दावा करती है तो उसे राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण के पास कीमत के अनुमोदन/ नियत कराने के लिये आना होगा ।

In exercise of the powers , conferred by sub - paragraphs ( 1 ) and (2) of paragraph 9 and paragraph 11 of the Drugs (Prices Control ) Order , 1995, read with No. S.O. 637 (E ) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers , (National Pharmaceutical Pricing Authority) No. S.O. 1363 (E ) , dated 24th December , 2002 , No. S.O. 387 (E) , dated 2nd April , 2003 , No. S.O. 778 ( E ) , dated 9th July , 2003 , No. S.O. 1165 (E) , dated 20th October , 2004 and No. S.O. 1359 (E) , dated 16th September , 2005 , in so far as it relates to formulation packs mentioned in the table below , except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority hereby fixes the prices as specified in column (5) of the table below as the ceiling price exclusive of excise duty, and local tax, if any, for scheduled formulation specified in the corresponding entry in column (2) of the said Table with the strength and pack size specified respectively in the corresponding entries in column (3 ) and (4) thereof:

IV For different / Compositions & packing material used or any specific feature claimed, companies are required to approach NPPA for approval / fixation of specific prices .

In exercise of the powers conferred by the sub - paragraph (3 ) of Paragraph 9 of the Drugs ( Prices Control ) Order , 1995 , read with No. S.O. 637(E) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority hereby notifies that the manufacturers of all the scheduled formulations , different from the notified pack size under sub - paragraphs ( 1 ) and ( 2) of the paragraph 9 of the said Order , shall work out the prices of such pack sizes , in respect of tablets and capsules of the same strength or composition packed in strips or blisters , by adding Rs. 0.08 per 10 tablets or capsules as the case may be towards hologram to the latest ceiling price fixed for such formulations under sub - paragraphs ( 1 ) and (2) of the paragraph 9 of the said Order :
