का. आ. 194(अ) .-विदेश व्यापार नीति, 2004-2009 के पैसग्राफ 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम, 1992 की धारा 5 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण, 2004-2009 में एतद्द्वारा , निम्नलिखित संशोधन करती है:-
1. निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण 2004-2009 के अध्याय 1 क की शर्त 16 ( आयात नीति की सामान्य टिप्पणियां ) को संशोधित करके निम्नानुसार पढ़ा जाएगा :-
" 16. हाइली पैथोजोनिक एवियन एंफ्लूएंजा ( फाउल प्लेग ) के प्रकोप को देखते हुए निम्नलिखित पशुधन और पशुधन उत्पादों का सभी देशों से भारत में आयात निषिद्ध होगा:-
( i ) कैद पक्षियों सहित घरेलू और वन्य पक्षी ( कुक्कुट को छोड़कर) ;
( ii ) वन्य पक्षियों समेत एवियन प्रजातियों का असंसाधित माँस और माँस उत्पाद ( कुक्कुट के अलावा ) ;
( iii) घरेलूऔर वन्य पक्षियों का वीर्य ।
इसके अलावा, केन्द्र सरकार ऐसे किसी अन्य देश से भी निम्नलिखित पशुधन और पशुधन उत्पादों का भारत में आयात निषिद्ध करती है जहां से हाइली पैथोजोनिक एवियन एंफ्लूएंजा ( फाउल प्लेग ) के प्रकोप की सूचना प्राप्त हुई है, नामतः:-
( i ) जीवित कुक्कुट;
( ii ) एक दिन के पक्षी , बत्तखें , टर्की एवं अन्य नवजात चूजा प्रजातियां;
(iii) अप्रसंस्करित कुक्कुट का मांस और मांस उत्पाद;
( iv ) हैचिंग अण्डे;
( v ) अण्डा और अण्डा उत्पाद;
(vi) पंख;
(vii ) जीवित सूअर और सूअर मांस के उत्पाद;
( viii ) पैथोलोजिकल सामग्री तथा पक्षियों के जैविकीय उत्पाद;

(ix) पशु आहार में उपयोग के लिए या कृषि या औद्योगिक उपयोग के लिए निर्मित ( पक्षियों से ) पशुमूल के उत्पाद । "
2. उपर्युक्त निषेध अगले आदेशों तक लागू रहेगा ।
इंसे लोकहित में जारी किया जाता है ।

NOTIFICATION
New Delhi , the 8th February, 2006
No. 43 ( RE - 2005)/2004-2009 .
$ .O. 194 (E ) . In exercise of powers conferredby Section 5 of the Foreign Trade ( Development and Regulation ) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy , 2004-2009, the Central Government hereby amends the ITC ( HS ) Classification of Export and Import Items, 2004-2009 as under:
I.Condition 16 of Chapter IA (General Notes to Import Policy) of the ITC ( HS ) Classifications of Export and Import items, 2004-2009 shall be amended to read as under :
"16. Import into India of the following livestock and livestock products shall be prohibited from all countries in view of the reported outbreak of Highly Pathogenic Avian Influenza ( Fowl Plague) :
(1) domestic and wild birds including the captive birds ( excluding poultry) ;
( i ) unprocessed meat and meat products from Avian species including wild birds ( except poultry) ;
( ii) semen of domestic and wild birds .
Further, the Central Government hereby prohibits also the import into India from the countries reporting the outbreak ofHighly Pathogenic Avian Influenza ( Fowl Plague) , the following livestock and livestock products , namely:
(1) live poultry;
( i) day old chicks , ducks , turkey and other newly hatched Avian species ;
( ii) meat and meat product from Avian species including wild birds ;
( v) hatching eggs ;
(4) eggs and egg products ;
(vi) feathers;
( vii ) live pig and pig meat products ;
(viii) pathological material and biological products from birds ;
(x) product of animal origin ( from birds ) intended for use in animal feeding or for agricultural or industrial use ."
2. The prohibition shall be inforce till further orders .
This issues in public interest .
