सं. 4/17/05 - मुद्रा-11. - भारत के राष्ट्रपति ( (श्री नवीन कुमार चौधरी, उप संचिव, भारत सरकार, वित्त मंत्रालय, आर्थिक कार्य विभाग के माध्यम से ) और 'सिक्यूरिटी प्रिंटिंग और मिंटिंग कॉरपोरेशन ऑफ इण्डिया लिमिटेड ' के बीच दिनांक 8 फरवरी , 2006 को निष्पन्न हुए समझौता ज्ञापन के नाते प्रतिभूति ग्रेड कागज और सिक्कों के उत्पादन तथा करेंसी नोट, स्टाम्प और गैर- न्यायिक स्टांप पेपरों के मुद्रण से सम्बन्धित सभी कार्यकलाप (जो पहले आर्थिक कार्य विभाग के अधीन नौ इकाइयों द्वारा किए जाते थे) दिनांक 10 फरवरी , 2006 से नवगठित कंपनी यथा 'सिक्यूरिटी प्रिंटिंग एंड मिंटिंग कॉरपोरेशन ऑफ इंडिया लिमिटेड ' (एसपीएमसीआईएल) को हस्तांतरित कर दिए गए हैं ।
2. आर्थिक कार्य विभांग की उक्त नौ इकाइयों की सभी परिसम्पत्तियां और देयताएं उक्त तिथि से एसपीएमसीआईएल को हस्तांतरित हो चुकी मानी जाएंगी ।
3. आर्थिक कार्य विभाग की उक्त नौ इकाइयों द्वारा विभिन्न आपूर्तिकारों , ठेकेदारों, विक्रेताओं , कंपनियों और व्यक्तियों के साथ की गई सभी विद्यमान संविदाएं, करार और समझौता ज्ञापन, जो इंन नौ इकाइयों के कार्यों के हस्तांतरण की तारीख को अस्तित्व में थे, उन्हें भी उक्त तिथि से एसपीएमसीआईएल को हस्तांतरित और सौंपे गए माना जाएगा ।

4. एसपीएमसीआईएल यथोचित कार्यनिष्पादन हेतु इन संविदाओं , करारों और समझौता ज्ञापनों का पालन करने के लिए पूरी तरह से जिम्मेदार है और उक्त संविदा, करार और समझौता ज्ञापन के तहत कोई विवाद होने पर उत्तराधिकारी /प्रबंधकर्ता के रूप में मुकदमा चला सकेगा या इस पर मुकदमा चलाया जा सकेगा और किसी भी चूक, विलम्ब अथवा गैर- निष्पादन के लिए उत्तरदायी होगा।
5. 10 फरवरी , 2006 से पहले जारी किए गए पत्राचार, बिलों, नोटिस या अन्य दस्तावेजों में दिया गया आर्थिक कार्य-विभाग की नौ इकाइयों का संदर्भ , 10 फरवरी , 2006 के बाद प्रसंगानुसार एसपीएमसीआईएल के संदर्भ के रूप में पढ़ा जाएगा ।
6. 10 फरवरी , 2006 के बाद एसपीएमसीआईएल द्वारा जारी किसी भी बिल, नोटिस या अन्य दस्तावेजों में जहां कहीं आर्थिक कार्य विभाग का संदर्भ होगा, प्रसंगानुसार, उसे एसपीएमआईसीएल के संदर्भ के रूप में पढ़ा जाएगा ।
7. 10 फरवरी , 2006 के बाद से, आर्थिक कार्य विभाग को देय धनराशि के संबंध में भारत सरकार के पक्ष में भुगतान करने वाले सभी चेक/ड्राफ्ट/अन्य लिखतों को, प्रसंगानुसार, 'सिक्यूरिटी प्रिंटिंग एंड मिंटिंग कॉरपोरेशन ऑफ इण्डिया लिमिटेड ' के पक्ष में आहरित किया जाए ।

No. 4/17/05 /Cy. IL- By virtue of the Memorandum of Understanding dated 10th February , 2006 entered into between the President of India, ( acting through Shri Navin Kumar Choudhary, Deputy Secretary to the Government of India, Ministry of Finance , Department of Economic Affairs and Security Printing and Minting Corporation of India Limited' , the activities in the production of security grade paper, coins and printing of currency notes , stamps and non -judicial stamp papers (which were earlier undertaken by the nine units under the Department of Economic Affairs ) has been transferred to the newly formed company viz . Security Printing and Minting Corporation of India Limited ' (SPMCIL) with

2. All the assets & liabilities of the nine units of Department of Economic Affairs stand transferred to SPMCIL w.e.f. the said date .
3. All the existing contracts , agreements and MOUs entered into by the nine units of Department of Economic Affairs with various suppliers , contractors , vendors , companies and individuals , subsisting on date of transfer of functions of the nine units also stand transferred and assigned to SPMCIL w.e.f. the said date .
4. SPMCIL is solely responsible for honouring these contracts , agreements and MOUs for due performance and in case of disputes to sue and be sued as the successor / assignee under the said contract agreement and MOU and shall be liable for any defaults , delays or non- performance ..
5. With effect from 10th February , 2006 , any reference in any correspondence , bills , notices and other documents to the nine units of Department of Economic Affairs having been issued before 10th February, 2006 , shall , wherever the context so permits and allows , be read as reference to the SPMCIL .
6. With effect from 10th February, 2006 , any bill , notice or other document issued by the SPMCIL bearing any reference to the Department of Economic Affairs , shall , wherever the context so permits and allows , be read to be a reference to the SPMCIL .
7. With effect from 10th February, 2006, all cheques / drafts / other instruments under which payment is to be made in favour of the Government of India in respect of monies owed to the Department of Economic Affairs , shall , wherever the context so permits and allows , be drawn in favour of 'Security Printing and Minting Corporation of India Limited' .
