का.आ. 212(अ).- विदेश व्यापार नीति, 2004-2009 के पैराग्राफ 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम, 1992 की धारा 5 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, विदेश व्यापार नीति ( आर ई -2005 ) 2004-2009 में एतद्द्वारा, निम्नलिखित संशोधन करती है :-
1. विदेश व्यापार नीति के पैरा 4.1.8 को निम्नानुसार संशोधित किया जाता है:-
अग्रिम लाइसेंस की सुविधा भी उपलब्ध होगी जहां निर्यातक को कुछ अथवा समस्त निवेश निशुल्क आपूर्तित किए जा रहे हैं ।
ऐसेमामलों में, मूल्य संवर्धन की संगणना हेतु, अन्य शुल्क मुक्त निवेशों के मूल्य सहित निशुल्क निवेशों का कल्पित मूल्य ध्यान में रखा जाएगा । तथापि, यदि सभी निवेश निशुल्क आपूर्तित किए जाते हैं, तो नीति के पैरा 4.2.7 में निर्धारित प्रावधान चुनने का भी निर्यातक को विकल्प प्राप्त होगा ।
इसे लोकहित में जारी किया जाता है ।

New Delhi , the 15th February , 2006

S.O. 212(E) .---In exercise of powers conferred under Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy , 2004-2009, the Central Government hereby makes the following amendments in the Foreign Trade Policy, (RE - 2005) 2004-2009:
1. Para 4.1.8 of the Foreign Trade Policy stands amended as follows :
The facility of Advance Licence shall also be available where some or all of the inputs are supplied free of costto the exporter .
In such cases , for calculation of value addition, the notional value of free of cost inputs along with value of other duty- free inputs shall be taken into consideration. However, if all the inputs are supplied free of cost , the exporter shall also have the option to follow the provision prescribed in paragraph 4.2.7 ofthe Policy.
This issues in Public interest .
