का.आ. 219 ( अ ) - राष्ट्रपति , संविधान के अनुच्छेद 77 के खण्ड ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत सरकार ( कार्य- आबंटन ) नियम , 1961 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है , अर्थात्ः-
1. (1 ) इन नियमों का नाम भारत सरकार (कार्य- आबंटन) दो सौ तिरासीवां संशोधन नियम , 2006 है ।
(2 ) ये तुरंत प्रवृत्त होंगे ।
2 . भारत सरकार ( कार्य-आबंटन ) नियम , 1961 में,-
प्रथम अनुसूची में, -
(1)
(i) " 8क. संस्कृति मंत्रालय " शीर्षक का लोप किया जाएगा;
(ii) " 18. मानव संसाधन विकास मंत्रालय " शीर्षक के अधीन , " ( iii ) महिला और बाल विकास विभाग " उपशीर्षक का लोप किया जाएगा;
(iii) " 21 क. खान मंत्रालय " शीर्षक के पश्चात्, निम्नलिखित शीर्षक रखा जाएगा , अर्थात्ः-
" 21ख. अल्पसंख्यक कार्य मंत्रालय" ;
(iv) विद्यमान " 22क . प्रवासी भारतीय कार्य मंत्रालय " शीर्षक के स्थान पर, " 22क. महासागर विकास मंत्रालय " शीर्षक रखा जाएगा;

[PART 11-SEC . 3 ( ii)) (v) यथा प्रतिस्थापित " 22 क. महासागर विकास मंत्रालय " शीर्षक के पश्चात् निम्नलिखित शीर्षक रखा जाएगा , अर्थात्ः-
" 22कक. प्रवासी भारतीय कार्य मंत्रालय";
(vi) " 38. पर्यटन मंत्रालय " शीर्षक के स्थान पर, निम्नलिखित शीर्षक और उपशीर्षक रखे जाएंगे , अर्थात्ः-
" 38. पर्यटन और संस्कृति मंत्रालय
(i) पर्यटन विभाग
(ii) संस्कृति विभाग";
(vii) " 41. जल संसाधन मंत्रालय " शीर्षक के पश्चात्, निम्नलिखित शीर्षक रखा जाएगा , अर्थात्ः-
"41 क . महिला और बाल विकास मंत्रालय" ;
" 44. महासागर विकास विभाग " शीर्षक का लोप किया जाएगा;
(viii)
(2) द्वितीय अनुसूची में, -
(i) " संस्कृति मंत्रालय " शीर्षक और तत्संबंधी प्रविष्टियों का लोप किया जाएगा;
(ii) " विदेश मंत्रालय " शीर्षक के अधीन , प्रविष्टि 26 का लोप किया जाएगा;
(iii) " मानव संसाधन विकास मंत्रालय " शीर्षक के अधीन , " ग. महिला और बाल विकास विभाग " उपशीर्षक और तत्संबंधी प्रविष्टियों का लोप किया जाएगा ;
(iv) "खान मंत्रालय " शीर्षक और तत्संबंधी प्रविष्टियों के पश्चात्, निम्नलिखित शीर्षक और तत्संबंधी प्रविष्टियां रखी जाएंगी , अर्थात्ः-
" अल्पसंख्यक कार्य मंत्रालय
1. अल्पसंख्यक समुदायों के विनियामक और विकास कार्यक्रमों की समग्र नीति , विनियोजन , समन्वय , मूल्यांकन और पुनरीक्षण ।

2. विधि और व्यवस्था से संबंधित मामलों को छोड़कर , अल्पसंख्यक समुदायों से संबंधित सभी मामले ।
3. केन्द्रीय सरकार के अन्य मंत्रालयों तथा राज्य सरकारों के परामर्श से अल्पसंख्यकों के संरक्षण के लिए नीतिगत पहलें एवं उनकी सुरक्षा ।
4. भाषायी अल्पसंख्यकों और भाषायी अल्पसंख्यक वर्ग आयुक्त के कार्यालय से संबंधित मामले ।
5. राष्ट्रीय अल्पसंख्यक आयोग अधिनियम से संबंधित मामले ।
6. निष्कांत संपत्ति प्रशासन अधिनियम, 1950 (1950 का 31 ) (अब निरसित ) के अधीन निष्कांत वक्फ संपत्तियों से संबंधित कार्य ।
7. आंग्ल- भारतीय समाज के लिए प्रतिनिधित्व ।
8. विदेश मंत्रालय के परामर्श से , 1955 के पंत - मिर्ज़ा करार के निर्बधनों के अनुसार , पाकिस्तान के गैर - मुस्लिम धर्म- स्थानों और भारत में मुस्लिम धर्म-स्थानों का संरक्षण और परिरक्षण ।
9. विदेश मंत्रालय के परामर्श से , पड़ोसी राष्ट्रों में अल्पसंख्यक समुदायों संबंधी प्रश्न ।
10. दान और पूर्त संस्थाएं , इस विभाग में व्यवहृत विषयों से संबद्ध दान और धार्मिक विन्यास ।
11. अल्पसंख्यकों के संबंध में सामाजिक- आर्थिक , सांस्कृतिक और शैक्षिक मामले , जिनमें मौलाना आजाद शैक्षिक प्रतिष्ठान सहित अल्पसंख्यक शैक्षिक संस्थाओं एवं संगठनों संबंधी मुद्दे शामिल है ।
12. वक्फ अधिनियम , 1995 ( 1995 का 43) और केन्द्रीय वक्फ परिषद ।
13 . दरगाह ख्वाजा साहिब अधिनियम, 1955 (1955 का 36) 1
14. अल्पसंख्यकों के कल्याण के लिए कार्यकमों एवं परियोजनाओं हेतु वित्तपोषण , जिसमें राष्ट्रीय अल्पसंख्यक विकास एवं वित्तपोषण निगम शामिल है ।
15. अल्पसंख्यकों के लिए केन्द्रीय तथा राज्य के सार्वजनिक क्षेत्र के उपक्रमों , और साथ ही निजी क्षेत्र में रोजगार के अवसर ।

16 . संबंधित केन्द्रीय मंत्रालयों तथा राज्य सरकारों के परामर्श से अल्पसंख्यकों के संरक्षण संबंधी उपायों को तैयार करना और उनकी सुरक्षा ।
17. धार्मिक एवं भाषायी अल्पसंख्यकों के मध्य सामाजिक एवं आर्थिक रूप से पिछड़े वर्गों के लिए राष्ट्रीय आयोग ।
18.
जस्टिस सच्चर समिति से संबंधित सभी मामले ।
19. अल्पसंख्यकों के लिए प्रधानमंत्री का नया 15 - सूत्री कार्यकम ।
20. अल्पसंख्यक समुदायों से संबंधित कोई अन्य विषय । ";
(v) विद्यमान " प्रवासी भारतीय कार्य मंत्रालय " शीर्षक और तत्संबंधी प्रविष्टियों के स्थान पर , निम्नलिखित शीर्षक और तत्संबंधी प्रविष्टियां रखी जाएंगी , अर्थात्ः-
" महासागर विकास मंत्रालय
1. महासागर से संबंधित ऐसे मामले जो किसी अन्य विभाग/मंत्रालय को विशिष्टतया आबंटित न किए गए हों ।
2. महासागर और ध्रुवीय क्षेत्रों से संबंधित नीति , समन्वय , और स्कीमें जिसके अंतर्गत निम्नलिखित भी है:
(क) (i) अनुसंधान ( मौलिक अनुसंधान सहित ) और उससे संबंधित उपयोगों का विकास;
(ii) प्रौद्योगिकीय विकास;
( iii
) सजीव और निर्जीव समुद्री संसाधनों की उपलभ्यता का पता लगाने और उनका मानचित्रांकन करने के लिए सर्वेक्षण;
समुद्री संसाधनों का परिरक्षण , संधारण और संरक्षण ;
(iv)
समुचित कौशल और जनशक्ति का विकास;
(v)
(vi) अंतर्राष्ट्रीय सहयोग और सहकारिता;

(ख) उपर्युक्त से संबंधित कानून और विनियामक उपाय ।
3. खुले सागर में समुद्री पर्यावरण ।
4. महासागर आयोग ।
5. सर्वभारतीय समुद्र विज्ञान संगम ।
6. महासागर विज्ञान और प्रौद्योगिकीय अभिकरण अथवा बोर्ड ।
7. राष्ट्रीय महासागर प्रौद्योगिकी संस्थान (एन.आई.ओ.टी.)
8. राष्ट्रीय अंटार्कटिक और महासागर अनुसंधान केन्द्र (एन.सी.ए.ओ.आर.)
9. भारतीय राष्ट्रीय महासागर सूचना सेवा केन्द्र (आई.एन.सी.ओ.आई.एस.) । ";
(vi) " महासागर विकास मंत्रालय " शीर्षक और तत्संबंधी प्रविष्टियों के पश्चात् निम्नलिखित शीर्षक और तत्संबंधी प्रविष्टियां रखी जाएंगी , अर्थात्ः-
" प्रवासी भारतीय कार्य मंत्रालय
1. प्रवासी भारतीयों से संबंधित सभी मामले जिनमें भारतीय मूल के व्यक्ति तथा अनिवासी भारतीय समाविष्ट है , उन प्रविष्टियों को छोड़कर जो विनिर्दिष्टतः अन्य विभागों को आबंटित की गई है ।
2. समग्र सरकारी नीतियों के अनुसार नवाचारी विनिधानों और नीतिगत पहलों को शामिल करते हुए भारत में विशेषतया प्रवासी भारतीयों के लिए अनन्य विशेष आर्थिक जोनों जैसे क्षेत्रों में , प्रवासी भारतीयों द्वारा विनिधान का संवर्धन ।
3. विदेशी विनिधान संवर्धन बोर्ड और विदेशी विनिधान कार्यान्वयन प्राधिकरण में प्रतिनिधित्व होना ।
4. विनिधान आयोग से अंतःकिया करना तथा उक्त आयोग द्वारा इस मंत्रालय से परामर्श लिया जाना तथा प्रवासी भारतीयों के विदेशी प्रत्यक्ष विनिधान से संबंधित सभी मामलों के बारे में इस मंत्रालय को सूचित करते रहना ।
5. उत्प्रवास अधिनियम , 1983 (1983 का 31 ) के अधीन भारत से प्रवासी देशों को होने वाला संपूर्ण उत्प्रवास और उत्प्रवासियों की वापसी ।

6. प्रवासी भारतीय दिवस , प्रवासी भारतीय सम्मान पुरस्कारों और प्रवासी भारतीय केन्द्र से संबंधित मामले ।
7. भारत में प्रवासी भारतीय स्वयंसेवकों के लिए कार्यक्रमों से संबंधित मामले ।
8. विदेश मंत्रालय से परामर्श और समन्वय करते हुए ऐसे देशों, जहां प्रवासी भारतीयों की गहन आबादी है , में प्रवासी भारतीय कार्य केन्द्रों की स्थापना और उनका प्रशासन ।
9. भारतीय मूल के व्यक्तियों/अनिवासी भारतीयों को रोजगार सहायता संबंधी नीति, जिसमें सरकारी सेवा में आरक्षण सम्मिलित नहीं है ।
10. मानव संसाधन विकास मंत्रालय और संस्कृति मंत्रालय से परामर्श करके , भारत में ऐसी विभिन्न शैक्षिक, तकनीकी और सांस्कृतिक संस्थाओं , जहां अनिवासी भारतीय/ भारतीय मूल के छात्रों के लिए विवेकाधीन कोटा विद्यमान है , में अनिवासी भारतीय/ भारतीय मूल के छात्रों के प्रवेश से संबंधित सूचना एकत्र करना और उसका प्रचार - प्रसार करना ।
11. विदेश मंत्रालय से परामर्श करके विभिन्न स्कीमों के अधीन भारत में अध्ययन के लिए अनिवासी भारतीय/ भारतीय मूल के छात्रों को छात्रवृत्ति ।
12. प्रवासी भारतीय समुदाय और भारत के मध्य सुदृढ़ संबंधों को सुनिश्चित करने के लिए विपणन और संचार कार्यनीतियों का विकास ।
13. आर्थिक कार्य विभाग से परामर्श करके सरकारी और मूल संगठनों को अनिवासी भारतीयों/ भारतीय मूल के व्यक्तियों के योगदान संबंधी मामले ।
14. प्रवासी भारतीयों से संबंधित मामलों पर राज्य सरकारों को दिशा- निर्देश तथा उनसे सहयोग और समन्वय ।
15. भारतीय सांस्कृतिक संबंध परिषद में प्रतिनिधित्व होना ।
16 . श्रम और रोजगार मंत्रालय की सहमति से विदेशों में कुशल जनशक्ति की आवश्यकताओं को पूरा करने के लिए व्यावसायिक और तकनीकी प्रशिक्षण प्रदान करने हेतु संस्थाओं की स्थापना ।
17. विदेश मंत्रालय के परामर्श से और विदेश नीति के उद्देश्यों के अनुरूप प्रवासी भारतीय मागलों के संबंध में देश बाह्य प्रचार ।

18. व्यापार , संस्कृति , पर्यटन , मीडिया , युवा मामले , स्वास्थ्य, शिक्षा , विज्ञान और प्रौद्योगिकी जैसे क्षेत्रों में संबंधित मंत्रालयों से परामर्श करके भारत के साथ प्रवासी भारतीयों की अंतःकिया के लिए नई पहलें ।
19. नागरिकता अधिनियम , 1955 ( 1955 का 57) की धारा 7ख ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग ।
टिप्पणः सभी संबंधित मंत्रालयों को, उनके द्वारा किए जाने वाले प्रवासी भारतीयों संबंधी सभी कार्यों, जैसे पीआईओ कार्ड स्कीम , दोहरी नागरिकता संबंधी मुद्दे, प्रवासी भारतीयों के गैर सरकारी संगठनों के एफसीआरए संबंधी मामलों , में प्रवासी भारतीय कार्य मंत्रालय से परामर्श करना होगा । इसी प्रकार भारतीय रिजर्व बैंक प्रवासी भारतीयों के निक्षेपों को नियंत्रित करने वाली नीतियां और स्कीमें तैयार करने के दौरान प्रवासी भारतीय कार्य मंत्रालय से परामर्श करेगा । " ;
(vii) "सामाजिक न्याय और अधिकारिता मंत्रालय " शीर्षक के अधीन, -
" (क) प्रविष्टि 12 प्रतिस्थापित की जाएगी , अर्थात्:- " 12. भिक्षावृत्ति । ";
(ख) प्रविष्टि 13,14,39 , 40 , 41 , 42 , 43 , 45 और 47 का लोप किया जाएगा । " ;
(viii) " पर्यटन मंत्रालय " शीर्षक और तत्संबंधी प्रविष्टियों के स्थान पर , निम्नलिखित शीर्षक , उपशीर्षक और तत्संबंधी प्रविष्टियां रखी जाएंगी , अर्थात्ः-
" पर्यटन और संस्कृति मंत्रालय
क. पर्यटन विभाग
1. पर्यटन का विकास और संवर्धन ।
2. पर्यटन के क्षेत्र में अंतर्राष्ट्रीय सहयोग ।

16. निर्धनावस्था वाले ऐसे लेखकों और कलाकारों अथवा उनके उत्तरजीवियों, जो सूचना और प्रसारण मंत्रालय की स्कीम के अधीन नहीं आते , को वित्तीय सहायता; सांस्कृतिक संगठनों और संस्थाओं को अनुदान; इस विभाग में व्यवहृत विषयों के संबंध में छात्रवृत्तियां और फैलोशिप , जिनमें विदेशी सरकारों और विदेशी अभिकरणों द्वारा दी जाने वाली छात्रवृत्तियां और फैलोशिप भी है ; बहुउद्देश्यीय सांस्कृतिक काम्पलैक्स स्थापित करने के लिए अनुदान ।

25. समर्थित और असमर्थित सांस्कृतिक शिष्टमंडलों , आदि द्वारा भारत का परिदर्शन ।
26. विदेश परिदर्शन के लिए सरकार द्वारा समर्थित व्यक्ति (जिसके अंतर्गत सांस्कृतिक व्याख्याता भी है ) ।

S.O. 219 ( E ) . In exercise of the powers conferred by clause ( 3) of article 77 of the Constitution , the President hereby makes the following rules further to amend the Government of India ( Allocation of Business) Rules , 1961 , namely: -
1. (1) These rules may be called the Government of India (Allocation of Business ) Two hundred and eighty third Amendment Rules , 2006 .
(2) They shall come into force at once .
2. In the Government of India ( Allocation of Business) Rules , 1961 , -
in the FIRST SCHEDULE , - (1)
(i) the heading " 8A . Ministry of Culture ( Sanskriti Mantralaya ) " shall be omitted;
