सा.का.नि. 67(अ).-जबकि, अभिहित प्राधिकारी ने , चीन जनवादी गणराज्य से आयातित, सीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51 ) की पहली अनुसूची के उपशीर्ष सं. 8506 10 के अन्तर्गत आने वाले आर 6 एए आकार की कागज और धातु ( हैवी ड्यूटी या सुपर हैवी ड्यूटी दोनों ) दोनों प्रकार की जैकेट वाली प्राईमरी पैनसिल सेल और बैटरियों के आयात पर अधिसूचना सं. 84/2001- सीमाशुल्क, तारीख 2 अगस्त, 2001 सा.का.नि. 570 ( अ ) , तारीख 2 अगस्त, 2001 द्वारा अधिरोपित प्रतिपाटन शुल्क के जारी रहने के संबंध में, भारत के राजपत्र, असाधारण , भाग I , खण्ड 1 , तारीख 2 फरवरी , 2006 में प्रकाशित अधिसूचना सं. 53/ 1/2000- डीजीएडी द्वारा निर्णायक समीक्षा प्रारम्भ की है तथा निर्णायक समीक्षा के परिणामों के लम्बित रहने तक, अधिरोपित प्रतिपाटन शुल्क की अवधि एक और वर्ष तक बढ़ाने का अनुरोध किया है :
अतः , अब, केन्द्रीय सरकार, सीमाशुल्क टैरिफ अधिनियम , 1975 ( 1975 का 51 ) की धारा 9 क कीउप - धारा ( 1 ) के साथ पठित उप- धारा (5) के दूसरे परंतुक एवं उप- धारा (6 ) और सीमाशुल्क टैरिफ ( पाटित वस्तुओं की पहचान , उस पर प्रतिपाटन शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण ) नियम, 1995 के नियम 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 84/2001-सीमाशुल्कं, तारीख 2 अगस्त, 2001 में निम्नलिखित संशोधन करती है, अर्थात्:-
उक्त अधिसूचना में , पैराग्राफ 2 में, शब्द और अंक 6 फरवरी, 2001 से उदग्रहित किया जाएगा " के पश्चात् और शब्द " और भारतीय करेंसी में संदत्त किया जाएगा " के पूर्व शब्द और अंक " और 5 फरवरी , 2007 तक प्रभावी होगा, जिसमें यह तारीख भी सम्मिलित है " अंतः स्थापित किया जाएगा ।

New Delhi , the 16th February , 2006
No. 8/2006- CUSTOMS
G.SR. 67 ( E).Whereas , the designated authority vide notification No. 53/1 /2000- DGAD, published in Part I , Section 1 of the Gazette of India, Extraordinary , dated the 2nd February ,2006, has initiated review in the matter of continuation ofanti-dumping duty on primary pencil cells and primary batteries of R6 (AA ) size, both in paper and metal (both heavy duty and super heavy duty) jacketed form , excluding rechargeable batteries, falling under sub -heading 8506 10 of the First Schedule tothe Customs Tariff Act , 1975 (51 of 1975 ) , originating in, or exported from, the People's Republic of China, imposed vide notification No. 84/2001 - Customs , dated the 2nd August, 2001 [ G.S.R. 570(E), dated the 2nd August, 2001 ] and has requested for extension of anti- dumping duty for a further period of one year , pending the results of the review investigations;
Now, therefore , in exercise of the powers conferred by Sub- section ( 1 ) , read with Sub- section (5) ofSection 9A ofthe saidCustoms Tariff Act and Rule 23 of the Customs Tariff ( Identification , Assessment and Collection of Anti - dumping DutyonDumped Articles and for Determination of Injury) Rules , 1995 , the Central Government hereby makes the following amendment in the notification ofthe Government of India in the Ministry ofFinance (Department of Revenue) No. 84/2001- Customs[G.S.R. 570 (E) , dated the 2nd August, 2001 ] , namely: -
In the said notification , in Paragraph 2, after the figures and words " 6th February , 2001 " and before the words " and shall be paid in Indian currency", the words and figures " and shall remain in force up to the 5th February, 2007", shall be inserted.
