का.आ. 228(अ).- यतः चाय अधिनियम, 1953 ( 1953 का 29) की धारा 49 की उपधारा ( 1 ) द्वारा यथा अपेक्षित चाय नियमावली, 1954 को संशोधित करने के लिए कतिपय नियम भारत सरकार, वाणिज्य एवं उद्योग मंत्रालय (वाणिज्य विभाग) की दिनांक 21 सितम्बर, 2005 की अधिसूचना सं . सा.आ. 1377 (अ) के तहत भारत के राजपत्र, असाधारण , भाग II , खण्ड 3 , उपखण्ड ( ii) में उनसे प्रभावित होने वाले सभी संभावित व्यक्तियों से भारत के राजपत्र जिसमें यह अधिसूचना उल्लिखित थी, की प्रतियाँ जनता को उपलब्ध होने की तारीख से पैंतालीस दिन की अवधि के भीतर आपत्तियां या सुझाव आमंत्रित करने के लिए कतिपय नियमों का मसौदा प्रकाशित किया गया था ।
और यतः उक्त राजपत्र अधिसूचना की प्रतियां, 23 सितम्बर, 2005 को जनता को उपलब्ध करा दी गयी थी;
और यतः केन्द्र सरकार को जनता से कोई आपत्तियां अथवा सुझाव प्राप्त नहीं हुए हैं ;
इसलिए , अब , चाय अधिनियम, 1953 (1953 का 29) की धारा 49 की उपधारा (2) के खण्ड और उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा चाय नियमावली, 1954 को आगे संशोधित करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. (1) इन नियमों को चाय (संशोधन) नियम, 2006 कहा जाएगा।
(2) ये सरकारी राजपत्र में अपने अंतिम प्रकाशन की तारीख से लागू होंगे ।

2. चाय नियमावली , 1954 में नियम 37 के परंतुक में छः महीने शब्दों के लिए 'बीस वर्ष ' शब्द प्रतिस्थापित किए जाएंगे ।

टिप्पणी:- मूल नियम दिनांक 25 मार्च, 1954 के सा.नि.आ. 1026 के तहत भारत के राजपत्र में प्रकाशित किए गए थे और बाद में निम्नलिखित संख्याओं के तहत संशोधित किए गए थेः-
1. सा.का. नि. 674 दिनांक 25-4-1979;
2. सा.का.नि. 1081 दिनांक4-12-1986;
3. सा.का.नि. 169 दिनांक 2-3-1987;
4. का.आ. 382( अ ) दिनांक 30-5-1991;
5. सा.का.नि. 932( अ) दिनांक 16-12-1992; और
6. सा.का.नि. 301 ( अ ) दिनांक 20-3-1995 .

NOTIFICATION
New Delhi , the 20th February , 2006
S.O.228 (E) . Whereas a draft of certain rules to amend the Tea Rules , 1954 was published, as required by sub - section ( 1 ) of section 49 of the Tea Act , 1953 (29 of 1953) , in the Gazette of India, Extraordinary, Part - II , Section 3 , Sub- section ( ii) , vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Commerce) number $ .O . 1377 (E) , dated 21st September 2005 for inviting objections or suggestions from all persons likely to be affected thereby, within a period of forty - five days from the date on which the copies of the Gazette of India containing the notification were made available to the public.
And whereas the copies of the said Gazette notification was made available to the public on 23rd September, 2005 ;
And whereas no objections or suggestions have been received from the public by the Central Government;

Now, therefore, in exercise of the powers conferred by sub- section ( 1 ) and clause ( J) of sub-section (2) of section 49 of the Tea Act, 1953 (29 of 1953) , the Central Government hereby makes the following rules further to amend the Tea Rules , 1954, namely: -
1. (1 ) These rules may be called the Tea (Amendment ) Rules , 2006.
(2) They shall come into force on the date of their final publication in the official Gazette .
2. In the Tea Rules , 1954, in the proviso to rule 37, for the words " six months", the words " twenty years " shall be substituted.

Note : The principal rules were published in the Gazette of India vide number SRO 1026 dated 25th March, 1954 , and subsequently amended vide numbers :
