का.आ. 236( अ ). केन्द्रीय सरकार , राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग सेक्शन और स्थायी पुल लोक वित्त पोषित परियोजनाओं के उपयोग के लिए फीस ) नियम, 1997 के नियम 3 , नियम 5 , और नियम ।। और राष्ट्रीय राजमार्ग (फीस की दर) नियम , 1997 के नियम 3 के उपनियम ( 1 ) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह अधिसूचित करती है कि नीचे दी गई अनुसूची में विनिर्दिष्ट दरों पर दोनों तरफ की पहुँच सड़क सहित उत्तरांचल राज्य में राष्ट्रीय राजमार्ग सं0 74 के हरिद्वार नजीबाबाद- काशीपुर पीलीभीत - बरेली सेक्शन पर 19 किलोमीटर में रवासन नदी के आर- पार स्थायी पुल के उपयोग के लिए यांत्रिक यानों पर फीस उदगृहीत और संगृहीत की जाएगी और राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से या यातायात के लिए पुल खोले जाने की तारीख से जो भी पश्चातवर्ती हो , शाश्वतता के आधार पर उक्त अनुसूची में विनिर्दिष्ट दरों पर केन्द्रीय सरकार के निमित्त फीस के संग्रहण के लिए मुख्य इंजीनियर ( रा.रा. ) उत्तरांचल , लोक निर्माण विभाग या उसके प्राधिकृत विधिक प्रतिनिधि को प्राधिकृत करती है । फीस की दरें राष्ट्रीय राजमार्ग ( फीस की दर) नियम , 1997 के उपनियम (3) के उपबंधों के अनुसार पुनरीक्षण के अध्यधीन है ।

उत्तरांचल राज्य में राष्ट्रीय राजमार्ग सं. 74 के हरिद्वार मजीबाबाद- काशीपुर - पीलीभीत - बरेली सेक्शन पर 19.00 कि.मी. में रवासन नदी पर पुल के उपयोक्ताओं से वसूल की जाने वाली फीस की दरें

टिप्पण : जब उसी यांत्रिक यान को एक दिन में एक से अधिक बार पुल को पार करना हो तो उपयोक्ता के पास यह विकल्प होगा कि वह पहली बार ही पुल पार करते समय उक्त अनुसूची में विनिर्दिष्ट दरों का डेढ़ गुणा संदाय कर दे अथवा यदि यान को पूरे मास अथवा उससे भी अधिक लंबी अवधि के लिए निरंतर और बार- बार पुल पार करना पड़ता है तो यान का स्वामी, उक्त अनुसूची में यथा विनिर्दिष्ट उस पर लागू तीस एकल दरों के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
2. निम्नलिखित प्रकार के यानों को उपर्युक्त अनुसूची में विनिर्दिष्ट फीस से छूट प्राप्त है अर्थात्: -
यान:-
(I)
जो " अति विशिष्ट व्यक्ति " प्रतीक वाले हैं अथवा शासकीय रुप से निम्नलिखित से संबंधित है:-
(अ)
भारत के राष्ट्रपति;
(क)
(ख) भारत के उप राष्ट्रपति;
( ग) राज्य के राज्यपाल अथवा संघ राज्य क्षेत्र के उपराज्यपाल;
भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
( घ)
(ङ) ' सी डी' / 'सी सी' नंबर प्लेट वाली कारों का उपयोग कर रहे भारत में रह रहे विदेशी रजनयिक;
(च) राज्य सभा के सभापति अथवा लोक सभा के अध्यक्ष अथवा राज्य विधान परिषद् के अध्यक्ष अथवा राज्य विधान सभा के अध्यक्ष अथवा संघ अथवा राज्य के मंत्री अथवा लोक सभा अथवा राज्य सभा अथवा राज्य विधानमंडल में विरोधीदल के नेता जिनका दर्जा कैबिनेट मंत्री का है और यदि वह यान में बैठे हों , और
(छ ) संसद सदस्य, राज्य की विधान सभा के सदस्य अथवा राज्य की विधान परिषद् के सदस्य अपने - अपने राज्य में यदि वह यथास्थिति संसद द्वारा या संबंधित राज्य के विधानमंडल द्वारा जारी अपना पहचान पत्र प्रस्तुत करते हैं ।

आ) परमवीर चक्र , अशोक चक्र , महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र जैसे वीरता पुरस्कार पाने वाले व्यक्तियों के यान यदि ऐसे पुरस्कार धारक ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यकरुप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता है ।

(II) रक्षा यान , पुलिस यान , अग्नि शमन यान , एम्बुलेंस , अन्त्येष्टि वैन , डाक व तार विभाग के यान और केंन्द्रीय सरकार और राज्य सरकार के कर्तव्यारुढ़ यान ।
3. फीस की दरें , फीस से छूट प्राप्त यानों के वर्ग और प्राधिकारी जिसे शिकायत , यदि कोई हो , की जानी है , का नाम , पता और टेलीफोन नम्बर पथकर बूथ से 500 मीटर पीछे , पथकर चौकी से 100 मीटर पहले और पथकर बूथों पर भी स्पष्ट रुप से प्रदर्शित की जाएंगी । संप्रदर्शन बोर्ड की ऊंचाई , अक्षरों का आकार ऐसा होगा कि चालकों के लिए संप्रदर्शन बोडों को पढ़ना आसान हो और ये अंग्रेजी , हिंदी और उस क्षेत्र की भाषा जिसमें उक्त पुल स्थित है , में सुपाठ्य रुप में लिखित या मुद्रित रुपमें होंगे ।
4. यांत्रिक यान का प्रत्येक चालक , स्वामी अथवा भारसाधक व्यक्ति, स्थायी पुल पार करने से पहले अथवा इसे पार करने के बाद क्रास बार पर अपना यान रोकेगा और पथकर संग्रहण बूथ पर यानों की बाबत देय फीस का संदाय करेगा । पुल पार कर रहे किसी यांत्रिक यान के संबंध में फीस संग्रहण के लिए मुख्य इंजीनियर ( रा.रा. ) , उत्तरांचल , लोक निर्माण विभाग द्वारा प्राधिकृत व्यक्ति इसके लिए प्रारुप "क" में दो प्रतियों में रसीद तैयार करेगा तथा रसीद की एक प्रति यांत्रिक यान के चालक अथवा स्वामी या भारसाधक व्यक्ति को सौंपेगा ।
5. अनुसूची की क्रम सं. 3 में यथा उल्लिखित यानों के प्रकार में " भारी निर्माण मशीनरी और अर्थ मूविंग उपस्कर " भी सम्मलित होंगे ।
6. ऐसे यांत्रिक यान जो उक्त अनुसूची में सम्मलित नहीं है , से कोई फीस उद्गृहीत और संगृहीत नहीं की जाएगी ।

NOTIFICATION
New Delhi , the 23rd February, 2006
S.O. 236(E) :-In exercise of the powers conferred by section 7 of the National Highways Act , 1956 ( 48 of 1956) , read with rules 3 , 5, 6 and 11 of the National Highways ( Fees for the Use of National Highways , Section and Permanent Bridge- Public Funded Projects ) Rules , 1997 and sub -rule ( 1 ) of rule 3 of the National Highways ( Rate of Fee) Rules , 1997, the Central Government hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the Permanent Bridge across Rawasan River in Km. 19.00 on Haridwar Najibabad - Kashipur - Pilibhit - Bareilly Section of National Highway No. 74 in the State of Uttaranchal including approach roads on the both sides at the rates specified in Schedule given below and hereby authorise the Chief Engineer (NH) , 4

Uttaranchal P.W.D. or his authorized legal representative to collect the fees on behalf of Central Government at the rates specified in the said Schedule on the perpetuity basis from the date of publication of this notification in Official Gazette or date of opening of the bridge to the traffic whichever is later . The rates of fee are subject to revision as per the provisions of sub- rule (3 ) of the National Highways (Rate of Fee) Rules , 1997.

Rate of fees to be recovered from users of the bridge across Rawasan River in Km. 19.00 on Haridwar- Najibabad - Kashipur - Pilibhit- Bareilly Section of National Highway No. 74 in the State of Uttaranchal .

NOTE : - When the same mechanical vehicle has to cross the bridge more than once in a day, the user shall have the option to pay one and a half times the rates specified in the Schedule above while crossing the bridge in the first trip itself, or if the vehicle has to use the bridge continuously and quite frequently for the entire month or even beyond that for much longer period the vehicle owner may obtain a monthly pass on the payment of charges equal to thirty times single rates applicable to it as specified in the aforesaid Schedule.
2. The following types of vehicles are exempted from the fees specified above
in the Schedule , namely: -
vehicles -
(i)
(A) having "VIP " symbols ; or Officially belonging to: -
the President of India;
(a)
the Vice- President of India;
(b)
(c) the Governor of a State or Lt. Governor of a Union Territory ;
(d) Foreign Dignitaries on State visit to India;
(e) Foreign Diplomats stationed in India using cars with " CD " / " CC " number plates;
(f) the Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislative Assembly or a Minister for the Union or State , of Leaders of Opposition in Lok Sabha or Rajya Sabha or State Legislatures , having the status of Cabinet Minister, if he is sitting in the vehicle ; or 5

(g) a Member of Parliament , a Member of Legislative Assembly of a State or a Member of Legislative Council of a State, in the respective state, if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be ;
(B) belonging to winner of Gallantry awards such as Param Vir Chakra, Ashok Chakra , Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award;
(ii) Defence vehicles , Police vehicles , Fire fighting vehicles , Ambulances , Funeral vans Vehicles of the Departments of Posts and Telegraphs and Central Government and State Government vehicles on duty.
3. The rates of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of the authority to whom complaints , if any, should be addressed, shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English , Hindi and the regional language of the area in which the stretch is situated.
4. Every driver , owner or person in charge of the mechanical vehicles shall , before crossing the permanent bridge or after having crossed it, stop his vehicle at the cross bar and pay the fee leviable in respect of the vehicles at the fee collection booth . The person authorized by the Chief Engineer (NH) , Uttaranchal Public Works Department to collect fee in respect of any mechanical vehicle crossing, the bridge shall in return , prepare a receipt in duplicate in Form ' A' and hand over one copy of the receipt to the driver or owner or person in charge of the mechanical vehicle.
5. The type of vehicles as mentioned in Serial number 3 of the schedule shall also include "Heavy construction machinery and earth moving equipment " .
6. No fee shall be levied and collected from a mechanical vehicle, which is not covered by the said Schedule.
