का.आ. 268(अ). चूंकि, केन्द्र सरकार को मैसर्स सेलन एक्सप्लोरेशन टैक्नोलोजी लिमिटेड, इन्द्रोरा ऐप्स, पलाज गांव , गांधीनगर जिला, गुजरात से, तेल निकालने के प्रयोग के लिए फ्रांस से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है ;
और, चूंकि पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग, तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप- नियम ( 2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है , जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है ;
और, जबकि, नागर विमानन महानिदेशक ने वायुयान ( खतरनाक वस्तुओं का वहन ) नियमावली, 2003 के नियम 3 के उप-नियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपने परमिट सं. 465 - डीजी/2005 दिनांक 19-12-2005 द्वारा जो कि 30 जून , 2006 तक वैध है इस प्रकार के विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मैसर्स सेलन एक्सप्लोरेशन टेक्नोलोजी लिमिटेड, को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान कीहै ।
अतः , अब विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन एवं नागर विमानन महानिदेशक द्वारा की गई सिफारिशों के आधार पर केन्द्र सरकार एतद्वारा मैसर्स सेलन एक्सप्लोरेशन टेक्नोलोजी लिमिटेड, गांधीनगर जिला, गुजरात को मै . इट्यूडस एट प्रोडक्शंस श्लमबर्गर , 1 यू हेनरी बैकरल , बी.पी. 202 , 92142 क्लेभार्ट सीडेक्स ,फ्रांस से चेन्नई हवाई अड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप-नियम ( 2 ) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है, नामतः :-

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः :-
( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों. यदि कोई हों, का पालन किया जाएगा:

(2) 1 जनवरी , 1996 से लागू हुई अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के 37वें संस्करण की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा;
(3) [नियम 31 के उप- नियम ( 2 ) के अलावा उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जाएगा;
(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;
(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अन्तरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;
(6 ) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी ; तथा
( 7) उपर्युक्तविस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगरपालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

S.O. 268 (E ) . Whereas the Central Government has received a proposal made by M/ s . Selan Exploration Technology Limited, Indrora Eps , Palaj Village, Gandhinagar District , Gujarat to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from France for oil exploration purposes ;
And, whereas the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explo- şives shall be used for oil exploration purposes and , therefore, necessary exemption may be granted from the purview of sub -rule (2) ofrule 31 of the Explosives Rules , 1983 (hereinafter referred to as the said rules) which prohibits import or export of explosives specified herein by air;
And, whereas the Director General of Civil Aviation has in exercise of powers conferred by sub - rule ( 1 ) ofrule 3 of the Aircraft (Carriage of Dangerous Goods ) Rules , 2003 , granted necessary permission with certain conditions to M/s . Selan Exploration Technology Ltd. to carry such explosives by air vide their permit number 465 - DG /2005 dated 19-12-2005 which is valid upto 30th June, 2006;
Now, therefore, in exercise of the powers conferred by Sub - section (2 ) of Section 14 of the Explosives Act, 1884 (4 of 1884) , and on the recommendations made by the Petroleum and Explosives Safety Organisation and the Director General of Civil Aviation, the Central Government hereby exempts M/ s . Selan Exploration Technology Limited , Gandhi Nagar Deuint, Gujar fuam the pro valsa.ore nadeefale31 ofthe said rules, for import of the following explosives , the भारत का राजपत्र असाधारण

items and quantities of which are specified in the Table below, by air from M/s. Etudes et Productions Schlumberger , I Rue Henri Bacquerel , B. P. 202, 92142 , Clamart, Cedex , France at Chennai Airport, namely:-

2. The explosives mentioned in the Table shall be imported subject to the following conditions , namely:-
( 1) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;
(2) explosives conforming only to Division 1.4 ofthe Division relating to class 1 Explosives falling under 3.1 of Section 3 of 37th Edition of the International Air Transport Association Dangerous Goods Regulations , which became effective on 1st January , 1996 shallbe imported;
(3) strict compliance with the relevant provisions relating to the possession, transport , use and import of explosives , [ except sub - rule ( 2) ofrule 31 ] ofthe said rules ;
(4) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres aroundthe aircraft and the explosives van shall be cordoned offby providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosivesfrom aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(6) smoking or use of naked light shall not be permitted within the cordoned area; and
(7) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any, shall be complied with during the transportation of explosives .
