सा.का.नि. 128(अ) .-अभिहित प्राधिकारी ने, इंडोनेशिया, मलेशिया, थाईलैंड और ताईवान में उद्गमित या वहां से निर्यात किए गए पार्शियली ओरिएण्टेड यार्न ( पीओवाई ) जिस पर की भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 15/2002- सीमाशुल्क, तारीख 8 फरवरी , 2002 [ सा.का.नि. 92 (अ ) , तारीख 8 फरवरी , 2002 द्वारा प्रकाशित ] के तहत प्रतिपाटन शुल्क अधिरोपित किया गया है, के आयात केमामले में भारत के राजपत्र, असाधारण , भाग I , खण्ड 1 , तारीख 20 दिसम्बर, 2005 में प्रकाशित अधिसूचना सं. 15/9/2005- डीजीएडी, तारीख 20 दिसम्बर, 2005 के तहत सीमाशुल्क टैरिफ अधिनियम , 1975 ( 1975 का 51 ) की धारा 9क की उप- धारा ( 5 ) के साथ पठित सीमाशुल्क टैरिफ (पाटित वस्तुओं की पहचान, उन पर प्रतिपाटित शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण ) नियम, 1995 ( जिसे इसके पश्चात् उक्त नियम भी कहा गया है ) के नियम 23 के तहत, प्रतिपाटन शुल्क जारी रखने के मामले में निर्णायक समीक्षा आरम्भ की है और समीक्षा के सम्पन्न होने तक, प्रतिपाटन शुल्क को इसके समाप्ति की तारीख से एक साल की अवधि तक बढ़ाने की सिफारिश की है ;
अतः , अब, केन्द्रीय सरकार, उक्त नियम के नियम 23 के साथ पठित सीमाशुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51 ) की धारा 9 क की उप- धारा ( 1 ) और उप- धारा ( 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 15/2002- सीमाशुल्क, तारीख 8 फरवरी , 2002 का निम्नलिखित और संशोधन करती है, अर्थात:-
उक्त अधिसूचना में, पैराग्राफ 2 के पश्चात्, निम्नलिखित पैराग्राफ अंतःस्थापित किया जाएगा, अर्थातः-
" 3. यह अधिसूचना, जब तक कि अधिसूचना को पहले विखण्डित न किया जाए, 11 अप्रैल , 2007 जिसमें यह तारीख भी शामिल है, तक प्रभावी रहेगी ।" ।

G.S.R. 128 (E ) . Whereas , the designated authority vide notification No. 15/9/2005 - DGAD , dated the 20th December 2005, published in Part I, Section 1 of the Gazette of India, Extraordinary, dated the 20th December , 2005 , has initiated review , interms of Sub -section (5 ) of Section 9A of the Customs TariffAct, 1975 (51 of 1975) read with Rule 23 ofthe Customs Tariff (Identification,Assessment and Collection of Anti - dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (hereinafter referred to as the said Rules ) , in the matter of continuation of anti -dumping duty on Partially Oriented Yarn (POY) , originating in , or exported from Indonesia , Malaysia, Thailand and Taiwan , imposed vide notification oftheGovernment of India in the Ministry of Finance (Department of Revenue ) , No. 15/2002- Customs , dated the 8th February , 2002 [ published vide number G.S.R. 92 (E) , dated the 8th February, 2002 ] , and has requested for extension of anti- dumping duty for a period of one year from the date of its expiry, in terms of Sub - section (5) of Section 9A of the said Customs TariffAct, pending the completion of the review;
Now therefore, in exercise of the powers conferred by Sub - sections ( 1 ) and ( 5) of Section 9A of the said Customs TariffAct, 1975, read with Rule 23 of the said Rules , the Central Government hereby makes the following amendment in the notification ofthe Government of India , in the Ministry of Finance (Department of Revenue ) , No. 15 / 2002 - Customs , dated the 8th February, 2002 , namely:
Inthe said notification , after paragraph two , the following paragraph shall be inserted , namely:-
"3.Thisnotification shall remain in force upto and inclusive of the 11th day of April , 2007, unless the notification is revoked earlier ." .
