विदेशी मुद्रा प्रबंध ( भारत में अचल संपत्ति का अभिग्रहण तथा अंतरण ) (संशोधन ) विनियमावली, 2006
सा.का.नि. 130(अ) .-विदेशी मुद्रा प्रबंध अधिनियम, 1999 (1999का 42 ) की धारा 6 की उप- धारा ( 3 ) के खंड ( i ) , धारा 47 की उप- धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय रिज़र्व बैंक इसके द्वारा विदेशी मुद्रा प्रबंध ( भारत में अचल संपत्ति का अभिग्रहण तथा अंतरण ) विनियमावली, 2000 ( मई 3 , 2000 की अधिसूचना सं . फेमा 21 /2000- आरबी ) में निम्नलिखित संशोधन करता है, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( i ) ये विनियम विदेशी मुद्रा प्रबंध ( भारत में अचल संपत्ति का अभिग्रहण तथा अंतरण ) (संशोधन) विनियमावली, 2006 कहलाएंगे ।
(ii ) ये सरकारी राजपत्र में इनके प्रकाशित होने की तारीख सेलागूहोंगे ।
2. विनियमावली 3 में संशोधन. विदेशी मुद्रा प्रबंध ( भारत में अचल संपत्ति का अभिग्रहण तथा अंतरण ) विनियमावली , 2000 (अब से आगे मूल विनियमावली के रूप में उल्लिखित ) के विनियम 3(क) को निम्नलिखित से प्रतिस्थापित किया जाएगा:

" (क) भारत में कृषि/बागवानी अथवा फार्म हाऊस से इतर किसी अचल संपत्ति का अधिग्रहणः
बशर्ते अचल संपत्ति के अधिग्रहण के मामले में खरीद मूल्य का भुगतान, यदि कोई हो ( i ) भारत से बाहर के किसी स्थान से आवक प्रेषण के रूप में सामान्य बैंकिंग चैनल के माध्यम से भारत में प्राप्त निधियों अथवा ( ii ) अधिनियम के प्रावधानों और रिज़र्व बैंक द्वारा बनाए गए विनियमों के अनुसार रखे गए किसी अनिवासी खाते में रखी गई निधियों में से किया जाएगा ।
बशर्ते इसके अलावा कि यात्री चेकों अथवा विदेशी मुद्रा नोटों अथवा इस खंड में विशेष रूप से अनुमत प्रकार को छोड़कर किसी अन्य प्रकार से अचल संपत्ति के अधिग्रहण के लिए खरीद मूल्य का भुगतान नहीं किया जाएगा।"
3. विनियम 4 में संशोधन. विनियम 4 में खंड (क) को निम्नलिखित से प्रतिस्थापित किया जाएगा, अर्थात्: -
" (क) भारत में कृषि/ बागवानी अथवा फार्म हाऊस से इतर किसी अचल संपत्ति का अधिग्रहणः
बशर्ते अचल संपत्ति के अधिग्रहण के मामले में खरीद मूल्य का भुगतान, यदि कोई हो (i ) भारत से बाहर के किसी स्थान से आवक प्रेषण के रूप में सामान्य बैंकिंग चैनल के माध्यम से भारत में प्राप्त निधियों अथवा ( ii ) अधिनियम के प्रावधानों, और रिज़र्व बैंक द्वारा बनाए गए विनियमों के अनुसार रखे गए किसी अनिवासी खाते में रखी गई निधियों में से किया जाएगा ।

"(a) acquire immovable property in India other than an agricultural property , plantation , or afarm house :
बशर्ते इसके अलावा कि यात्री चेकों अथवा विदेशी मुद्रा नोटों अथवा इस खंड में विशेष रूप से अनुमत प्रकार को छोड़करकिसी अन्य प्रकार से अचल संपत्ति के अधिग्रहण के लिए खरीद मूल्य का भुगतान नहीं किया जाएगा । "

Provided that in case of acquisition of immovable property, payment of purchase price, if any, shall be made out of ( i ) funds received in India through normal banking channels by way of inward remittance from any place outside India or ( ii) funds held in any non - resident account maintained in accordance with the provisions of the Act and the regulations made by the Reserve Bank.
2000के सं. सा.का.नि. 407( अ ) में भाग II , खंड 3 , उप- खंड ( i ) में प्रकाशित किए गए थे और तत्पश्चात्19 अगस्त, 2002 के सं. सा.का.नि 578 ( अ ) और जुलाई 22, 2003 के सं. सा.का.नि. 557 ( अ ) द्वारा संशोधित किए गए ।

3.Amendment of Regulation 4.-In regulation 4, for clause ( a) , the following shall be substituted, namely: --

Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) (Amendment) Regulations , 2006
Provided that in case of acquisition of immovable property , payment of purchase price , ifany , shall be made out of ( i) funds received in India through normal banking channels by way of inward remittance from any place outside India or ( ii) funds held in any non- resident account maintained in accordance with the provisions of the Act and the regulations made by the Reserve Bank.
G . $ . R. 130(E) . In exercise of the powers conferred by clause ( i) of Sub - section (3 ) of Section 6 , Sub- section (2) of Section 47 of the Foreign Exchange Management Act, 1999 (42 of 1999 ) the Reserve Bank of India hereby makes the following amendments in the Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) Regulations , 2000 (Notification No. FEMA. 21 /2000 -RB dated May 3 , 2000 :-
Provided further that no payment of purchase price for acquisition of immovable property shall be made either by traveller's cheque or currency notes of any forcign country or any mode other than those specifically permitted by this clause . " 1. Short Title and Commencement . ( i) These Regulations may be called the Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) (Amendment) Regulations , 2006 .

Foot Note . The Principal Regulations were published in the Official Gazette vide No. G.S.R. 407 (E) dated May 8 , 2000 in Part II , Section 3 , Sub- section ( i) and subsequently amended vide No. G.S.R. 578 (E) dated August 19 , 2002 and 557 (E) dated July 22, 2003 .
2. Amendment of Regulation 3. In regulation 3 of the Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) Regulations , 2000 (hereinafter referred to as the principal regulations ) , for clause ( a) , the following shall be substituted , namely :-
