सा.का.नि. 137 (अ ) .-केन्द्रीय सरकार, भारत - तिब्बत सीमा पुलिस बल अधिनियम, 1992 ( 1992 का 35 ) की धारा 156 की उप- धारा ( 2 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत - तिब्बत सीमा पुलिस बल साधारण ड्यूटी काडर ( समूह ' ख ' और ' ग ' पद ) भर्ती नियम , 2000 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. (1) इन नियमों का संक्षिप्त नाम भारत- तिब्बत सीमा पुलिस बल साधारण ड्यूटी काडर ( समूह ' ख ' और ' ग ' पद ) भर्ती (संशोधन) नियम, 2006 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. भारत- तिब्बत सीमा पुलिस बल साधारण ड्यूटी काडर ( समूह ' ख ' और ' ग' पद ) भर्ती नियम , 2000 की अनुसूचि में, -
(i) क्र.सं. 1 पर वर्णित पद के सामने ,
(क) स्तंभ 2 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टयां रखी जाएंगी, अर्थात्ः-

(ख) स्तंभ 11 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्ः-
"प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा ।
भूतपूर्व सैनिकों के लिए :
प्रतिनियुक्ति/ पुनर्नियोजन" ,
(ग) स्तंभ 12 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्ः-
(i) प्रोन्नति द्वारा : ऐसा उप निरीक्षक (साधारण ड्यूटी) जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की हो और गृह मंत्रालय द्वारा जारी किए गए यूओ सं . 1.45020 / 52 / 2001 कार्मिक- ।। तारीख 30 जनवरी 2002 में यथा अतर्विष्ट चिकित्सा प्रवर्ग शेप-1 में रहा हो , और जिन्होंने सफलतापूर्वक पूर्व प्रोन्नति पाठ्यक्रम पूरा किया हो और विभागीय परीक्षण में अर्हता हो ,-
टिप्पण : - जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी
1 अर्हक / पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक / पात्रता सेवा , अपेक्षित अर्हक / पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो, कम न हो और उन्होंने अपने एसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक / पात्रता सेवा पहले ही पूरी कर ली है ।
(ii) प्रतिनियुक्ति द्वारा ऐसे निरीक्षक ( साधारण ड्यूटी) जो अन्य केन्द्रीय सरकार या राज्य सरकार पुलिस संगठनों में सदृश पद धारण किए हुए हैं ।
भूतपूर्व सैनिकों के लिए पुनर्नियोजन : सशस्त्र बल के ऐसे कार्मिकों के सबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अर्हताएं हैं और उपर्युक्त प्रोन्नति के लिए यथा विहित चिकित्सा प्रवर्ग शेप 1 में हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना हैय तत्पश्चात उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ।
टिप्पण 1 - प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी ।
टिप्पण 2 प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को बावन वर्ष से अधिक नहीं होगी ।

क्र.सं. 2 पर वर्णित पद के सामने,-
(ii)
(क) स्तंभ 2 की प्रविष्टियों के स्थान निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्ः- "811 * (2006) *कार्यभार के आधार पर परिवर्तन किया जा सकता है । ";
(ख) स्तंभ 11 की प्रविष्टियों के स्थान निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्ः-
"(i) पचास प्रतिशत प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा ।
भूतपूर्व सैनिकों के लिए : प्रतिनियुक्ति / पुनर्नियोजन";
(ii) तैंतीस प्रतिशत कर्मचारी चयन आयोग द्वारा सीधी भर्ती द्वारा । (जिसके लिए पाठ्य विवरण गृह मंत्रालय यूओ सं. 1.45020/34/ 99- कार्मिक. ।। तारीख 26 अगस्त, 1999 के अधीन सरकार द्वारा परिचालित स्कीम के अनुसार होगा ।)
(iii) सत्रह प्रतिशत हैड कांस्टेबलों, लांस नायकों और कांस्टेबलों के रैंक के भारत- तिब्बत सीमा पुलिस बल साधारण ड्यूटी काडर कार्मिक के लिए सीमित विभागीय प्रतियोगिता परीक्षा के माध्यम से प्रान्नति द्वारा जिसके न हो सकने पर प्रोन्नति द्वारा । उक्त परीक्षा के लिए पाठ्य विवरण गृह मंत्रालय यू०ओ सं. 1.45020/ 5/ 2000 -कार्मिक ।। तारीख 17.5.2000 के अधीन सरकार द्वारा परिचालित तथा समय समय पर यथा संशेधित स्कीम के अनुसार होगा ।
(ग) स्तंभ 12 की प्रविष्टियों के स्थान निम्नलिखित प्रविष्टियां रखी जाएंगी अर्थात्:-
"(i) प्रोन्नति द्वारा ऐसा हैड कांस्टेबल (साधारण डयूटी)
जिसने हैंड कांस्टेबल (साधारण डयूटी) की श्रेणी में दस वर्ष नियमित सेवा कीहो
या ऐसा हैंड कांस्टेबल (साधारण डयूटी) जिसने उस श्रेणी में पांच वर्ष की नियमित सेवा सहित जिसने उस श्रेणी में और भारत- तिब्बत सीमा पुलिस बल में किसी अन्य श्रेणी में अठारह वर्ष नियमित सम्मिलित सेवा की हो और गृह मंत्रालय द्वारा जारी किए गए यूओ सं. 1.45020-52/ 2001 कार्मिक - 11 तारीख 30 जनवरी 2002 में यथा अंतर्विष्ट चिकित्सा प्रवर्ग शेष -1 में रहा हो और पूर्व प्रोन्नति पाठ्यक्रम और विभागीय परीक्षण में अर्हित हो । "
टिप्पण :- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/ पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु [PART II- SEC . 3 ( i) ]

यह तब जब कि उसके द्वारा की गई ऐसी अर्हक / पात्रता सेवा, अपेक्षित अर्हक / पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक / पात्रता सेवा पहले ही पूरी कर ली है ।
( ii ) सीमित विभागीय प्रतियोगिता परीक्षा :
गृह मंत्रालय यूओ सं. 1.45024/ 5 / 2000- कार्मिक.।। तारीख 17.5.2000 के अधीन सरकार द्वारा परिचालित विहित तथा समय समय पर यथा संशोधित स्कीम के अनुसार ।
( iii ) प्रतिनियुक्ति द्वारा : ऐसे उप निरीक्षक (साधारण डयूटी ) जो केन्द्रीय सरकार या राज्य सरकार पुलिस संगठनों में सदृश पद धारण किए हुए हैं ।
भूतपूर्व सैनिकों के लिए पुनर्नियोजन सशस्त्र बल के ऐसे कार्मिकों के सबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अर्हताएं हैं और उपर्युक्त प्रोन्नति के लिए यथा विहित चिकित्सा प्रवर्ग शेप 1 में हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना हैय तत्पश्चात उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ।
टिप्पण 1 - प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण :- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी
अर्हक / पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक / पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक / पात्रता सेवा पहले ही पूरी कर ली है ।

*कार्यभार के आधार पर परिवर्तन किया जा सकता है । ";
(ख) स्तंभ 11 की प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टयां रखी जाएंगी, अर्थात्:-
" पचानवें प्रतिशत सीधी भर्ती द्वारा ।
पांच प्रतिशत अनुचरों के रिमस्टरेशन द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा , दोनों के न हो सकने पर सीधी भर्ती द्वारा । " ,
(ग) स्तंभ 12 की प्रविष्टियों के स्थान निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्: -
(i) अनुचरों का रिमस्टरेशन:
ऐसे कुशल और अकुशल योधक अनुचरों में से स्थानांतरण द्वारा जिन्होंने बल में तीन वर्ष नियमित सेवा की है और जो निम्नलिखित अर्हताएं पूरी करते हैं ,-
(क) 8वीं कक्षा उतीर्ण ;
(ख) सीधी भर्ती के लिए अनुमोदित स्कीम में यथा विहित शारीरिक मानकों को अवश्य रखता हो ।
(i) प्रतिनियुक्ति द्वारा: ऐसे कांस्टेबल ( साधारण ड्यूटी) जो केन्द्रीय सरकार या राज्य सरकार पुलिस संगठन में सदृश पद धारण किए हुए हैं ।
टिप्पण 1 - प्रतिनियुक्ति का अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी ।

New Delhi , the 6th March, 2006
G.S.R. 137(E) . In exercise of the powers conferred by clause (b) of sub- section (2) of section 156 of the Indo- Tibetan Border Police Force Act , 1992 (35 of 1992) , the Central Government hereby makes the following rules further to amend the Indo - Tibetan Border Police Force , General Duty Cadre ( Group ' B ' and ' C ' posts) Recruitment Rules, 2000 namely : -
1. ( 1 ) These rules may be called the Indo - Tibetan Border Police Force, General Duty Cadre (Group ' B' and ' C' posts) Recruitment (Amendment) Rules , 2006.
(2) They shall come into force on the date oftheir publication in the Official Gazette .
2. In the Schedule to the Indo - Tibetan Border Police Force , General Duty Cadre, (Group ' B ' and ' C ' posts ) Recruitment Rules, 2000 , -
(i) against the post appearing at serial number 1 ,
(a) in column 2 , for the entries , the following entries shall be substituted, namely : -
"708 *
(2006) * Subject to variation dependent on workload ." ;
(b) in column 11 , for the entries, the following entries shall be substituted , namely : -
"By promotion failing which by deputation.
Forex - servicemen:

(c) in column 12 , for the entries , the following entries shall be substituted, namely : -
(i) By Promotion: Sub Inspector ( General Duty) with three years regular service in the grade and being in medical category SHAPE - I as contained in the UO No.Ι.45020/ 52 / 2001 - Pers - II , dated the 30th January, 2002 , issued by the Ministry of Home Affairs and who have successfully completed pre -promotional courses and qualified the Departmental Test , -
Note: Where juniors who have completed their qualifying/ eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service.
(ii) By deputation : Inspector ( General Duty) in analogous scale from other Central Government or State Government Police Organisations .
Re - employment for ex - servicemen: The Armed Forces personnel due to retire or who are to be transferred to reserve within a period of one year and have the qualifications and being in Medical Category SHAPE - I as prescribed for promotion above shall also be considered, such persons would be given deputation terms upto the date on which they are due to release from the Armed Forces ; thereafter they may be continued on re - employment .
Note 1 : The period of deputation including the period of deputation in another ex - cadre held immediately preceding this appointment in same or some other organisation or deputation of the Central Government shall ordinarily not exceed three years .
Note 2 : The maximum age- limit for appointment by deputation shall not be exceeding fifty - two years as on the closing date of receipt of application.

Syllabus for the said examination shall be as per Scheme circulated by the Government vide MHA UO No.I.45020/5 /2000- Pers.II dated 17.5.2000 as amended from time to time : "
(c) in column 12, for the entries , the following entries shall be substituted, namely : -
" (i) By promotion Head Constable ( General Duty) -
with ten years service in the grade of Head Constable (General Duty) ,

with five years regular service in the grade of Head Constable (General Duty) who had rendered eighteen years of combined regular service in that grade and any other grade in the Indo- Tibetan Border Police Force, being in medical category SHAPE- I as contained in the UQ No.I.45020/ 52 / 2001 - Pers - II dated the 30th January, 2002 issued by the Ministry of Home Affairs

and qualified pre - promotional Courses and Departmental Test . "
Note : Where juniors who have completed their qualifying / eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/ eligibility service ."
( ii) Limited Departmental Competitive Examination : As perScheme prescribed by the Government circulated by MHA UO No.1.45024/5/ 2000- Pers.II dated 17.5.2000 and as amended from time to time .
( iii) By deputation of Sub Inspector ( General Duty) in analogous scale irom Central Government or State Government Police Organisations .
Re -employment for ex - servicemen : The Armed Forces personnel due to retire or who are to be transferred to reserve within a period of one year and have the qualifications and being in Medical Category SHAPE - I as prescribed for promotion above shall also be considered , such persons would be given deputation terms upto the date on which they are due to release from the Armed Forces ; thereafter they may be continued on re - employment .
Note 1 : - The period of deputation including the period of deputation in another ex - cadre held immediately preceding this appointment in same or some other organisation or deputation of the Central Government shall ordinarily not exceed three years .
Note 2 : The maximum age- limit for appointment by deputation shall not be exceeding fifty - two years as on the closing date of receipt of application .

(iii) against the post appearing at serial number 3 , for the entries , -
(a) in column 2 , for the entries , the following entries shall be substituted , namely : - :

(c) in column 12 , for the entries , the following entries shall be substituted , namely;
(i) By promotion Constable (General Duty) having eight years of regular service in the grade being in medical category SHAPE- I as contained in the UO No.I.45020/52/ 2001 - Pers - II dated the 30th January, 2002 issued by the Ministry of Home Affairs and amended from time to time and successfully completed pre - promotional courses and qualified the Departmental Test .
Note: Where juniors who have completed their qualifying/eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service . "
(ii ) By deputation: Head Constable ( General Duty in analogous scale from other Central Government or State Police Organisations .

( i) Remusteration of Followers :
By transfer against Five percent of the posts from amongst Combatised Followers - Skilled and Unskilled , who have put three years regular service in the Force and subject to fulfilling the following qualifications : -
a ) 8th Class pass ;
b) must possess physical standards as prescribed in the approved scheme for direct recruitment .

(ii) By deputation of Constable (General Duty) in analogous scale from other Central Government or State Government Police Organisation on functional requirement basis . "
