3. अध्याय 29 के अन्त में जोड़ी गई एक नई आयात लाइसेंसिंग टिप्पणी निम्नानुसार होगीः--
"(2) इस अध्याय के तहत आने वाले सभी स्वापक औषध और सइकोट्रापिक पदार्थ निम्नलिखित शर्तों के अधीन होंगे: -
(क) एनडीपीएस नियमावली के नियम 53 के प्रावधानों के तहत आयात प्रमाणपत्र प्राप्त करने के पश्चात , एनडीपीएस नियमावली 1985 के अध्याय 7 - क में चिकित्सा और वैज्ञानिक मामलों के लिए विशेष प्रावधानों के तहत किसी भी स्वापक औषध और साइकोट्रापिक पदार्थ का आयात किया जा सकता है ।
(ख) पूर्ववर्ती पैराग्राफ में दी गई श्रेणी ( क) के अलावा किया जाने वाला आयात, निर्यात और आयात मदों, के आईटीसी ( एचएस ) वर्गीकरण, 2004-09 की अनुसूची 1 ( आयात ) के अनुलग्नक-5 द्वारा अधिशासित होगी ।
4. नियात और आयात मदों के आईटीसी (एचएस) वर्गीकरण , 2004-09 की अनुसूची 1 (आयात) में एक नया अनुलग्नक 5 जोड़ा गया है जो कि इस अधिसूचना के साथ संलग्न है।
इसे लोकहित में जारी किया जाता है ।

क) से आशय है एनडीपीएस नियमावली 1985 के नियम 53 के तहत आयात निषिद्ध है।
ख) से आशय है एनडीपीएस नियमावली, 1985 के नियम 54 के अनुसार सरकारी अफीम और एल्कालाएड को छोड़कर आयात निषिद्ध है ।

(ख ) विनिर्मित स्वापक औषधियाँ ( भारत सरकार की अधिसूचना एस.ओ .826 (ई) दिनांक 14.11.1985 और एस.ओ.40 (ई) दिनांक 29.01.1993 में यथा उल्लिखित) :

2. डीहायड्रो कोडिओन ( सामान्यतः हायड्रोकोडोन) इसके नमक (जैसे कि ग डीकोडाइड, कोडीनोवो, डीकोनोंन, हायकोडन, मल्टाकोडिन, नायोडाइड, यड्रोस्ड और उसी प्रकार के) इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
3. डी हायड्रोमार्फिनोन ( सामान्यतः हायड्रो मार्फिन) और इसके नमक ग (जैसे कि डिलाडाइड, डिमार्किड, नोवालोडोन और उसी प्रकार के) इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो।
4. एसिटाइल हाय ड्रोकोडीनोन ( सामान्यतः एसिटाइल - डीहायड्रो कोडिनोन ग और एसिटाइलडेमिथेलो डीहायड्रोथ , बेन) और इसके नमक (जैसे कि एसिडोकोन नोवोकोडोन और इसी प्रकार के ) इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
5. डी हाय ड्रो मार्फिन, इसके नमक ( जैसे कि पैरामार्फिन और इर्सी ग प्रकार के) इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।

6. डी हायड्रो डी आक्सीमार्फिन; इसके नमक (जैसे कि डेसमार्फिन, ग परमोनिङ, स्कोपरमिड और इसी प्रकार के) इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।

मिथाइल डी हायड्रो मोर्फीनोन (आमतौर पर मेटोपोन नाम से जाना ग जाता है) इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
8. मार्फीन एच आक्साइड (आमतौर पर जेनो- मार्फीन नाम से जाना ग जाता है) और एन-आक्सी मार्फीन, मार्फिन एन-आक्साइड डेरिवेटिव्स और अन्य पेंटावेलेंट नाइट्रोजन मार्फीन डेरिवेटिव्स , लवण तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इन औषधियों में से कोई शामिल हो ।
9. बेंजाइल मारफाइन और अन्य इस्टर्स आफ मार्फीन उनके संबंधित ग इसके ईस्टर और इसके ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो।
10. थेबेइन और इसके लवण तथा विनिर्मित पदार्थ , सम्मिश्रण, सत्व या ग अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
11 बेन्ज़ील मोर्फीन ( जिसका पेरोनाइन एक लवण है ) और अन्यं प्रकार के ग मोर्फीन ( मेथिल मोर्फीन और एथिल मोर्फीन , एवं बेटा -4 मोर्फोलीनीथील मोर्फीन को छोड़कर) तथा उनके संबंधित लवण तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
12. 6 - मिथाइल -6 डिसोक्सी मोर्फीन , इसके लवण, इसके इस्टर्स और इसके ग इस्टर्स के लवण और विनिर्मित पदार्थ , सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
13. डिहाइड्रोहाईड्रोक्सी मोर्फीनोन, इसके लवण, इसके ईस्टर्स तथा इसके ग इस्टर्स के लवण और विनिर्मित पदार्थ, सम्मिश्रण , या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
14. 6-मिथाइल डाईहाइड्रो मोर्फीन , इसके लवण , इसके इस्टर्स और इसके ग ईस्टर के लवण तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
15. एक्गोनाइन के सभी लवण और ईस्टर्स और इसके ईस्टर्स के लवण ग तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
16. केवल बाहरी उपयोग की क्षमता वाल को छोड़कर इण्डियन हेम्प के ग सत्व या टिंचर से बने विनिर्मित पदार्थ भारत का राजपत्र असाधारण

17. 1 -मिथाइल -4 फिनाइल - पिपरडाइन -4 -काबोक्सीलिक एसिड इथाइल ग ईस्टर (आमतौर पर ' पेथीडाइन ' के नाम से जाना जाता है और उसके लवण ( जैसे एन्टीडिओल , बाइफिनेल , सेन्ट्राइजिन, डी-140 , डेमोरोल , डिस्पाडोल , डोडोनल , डोलन्टल , डोलन्टिन, डोइन्टोल , डोलारेन, डोलारिन, डोलातुल, डोलेन्टल , डोलिन्टल, डोलोपेथिन, डोलोसल, डोल्वानोल, यूडोलट, फेलाडाइन, ग्रेटीडाइन , आइसोनीपीकेन, मेपेरीडाइन , मेफेडाइन, पेनिटलगेन , पीरीडोसल, प्रीसीडाइल, सौतीरलगील और वैसे ही ) तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
18. 1 -मिथाइल -4- ( 3- हाइड्रोक्सी फिनाइल) पेपरडाइन - 4- काबोक्सीलिक ग एसिड इथाइल ईस्टर जिसे अन्यथा 1-मिथाइल-4-मेटाहाइडोक्सी फेनिल पेपरीडाइन-4-कार्बोक्सीलिक एसिड इथाइल ईस्टर के नाम से जाना जाता है ) और इसके लवण (बेमीडोन और उस जैसे ) तथा विनिर्मित पदार्थ , सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
19. 1 - मिथाइल -4- ( 3 हाइड्रोक्सीफेली) 4 - पेपरीडाइलेथीलकेटोन ( जिसे ग अन्यथा 1 - मिथाइल - 4- मेटा-हाइड्रोक्सी फिनाइल पेपरीडाइन और केटोबेमीडोन के नाम से जाना जाता है) , इसके लवण ( जैसे क्लीराडोन , केटोगन और उस जैसे ) तथा विनिर्मित पदार्थ, सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।

एल्फा -1-3- मिथाइल- 4- फिनाइल -4- प्रोपिओनोक्सी पेपरीडाइन ग | (आमतौर पर एल्फा प्रोडाइन के नाम से जाना जाता है) और इसके लवण (जैसे निसेन्टिल, निसिन्टिल, एन यू-1196 और उस जैसे ) तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
21. बेटा-1-3- मिथाइल-4-फिनाइल -4-प्रोपिओनोक्सी पिपरीडाइन (आमतौर ग पर ' बेटा प्रोडाइन ' के नाम से जाना जाता है) और इसके लवण ( एन यू-1779 और उस जैसे ) तथा विनिर्मित पदार्थ , सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
2.2. बेटा- 3 - इथाइल - 1 - मिथाइल - 4 - फिनाइल -4 -प्रोपिओनोक्सी पिपरीडाइन ग और इसके लवण ( एन यू-1932 और वैसे ही ) तथा विनिर्मित पदार्थ सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो । (बेटामेप्रोडाइन)
23. आइसोप्रोपील और 1 - मिथाइल-4 फिनाइल पिपरीडाइन-4- ग कार्बोक्सिलिक एसिड और उनके संबंधित लवण तथा विनिर्मित पदार्थ सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो । (प्रोपेरीडाइन)

24. 4-4 डीफिनाइल-6- डीमिथाइलामीनो हेप्टानोन 3 (अन्यथा जिसे ग 6-डिमिथाइल एमिनो 4 : 4-डीफिनाइल-3- हेप्टानोन और मेथाडोन के नाम से जाना जाता है और इसके लवण जैसे ( एडानोन, एलगोलीसिन, एमिडोन, एम्डोसन, बुटलजिन, डेपरीडोल , डिआमिनोन, डिआनोन, डोलाफिन, डोलामिड, डोल्फाइन, डोरीक्सोल , हेप्टाडोल , हेप्टानल , होएक्स्ट, 10820, डेटलजाइन, मेकोडिन, मेपेकशसन, मेफनोन, मिआडोन, मोहेप्टल, फीसेप्टोन, साइसोपटोन, पोलामिडोन , सिमोरोन, तुमानोन और वैसे ही ) तथा विनिर्मित पदार्थ, सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
25. 4: 4-डी फिनाइल 5 मिथाइल 6 डिमिथाइल एमिनो हेक्सानोन ग 3 (अन्यथा जिसे 6 - डिमिथाइल एमिनो-5- मिथाइल-4 : डीफिनाइल 3- हेक्सानोन और आइसोमेथाडोन नाम से जाना जाता है) तथा इसके लवण एवं विनिर्मित पदार्थ सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।.
26. रसेमिक , डेक्स्ट्रो और लेवोफार्म्स आफ एल्फा 6 मिथाइल एमिनो ग 4- डिफिनाइल 3 हेन्टानोल (आमतौर पर जिसे एल्फा मेथाडोल नाम से जाना जाता है) ; रेसमिक, डेक्स्ट्रो फार्म्स आफ बेटा 6- डी मिथाइल - एमिनो 4; 4-डीफिनाइल 3 हेप्टानोल (आमतैर पर जिसे ' बेटा- मेथाडोल ' नाम से जाना जाता है) उनके लवण तथा विनिमित पदार्थ, सम्मिश्रण (मेथाडोल, एनआईएच 2933 सहित ) सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
27. रेसमिक, डेक्स्ट्रो और लेवो फार्म्स आफ एल्फा 6 डीमिथाइल- ग एमिनो 4 : 4- डीफिनाइल - 3 - एसीटोक्सी हेप्टेन (आमतौर पर जिसे ' एल्फा- एसीटिल मेथाडोल ' नाम से जाना जाता है) ; रेसमिक, डेक्सट्रो और लेवो फार्म्स आफ बेटा-6- डीमिथाइल एमिनो-4 4-डीफिनाइल 3 एसिटोटसी हेप्टेन ( आमतौर पर जिसे बेटा- एसिटील मेथाडोल नाम से जाना जाता है) उनके लव्रण तथा विनिर्मित पदार्थ सम्मिश्रण (एसिटील मेथाडोल, एनआईएच 2953 सहित ) सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
28. 4 : 4-डिफिनाइल-6- पीपरीडाइन- 3-हेप्टानोन, इसके लवण तथा ग सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो।
29. 4-डीफिनाइल 6 - डीमिथाइल- एमिनो -3 हेक्सानोन ( जिसे नोर्मेथाडोन के ग नाम से भी जाना जाता है) इसके लवण तथा सम्मिश्रण , सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।
30. 4, 4 - डीफिनाइल- 6- मोर्फोलिनो - हेप्टानोन-3 ( अन्यथा जिसे 6- ग मोर्फोलिनो 4 , डिफिनाइल-3-हेप्टानोन और इसके लवण के रूप में जाना जाता है) (जैसे सीबी 11 , हेपाजिन हेप्टलजिन , हेप्टेन, हेप्टाजोन और उस जैसे) तथा विनिर्मित पदार्थ सम्मिश्रण, सत्व या अन्य पदार्थ जिनमें इनमें से कोई औषध शामिल हो ।

31. 3-हाइड्राक्सी-एन-मेथिल के रेसमिक और लेवो रूप । मार्फिनल ग (आमतौर पर एनयू- 2206 के रूप में अथवा क्रमशः रेसमार्फन और लेवोर्फन जाना जाता है) और उनके लवण जैसे ड्रोमोरन, मेथार्फिनल तथा उस तरह के) और सम्पाक, सम्मिश्रण , अर्क अथवा अन्य पदार्थ जिसमें इनमें से कोई औषधि शामिल है ।
32. 3 - हाइड्राक्सी-एन- मेथिल के रेसमिक और लेवो रूप । मार्फिनल ग (आमतौर पर एनयू- 2206 के रूप में अथवा क्रमशः रेसमेथार्पन और लेवोमेनार्पन जाना जाता है) और उनके लवण जैसे मेथिलड्रोमोरन तथा उस तरह के) और सम्पाक सम्मिश्रण, अर्क अथवा अन्य पदार्थ जिसमें इनमें से कोई औषधि शामिल है ।
33 . 3 -डाई मेथिल - एमिनों 1 , 1 -डाई (2- थिनाईल ) 1 - ब्यूटेन; 3 - एथिल- ग मेथिल- एमिनो -1 , 1 - डाई (2- थाइनिल ) 1 ब्यूटेन; 3 - डाइथिलामाईनो - 1 , 1 -डाई (2-थाइनिल) 1- ब्यूटेन, (डाइथिल- थियाम-ब्यूटेन और थीमालोन के रूप में भी जाना जाता है) और उनके लवण तथा सम्पाक, सम्मिश्रण , अर्क अथवा अन्य पदार्थ जिसमें ये औषधियाँ शामिल हैं ।
34. 4 - मोर्फोलीन-2 , 2 - डाईफेनाइल एथिल ब्यूटीरेट तथा इनके लवण और ग सम्पाक, सम्मिश्रण , अर्क अथवा अन्य पदार्थ जिसमें ये औषधियाँ शामिल हैं (डाईआक्साफेनाईल ब्यूटीरेट)
35. मेथिल मोर्फाईन (आमतौर पर ' कोडलाईन ' के रूप में जाना जाता है) ख और एथिल मोर्फाईन तथा उनके लवण ( डायोनाईन सहित ) , सभी अवमिश्रण और सम्पाक सिवाय उनके जो एक या अधिक अन्य अवयवों से संयोजित है और अविभक्त सम्पाक में 2.5% से अधिक सान्द्रण सहित तथा जिसमें प्रति खुराक औषधि 100 मिलीग्राम से अधिक न हो तथा जिसे चिकित्सीय प्रक्रियाओं में स्थापित किया गया है ।
36. डाईहाइड्रोकोडाईन और एसीटिलडिहाइड्रोकोडेईन, डाईहाइड्रोकोईडीन ग के अन्य व्यूत्पन्न तथा इनके लवण जैसे , पैराकोडीन और एसिटील कोडोन और उस तरह के) सभी अवमिश्रण और सम्पाकः सिवाय उनके जो एक या अधिक अन्य अवयवों से संयोजित है और अविभक्त सम्पाक में 2.5% से अधिक सान्द्रण सहित तथा जिसमें प्रति खुराक औषधि 100 मिलीग्राम से अधिक न हो तथा जिसे चिकित्सीय प्रक्रियाओं में स्थापित किया गया है ।
37. बेटा-4- मेर्फेलिनीलीथिमोर्फाईन (होमोकोडीन , हाईबरनिल , फोलकोडीन ग तथा उस जैसे के रूप में भी जाना जाता है ) और इनके लवण , सभी अवमिश्रण तथा सम्पाक सिवाय उनके जो एक या अधिक अन्य अवयवों से संयोजित है और अविभक्त सम्पाक में 2.5% से अधिक सान्द्रण सहित तथा जिसमें प्रति खुराक औषधि 100 मिलीग्राम से अधिक न हो तथा जिसे चिकित्सीय प्रक्रियाओं में स्थापित किया गया है ।
38 . 1 , 3 -डाइमेथिल-4- फेनाईल-4-प्रोपीओनोक्सीहेक्सामेथीलेनेइमाईन, ग 8

S.O. 302 (E) . In exercise of powers conferred under Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy, 2004-2009 , the Central Government hereby amends to the ITC (HS) Classifications of Export and Import Items 2004-2009.
2. After amendment the policy of the following Exim Code will be read as under:

3. A new Import Licensing Note be inserted at the end of Chapter 29 will be as under:
" ( 2) All Narcotic drugs and psychotropic substances covered under this chapter will be subject to the following conditions:
( a) Any narcotic drug and psychotropic substance can be imported under the Special Provisions for medical and scientific purposes as per Chapter VII - A of the NDPS Rules , 1985 after obtaining an import certificate under the proviso to Rule 3 of the NDPS Rules .
(b) Imports other than category ( a ) referred to in the preceeding Paragraph will be governed by Annexure -V to Schedule 1 ( Imports ) of the ITC ( HS ) Classifications of Export and Import Items , 2004-09 . " भारत का राजपत्र असाधारण

4. A new Annexure -V is added to the Schedule I ( Imports) of the ITC ( HS ) Classifications of Export and Import Items , 2004-09 as annexed with this Notification .
