सा.का.नि. 149( अ).- केन्द्रीय सरकार, पंजाब पुनर्गठन अधिनियम, 1966 ( 1966 का 31 ) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, " पंजाब कृषि उत्पाद विपणन ( संशोधन ) अधिनियम , 2005" ( 2005 का पंजाब अधिनियम सं. 12 ) को, जैसा कि वह इस अधिसूचना की तारीख को पंजाब राज्य में प्रवृत्त है , निम्नलिखित उपांतरणों के अधीन रहते हुए चंडीगढ़ संघ राज्य क्षेत्र पर विस्तारित करती है, अर्थात्: --
उपांतरण
1. धारा 1 की उप - धारा ( 1 ) में, " पंजाब कृषि उत्पाद विपणन (संशोधन) अधिनियम, 2005 " शब्दों, कोष्ठकों और अंको के स्थान पर, " चंडीगढ़ संघ राज्य क्षेत्र पर यथा विस्तारित पंजाब कृषि उत्पाद विपणन ( संशोधन ) अधिनियम , 2005 " शब्द, कोष्ठक और अंक रखे जाएंगे ।
2. धारा 2 में,-
(i ) " पंजाब कृषि उत्पाद विपणन अधिनियम, 1961 " शब्दों और अंकों के स्थान पर, " चंडीगढ़ संघ राज्य क्षेत्र में लागू रूप में पंजाब कृषि उत्पाद विपणन अधिनियम , 1961 " शब्द और अंक रखे जाएंगे ;
(ii) खंड ( ख) में " राज्य सरकार " शब्दों के स्थान पर, " प्रशासक, चंडीगढ़ संघ राज्य क्षेत्र" शब्द और अंक रखे जाएंगे।
3. धारा 3 में " राज्य सरकार " शब्दों के स्थान पर, " प्रशासक, चंडीगढ़ संघ राज्य क्षेत्र" शब्द और अंक रखे जाएंगे ।

पंजाब कृषि उत्पाद विपणन अधिनियम , 1961 का और संशोधन करने के लिए अधिनियम
भारत गणराज्यके छप्पनवें वर्ष में पंजाब राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इस अधिनियम का संक्षिप्त नाम पंजाब कृषि उत्पाद विपणन ( संशोधन ) अधिनियम , 2005 है ।
(2) यह तत्काल प्रवृत्त होगा ।
2. 1961 के पंजाब अधिनियम 23 की धारा 2 का संशोधन:- पंजाब कृषि उत्पाद विपणन अधिनियम, 1961 (जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) की धारा 2 में,-
" (क) खंड ( 1 ) में, प्रधान विपणन यार्ड और उप-विपणन यार्ड " शब्दों के स्थान पर " प्रधान विपणन यार्ड, उप- विपणन यार्ड और प्राइवेट विपणन यार्ड " शब्द और चिह्न रखे जाएंगेः और
(ख ) खंड ( ढ़ ) के पश्चात् निम्नलिखित खंड: अन्त स्थापित किया जाएगा, अर्थात्ः -
" ( ढढ) " प्राइवेट विपणन यार्ड " से अधिसूचित विपणन क्षेत्र में प्रधान विपणन यार्ड या उप-विपणन यार्ड से भिन्न ऐसा अहाता, भवन या परिक्षेत्र अभिप्रेत है जो किसी व्यक्ति या कंपनी या सहकारी सोसाइटी के स्वामित्वाधीन है और उसके द्वारा उसका संचालन राज्य सरकार द्वारा अनुदत्त अनुज्ञप्ति केनिबंधनों और शर्तों के अनुसार किया जाता है तथाजहां, अवसंरचना का विकास यथास्थिति, ऐसे व्यक्ति या कंपनी या सहकारी सोसाइटी द्वारा किया गया है ।
स्पष्टीकरण:-इस खंड के प्रयोजन के लिए कंपनी से ऐसी कंपनी अभिप्रेत होगी जो कंपनी अधिनियम, 1956 केअधीन निगमित की गई है । " 2

ANNEXURE THE PUNJAB AGRICULTURAL PRODUCE MARKETS ( AMENDMENT) ACT, 2005 3. 1961 के पंजाब अधिनियम सं ० 23 की धारा 7 का प्रतिस्थापन:-मूल अधिनियम की धारा 7 के स्थान पर निम्नलिखित धारा रखी जाएगी , अर्थात्: -

" 7 विपणन यार्ड की घोषणा ( 1 ) प्रत्येक अधिसूचित
AnAct Further to amend the Punjab Agricultural Produce Markets Act, 1961
विपणन क्षेत्र के लिए एक प्रधान विपणन बार्ड, एक या अधिक उतने उप -विपणन यार्ड और एक या अधिक उतने प्राइवेट विपणन यार्ड होंगे जितने आवश्यक हों ।
Be it enacted by the Legislature of the State ofPunjab inthe Fifty Sixth Year of the Republic of India as follows: -
1.Short title and commencement:-( 1) This Act may be called the the Punjab Agricultural Produce Markets (Amendment) Act , 2005 .
(2) It shall come into force at once.
2. Amendment of Section 2 of Punjab Act, 23 of (2 ) राज्य सरकार, अधिसूचना द्वारा किसी अधिसूचित विपणन बार्ड में किसी अहाते , भवन या परिक्षेत्र को उस क्षेत्र के लिए प्रधान विपणन यार्ड घोषित कर सकेगी और अन्य अहातों, भवनों या परिक्षेत्रों को उस क्षेत्र के लिए एक या अधिक उप- विपणन यार्ड या एक या अधिक प्राइवेट विपणन यार्ड घोषित कर सकेगी ।
(3 ) प्राइवेट विपणन यार्ड के लिए अनुज्ञप्ति अभिप्राप्त करने का इच्छुक प्रत्येक व्यक्ति या कंपनी या सहकारी सोसाइटी ऐसे प्राधिकारी को ऐसी रीतिसे और ऐसी फीस के साथ, जो विहित की जाए, आवेदन करेगी। " ।
1961:--In the Punjab Agricultural Produce Markets Act , 1961 (hereinafter referred to as the Principal Act) , in Section 2,- "(a) in clause ( 1 ) , for the words and sign " Principal markets yard and sub - market yard " , the words and sign "principal market yard, sub - yard and private market yard, " shall be substituted; and
(b) after clause (n) , the following clause shall be inserted namely: ----
4. 1961 के पंजाब अधिनियम सं ० 23 की धारा 8 का संशोधन:-मूल अधिनियम की धारा 8 में, " को और उसके पश्चात् " शब्दोंके स्थान पर, " धारा 7 में जैसा उपबंधित है उसके सिवाय को और उसके पश्चात्" शब्द रखे जाएंगे ।

(nn) "Private market yard" means an enclosure , building or locality other than the principal market yard or sub market yard in the notified market area, owned and operated by any person or company or co - operative society in accordance with the terms and conditions of a licence, granted by the State Government and where infrastructure has been developed by such person or company or co -operative society, as the case may be;
Explanation :-For the purpose of this clause, company shall mean a company incorporated under the Cmparies Act, 1956 " .
G.S.R. 149 (E). In exercise ofthe powers conferred by Section 87 of the Punjab Reorganisation Act, 1966 (31 of 1966) , the Central Government hereby extends to the UnionTerritory of Chandigarh "The Punjab Agricultural Produce Markets (Amendment) Act , 2005 ( Punjab Act No. 12 of2005) , as in force in the State of Punjab on the date of this notification subject to the following modifications , namely:-
MODIFICATIONS
3. Substitution of Section 7 of Punjab Act 23 of 1961: In the principal Act , for Section 7 , the following section shall be substituted namely:--
1. In sub - section ( 1) of Section 1 , for the words , brackets and figures "the Punjab Agricultural Produce Markets (Amendment ) Act, 2005" , the words , brackets and figures " the Punjab Agricultural Produce Markets (Amendment) Act, 2005, as extended to the Union Territory of Chandigarh " shall be substituted.
"7. Declaration of Market Yards.-( 1 ) For each notified market area, there shall be one principal market yard, one or more sub -market yard, one or more sub -market yards and one or more private market yards as may be necessary.
2. In Section 2,--
(2) The StateGoverninent may , by notification , declare any enclosure building or locality in any notified market area to be principal market yard for the area and other enclosures , buildings or localities to be one or more sub- market yards or one or more private market yards for thearea.
(1) for the words and figures " the Punjab Agricultural Produce Markets Act , 1961 " , the words and figures "the Punjab Agricultural Produce Markets Act , 1961 , as applicable in the Union Territory of Chandigarh " shall be substituted;
(ii) in clause (b) , the words " State Government " the words "Administrator , Union Territory of Chandigarh " shall be substituted.
(3) Every person or company or co - operative society, as the case may be , desiring to obtain a licence for the private market yard, shall apply to such authority , in such manner and with such fee , as may be prescribed" .
3.In Section 3 , for the words " State Government " the words "Administrator , Union Territory of Chandigarh " shall be substituted.
4. Amendment in Section 8 of Punjab Act 23 of 1961: In the principal Act , in Section 8 , for the words "On and after" , the words " Save as otherwise provided in Section 7, on and after " shall be substituted.
