का.आ. 304(अ).-केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्यांक का.आ. 78 ( अ ) तारीख 4 फरवरी, 1999, द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं. 4 के 592.000 कि. मी. से 834.000 कि. मी. ( कर्नाटक/महाराष्ट्र सीमा से पुणे सेक्शन ) और 0.000 कि.मी. से 143.000 कि.मी. ( पूणे से थाने सेक्शन ) तक के भूखंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था;
अतः , अब , केन्द्रीय सरकार, राष्ट्रीय राजमार्ग (राष्ट्रीय राजमार्ग सेक्शन और स्थायी पुल-लोक वित्तपोषित परियोजना के उपयोग के लिए फीस ) नियम, 1997 के नियम 3, नियम 5 और नियम 11 और राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के नियम 3 के उपनियम (2) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह अधिसूचित करती है कि महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्या 4 के 781.00 कि.मी. से 825.500 कि.मी. (44.50 कि.मी. लम्बाई सहित खण्डला सारोल कटराज सेक्शन) , 825.500 कि.मी. से 834.000 कि.मी. (10.07 कि.मी. की लम्बाई सहित कटराज पुनः संरेखण जो कि 825.500 कि.मी. से प्रारम्भ होकर पश्चिमाभिमुख विपथन के 30.00 कि.मी. पर समाप्त होता है) , और पश्चिमाभिमुख विपथन के 30.00 कि.मी. से 2.80 कि.मी. (जो कि 27.200 कि.मी. की कुल लंबाई सहित कटराज पुनः संरेखण से प्रारम्भ होकर पुणे मुम्बई एक्सप्रेसवे पर समाप्त होता है) , तक के चार लेन वाले भूखंड के उपयोग के लिए याँत्रिक यानों पर फीस भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय तौर पर या प्रतिस्पर्द्धात्मक निविदा के आधार पर जो नियुक्त किए जा सकेंगे प्राइवेट ठेकेदार के माध्यम से, इससे संलग्न अनुसूची में विनिर्दिष्ट दरों पर शाश्वत आधार पर उद्गृहीत और संगृहीत की जाएगी । फीस का संग्रहण इस अधिसूचना के राजपत्र में प्रकाशित होने

की तारीख से तीस दिन के भीतर या उक्त चार लेन के भूखंड को यातायात के लिए खोले जाने की तारीख से तीस दिनों के भीतर इनमें से जो भी पश्चातवर्ती हो , प्रारम्भ किया जाएगा । फीस की दरें राष्ट्रीय राजमार्ग (फीस की दर) नियम , 1997 नियम 3 के उपनियम (3 ) के उपबंधों के अनुसार पुनरीक्षण के अध्यधीन है ।

महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्या 4 के 781.00 कि.मी. से 825.500 कि.मी. (44.50 कि.मी. लम्बाई सहित खण्डला सारोल कटराज सेक्शन) , 825.500 कि.मी. से 834.000 कि.मी. (कटराज पुनः संरेखण जो कि 10.07 कि.मी. लम्बाई सहित 825.500 कि.मी. से प्रारम्भ होकर पश्चिमाभिमुख विपथन के 30.00 कि.मी. पर समाप्त होता है) , और पश्चिमाभिमुख विपथन के 30.00 कि.मी. से 2.80 कि.मी. (जो कि 27.200 कि.मी. लम्बाई सहित कटराज पुनः संरेखण से प्रारम्भ होकर पुणे मुम्बई एक्सप्रेसवे पर समाप्त होता है) , तक के चार लेन के भूखंड के उपयोक्ताओं से वसूल की जाने वाली फीस की दरेंः
यह फीस भूखंड़ के भीतर केवल एक स्थान पर ही संगृहीत की जाएगी ।

1. जब उसी यांत्रिक यान को राष्ट्रीय राजमार्ग के उक्त भूखंड को एक दिन में एक से अधिक बार पार करना हो तो उपयोक्ता के पास यह विकल्प होगा कि वह पहली बार ही द्वार पार करते समय ऊपर अनुसूची में दी गई दरों पर अनेक बार चक्करों के लिए फीस का संदाय कर दे या यदि उसी यांत्रिकी यान को पूरे मास में उक्त चार लेन के भूखंड का उपयोग बार बार करना पड़ता है तो यान का स्वामी पूर्वोक्त अनुसूची में यथा विनिर्दिष्ट उसको लागू 30 एकल दरों के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
स्पष्टीकरण:- इस अधिसूचना के प्रयोजन के लिए " दिन " की गिनती चौबीस घंटे की निरंतर अवधि के रूप में की जाएगी ।

2. निम्नलिखित प्रकार के यानों को अनुसूची में ऊपर विनिर्दिष्ट फीस से छूट प्राप्त होगी अर्थातः-
(i) यान -
(अ) जो सरकारी तौर पर निम्नलिखित के हैं: -
(क) भारत के राष्ट्रपति;
(ख) भारत के उपराष्ट्रपतिः
(ग) राज्य के राज्यपाल या संघ राज्य क्षेत्र के उपराज्यपाल;
(घ) भारत के शासकीय दौरे पर उच्चपदस्थ विदेशी व्यक्ति;
(ड) " सी डी" / " सी सी " नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद के सभापति या राज्य विधान सभा के अध्यक्ष या संध या राज्य के मंत्री या लोक सभा या राज्य सभा या राज्य विधानमंडलों में विरोधी दल के नेता, जिनका दर्जा कैबिनेट मंत्री का हो , यदि, वे स्वयं यान में हों ; या
(छ) संसद सदस्य, संपूर्ण देश में या अपने- अपने राज्य में राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद के सदस्य, यदि, वह, यथास्थिति, संसद या राज्य के संबंधित विधान मंडल, द्वारा जारी पहचान पत्र प्रस्तुत करते हैं;
(आ) शौर्य पुरस्कारों , जैसे परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र का विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यंक रूप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता है ।
(ii) रक्षा यान, पुलिस यान, अग्नि शमन यान, एम्बुलेंस , अन्त्येष्टि यान, डाक और तार विभाग के यान, केंद्रीय सरकार और राज्य सरकार के कर्तव्यारूढ़ यान ।
3. फीस की दरें फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम, पता और टेलीफोन नंबर, जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए , पथकर चौकी से 500 मीटर पीछे, पथकर चौकी से 100 मीटर आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित की जाएगी । संप्रदर्शन बोर्ड की उंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना आसान हो, और ये अंग्रेजी, हिंदी और उस क्षेत्र जिसमें उक्त भूखंड अवस्थित है, की प्रादेशिक भाषा में स्पष्ट रूप से लिखे अथवा मुद्रित किए जाएंगें ।
4.
वाहन के प्रकार में निम्नलिखित सम्मिलित होगें : -
(i) अनुसूची के क्रम संख्या 2 की दशा में "मिनी बसें" और
(1) अनुसूची के क्रम संख्या 3 की दशा में ऐसे "बहुधुरी वाले यान " जो उक्त अनुसूची की क्रम संख्या 4 में सम्मिलित नहीं हैं ।

5 . किसी ऐसे यांत्रिक यान से फीस उदगृहीत और संगृहीत नहीं की जाएगी जो उक्त अनुसूची में सम्मिलित नहीं हैं ।

NOTIFICATION
New Delhi , the 8th March , 2006
S.O. 304 (E) . Whereas , vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , No. S.O. 78 (E) dated the 4th February, 1999 issued under Section 11. ofthe National Highways Authority of India Act , 1988 (68 of 1988) , the Central Government entrusted the stretches from Km 592.000 to Km 834.000 ( Karnataka/ Maharashtra Border to Pune section) and Km 0.000 to Km 143.000 ( Pune to Thane section) of National Highway No. 4 in the State of Maharashtra to the National Highways Authority of India;
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956) , read with rules 3 , 5 and 11 of the National Highways (Fees for the Use of National Highways Section and Permanent Bridge Public Funded Project ) Rules , 1997 and sub- rule (2) of rule 3 of the National Highways (Rate of Fee) Rules , 1997 , the Central Government hereby notifies that there shall be levied and collected by the National Highways Authority of India departmentally or through private contractor who may be appointed on the basis of competitive bidding , a fee on mechanical vehicles for the use of the four - laned stretches from Km . 781.00 to Km 825.500 ( Khandala - Sarole - Katraj Section with a length of 44.50 Km) , Km 825.500 to KM 834.000 (Katraj realignment taking off from Km 825.500 and ending at Km 30.00 of Westerly Diversion with a length of 10.07 Km) and Km 30.000 to Km 2.800 of westerly diversion (taking off from Katraj realignment and ending at Pune Mumbai expressway with a total length of 27.200 Km) of National Highway No. 4 in the State of Maharashtra at the rates specified in the Schedule annexed hereto in perpetuity. The collection of fee shall commence within thirty days from the date of publication of this notification in the Official Gazette or within thirty days from the date of opening of the said four - laned stretches to traffic , whichever is later. The rates of fee are subject to revision as per the provisions of sub- rule (3 ) of rule 3 of the National Highways (Rate of Fee ) Rules , 1997.

RATES OF FEE TO BE RECOVERED FROM THE USERS OF FOUR - LANED STRETCHES FROM KM . 781.00 ΤΟ ΚΜ 825.500 ( KHANDALA - SAROLE - KATRAJ SECTION WITH A LENGTH OF 44.50 KM) , KM 825.500 ΤΟ KM 834.000 ( KATRAJ REALIGNMENT TAKING OFF FROM KM 825.500 AND ENDING AT KM 30.00 OF WESTERLY DIVERSION WITH A LENGTH OF 10.07 KM) AND KM 30.000 TO KM 2.800 OF WESTERLY DIVERSION ( TAKING OFF FROM KATRAJ REALIGNMENT AND ENDING AT PUNE MUMBAI EXPRESSWAY WITH A TOTAL LENGTH OF 27.200 KM) OF NATIONAL HIGHWAY NO . 4 IN THE STATE OF MAHARASHTRA .
The fee shall be collected at single location only within the stretch .

Note :-
1. When the same mechanical vehicle has to cross the said stretch of the National Highway more than once in a day , the user shall have the option to pay the fee for the multiple trips at the rates as given in the Schedule above while crossing the gate in the first trip itself or if the same mechanical vehicle has to use the said four- laned stretches frequently for the entire month , the vehicle owner may obtain a monthly pass on the payment of charges equivalent to 30 single rates applicable to it, as specified in the aforesaid Schedule .
Explanation : - For the purpose of this notification , " day " shall be counted as a continuous period of twenty - four hours .

2. The following types of vehicles shall be exempted from the fee specified above in the Schedule , namely : -
(i) vehicles , -
(A) officially belonging to
(a) the President of India ;
(b ) the Vice President of India;
(c) the Governor of a State or the Lt. Governor of a Union Territory ;
(d) a Foreign Dignitary on State visit to India ;
(e) a Foreign Diplomat stationed in India using cars with "CD " / " CC" number plates ;
(f) the Chairman of Rajya Sabha or the Speaker of Lok Sabha or the Chairman of a State Legislative Council or the Speaker of a State Legislative Assembly or a Minister for the Union or State , or Leader of Opposition in Lok Sabha or Rajya Sabha or a State Legislature having the status of Cabinet Minister, if he is sitting in the vehicle ; or
(g) a Member of Parliament, in the entire country , or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective State , if he produces his identity card issued by the Parliament or the concerned Legislature of the State , as the case may be ;
(B) belonging to the winner of a Gallantry award such as Param Vir Chakra , Ashok Chakra, Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award;
:
( ii ) Defence vehicles , Police vehicles , Fire - fighting vehicles , Ambulances , Funeral vans , Post and Telegraphs Departments vehicles and Central Government and State Government vehicles on duty.
3. The rates of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of the authority to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also, the height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English, Hindi and the regional language of the area in which the stretch is situated.

4. The type of vehicle shall include , -
(i) in case of S. No. 2 of the Schedule , "Mini Buses " ; and
(ii) in case of S. No. 3 of the Schedule , " Multi Axle vehicle " , not covered by S No. 4 of the said Schedule.
5. No fee shall be levied and collected from a mechanical vehicle , which is not covered by the said Schedule .
