सा.का.नि. 153( अ ) .-जबकि, अभिहित प्राधिकारी ने, चीन जनवादी गणराज्य में उत्पादित या वहां से आयातित, सीमाशुल्क टैरिफ अधिनियम 1975 ( 1975 का 51 ) की पहली अनुसूची के अध्याय 28 के अंतर्गत आने वाले सोडियम हाइड्रोसल्फाइट पर भारत सरकार के वित्त मंत्रालय (राजस्व विभाग ) अधिसूचना सं. 114/2001- सीमाशुल्क, तारीख 2 नवम्बर, 2001 [सा०का०नि० 820 (अ) , तारीख 2 नवम्बर, 2001 ] द्वारा अधिरोपित प्रतिपाटन शुल्क के जारी रहने के संबंध में , भारत के राजपत्र, असाधारण, भाग 1 , खंड 1 , तारीख 5 अक्तूबर, 2005 में प्रकाशित अधिसूचना सं. 15/16/2005-डीजीएडी द्वारा निर्णायक समीक्षा प्रारंभ की है तथा निर्णायक समीक्षा के परिणामों के लम्बित रहने तक, अधिरोपित प्रतिपाटन शुल्क की अवधि बढानें का अनुरोध किया है
अतः अब केन्द्रीय सरकार सीमाशुल्क टैरिफ अधिनियम 1975 ( 1975 का 51 ) की धारा 9 क की उपधारा ( 1 ) के साथ पठित उपधारा (5) के दूसरे परंतुक एवं उपधारा (6) और सीमाशुल्क टैरिफ (पाटित्त वस्तुओं की पहचान, उस पर प्रतिपाटन शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण) नियम, 1995 के नियम 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 114/2001-सोमाशुल्क, तारीख 2 नवम्बर, 2001 में निम्नलिखित संशोधन करती है, अर्थातः-
2. अर्थातः- उक्त अधिसूचना में, पैराग्राफ 2 के पश्चात, निम्नलिखित पैराग्राफ अंतः स्थापित किया जायेगा,
८८ 3. इस अधिसूचना के अधीन अधिरोपित प्रतिपाटन शुल्क 11 मार्च 2007 तक, प्रभावी रहेगी जिसमें यह तारीख भी शामिल है, और भारतीय करेंसी में संदत्त होगा। "

No. 25/2006 - CUSTOMS
G.S.R. 153 (E ). Whereas , the designated authority vide notification No.15/16/2005- DGAD, published in Part I , Section I of the Gazette of India, Extraordinary, dated the 5th October, 2005, has initiated sunset review in the matter of continuation of anti -dumping duty on Sodium Hydrosulphite falling under Chapter 28 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975 ) , originating in or exported from China PR, imposed vide notification No. 114/2001 -Customs , dated the 2nd November , 2001 , [G.S.R.820 (E) , dated the2nd November , 2001 ] and has requested for extension of anti -dumping duty, for a further period of one year pending the results of the review investigations ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) , read with Sub- section (5) ofsection 9A of the said Customs Tariff Act and Rule 23 of the Customs Tariff (Identification , Assessment and Collection of Anti - dumping Duty on Dumped Articles and for Determination of Injury ) Rules , 1995, the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue ) No. 114/2001 -Customs , dated the 2nd November 2001 , namely:-
In the said notification, after Paragraph 2 , the following Paragraph shall be inserted , namely; -
" 3. The anti - dumping duty imposed under this notification shall be effective up to and inclusive of the 11th day of March , 2007 , and shall be paid in Indian currency."

सा.का.नि. 154( अ ) . जबकि, अभिहित प्राधिकारी ने, चीन जनवादी गणराज्य में उतपादित या वहाँ से निर्यातित, सीमाशुल्क टैरिफ अधिनियम 1975 ( 1975 का 51 ) की पहली अनुसूची के उपशीर्ष 2841 61 के अंतर्गत आने वाले पोटेसियम परमैगनेट पर प्रतिपाटन शुल्क जारी रखने के संबंध में, जो कि भारत सरकार के वित्त मंत्रालय (राजस्व विभाग ) की अधिसूचना सं. 113/2001- सीमाशुल्क, तारीख 1 नवम्बर, 2001 [ सा० का०नि० 815 (अ) , तारीख 1 नवम्बर, 2001 ] , भारत के राजपत्र, असाधारण, भाग II, खंड 3 , तारीख 1 नवम्बर, 2001 में प्रकाशित द्वारा अधिरोपित किया गया था और जिसका भारत सरकार के वित्त मंत्रालय (राजस्व विभाग ) की अधिसूचना सं . 85/2003- सीमाशुल्क, तारीख 27 मई, 2003 [सा०का०नि० 436 (अ ) , तारीख 27 मई, 2003 ] द्वारा अतिक्रमण किया गया था और पुनः जिसका, भारत के राजपत्र, असाधारण, भाग II, खंड 3, तारीख 14 सितम्बर, 2005 में प्रकाशित अधिसूचना सं. 82/ 2005- सीमाशुल्क, तारीख 14 सितम्बर, 2005 [साका०नि० 585 (अ) , तारीख 14 सितम्बर, 2005] द्वारा अतिक्रमण किया गया था, भारत के राजपत्र , भारत का राजपत्र असाधारण

असाधारण, भाग I, खंड 1 तारीख 3 मार्च, 2006 में प्रकाशित अधिसूचना सं. 15/5/2006-डीजीएडी द्वारा निर्णायक समीक्षा प्रारंभ की है तथा निर्णायक समीक्षा के परिणामों के लम्बित रहने तक , अधिरोपित प्रतिपाटन शुल्क की अवधि समय सीमा एक वर्ष और बढ़ाने का अनुरोध किया है;
अतः अब केन्द्रीय सरकार सीमाशुल्क टैरिफ अधिनियम 1975 ( 1975 का 51 ) की धारा 9 क की उपधारा ( 1 ) के साथ पठित उपधारा (5) और सीमाशुल्क टैरिफ (पाटित वस्तुओं की पहचान, उस पर प्रतिपाटन शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण) नियम, 1995 के नियम 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 82/2005-सीमाशुल्क, तारीख 14 सितम्बर, 2005 में निम्नलिखित संशोधन करती है, अर्थातः-
उक्त अधिसूचना में, पैराग्राफ 2 के स्थान पर, निम्नलिखित पैराग्राफ प्रतिस्थापित किया जायेगा, अर्थात
" 2. इस अधिसूचना द्वारा अधिरोपित प्रतिपाटन शुल्क 11 मार्च, 2007 तक, जिसमें यह तारीख भी शामिल है, प्रभावी रहेगा और भारतीय करेंसी में संदेय होगा ।"

G.S.R. 154(E).-Whereas, the designated authority vide notification No. 15/5/2006- DGAD, published in Part I, Section I ofthe Gazette of India, Extraordinary, dated the 3rd March, 2006 , has initiated sunset review in the matter of continuation of anti- dumping duty on Potassium Permanganate falling under sub - heading 2841 61of the First Schedule to the Customs tariffAct 1975 , (51 of 1975) originating in or exported from Peoples Republic of China, imposed vide notification No. 113/2001 dated 1 * November , 2001 , [G.S.R. 815 (E), dated the 1st November , 2001 ] , published in Part II , Section 3 , Sub-section ( i ) of the Gazette of India, Extraordinary , dated the 1st November , 2001 , superseded by Notification No. 85/2003 -Customs dated the 27th May, 2003 , [G.S.R. 436(E), dated the 27th May, 2003 ] , published in Part II , Section 3 , Sub -section ( i ) of the Gazette of India , Extraordinary, dated the 27th May , 2003 , subsequently superseded by Notification No. 82/2005 -Customs dated the 14th September , 2005 , [G.S.R. 585(E), dated the 14th September , 2005 ] , published in Part II , Section 3 , Sub- section ( i) of the Gazette of India, Extraordinary, dated the 14th September, 2005 , and has requested for extension of anti -dumping duty, for a further period of one year pending the results of the review investigations ;

" 2. The anti - dumping duty imposed under this notification shall be effective up to and inclusive of the 11th day of March, 2007, and shall be paid in Indian currency. "
