सं. 24/2006-केन्द्रीय उत्पाद शुल्क
सा.का.नि. 161 ( अ ) -केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 ( 1944 का 1 ) की धारा 5क की उप धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह समाधान हो जाने पर कि ऐसा करना लोकहित में आवश्यक है , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना संख्या 3/2006 केन्द्रीय उत्पाद शुल्क, तारीख 1 मार्च, 2006, सं. सा.का.नि. 93 ( अ ) , तारीख 1 मार्च, 2006 में निम्नलिखित संशोधन करती है , अर्थात्: --
उक्त अधिसूचना में,-
( i ) सारणी में, क्रम सं. 40 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टि अंतःस्थापित की जायेंगी , अर्थात्:-

कुछ नहीं 1 " एकक आद्यानों में रखी गई खाद्य विनिर्मितियां, केन्द्रीय सरकार या किसी राज्य सरकार द्वारा सम्यक रूप से अनुमोदित किसी कार्यक्रम के अधीन समाज के आर्थिक रूप से कमजोर वर्गों को निःशुल्क वितरण के लिए आशयित
( ii ) स्पष्टीकरण के पश्चात्, निम्नलिखित उपाबंध अंतः स्थापित किया जायेगा , अर्थात्:-

1. यदि खाद्य विनिर्मितियों का विनिर्माता , किसी ऐसे अधिकारी से जो भारत सरकार के उप सचिव की पंक्ति से अभिन्न न हो या संबद्ध राज्यके उप सचिव की पंक्तिके नीचे का न हो, इस आशय का प्रमाण पत्र प्रस्तुत करता है कि ऐसी खाद्य विनिर्मितियों का मुफ्त वितरण केन्द्रीय सरकार या संबद्ध राज्य सरकार द्वारा सम्यक रूप से अनुमोदित कार्यक्रम के अधीन समाज के आर्थिक रूप से कमजोर वर्गों को ऐसे माल की निकासी की तारीख से 5 मास के भीतर या ऐसी बढ़ाई गई अवधि के भीतर, जो अधिकारिता रखने वाला, यथास्थिति, उप केन्द्रीय उत्पाद शुल्क आयुक्त या सहायक केन्द्रीय उत्पाद शुल्क आयुक्त इस संबंध में अनुज्ञात करें कि उक्त विनिर्मितियों का निःशुल्कवितरण कर दिया गया है । "

NOTIFICATION
New Delhi , the 16th March, 2006
No. 24/ 2006 - Central Excise
G.S.R. 161 (E ) .- In exercise of the powers conferred by sub -section ( 1 ) of Section 5A ofthe Central Excise Act , 1944 ( 1 of 1944) , the Central Government , being satisfied that it is necessary in the public interest so todo , hereby makes the following amendments in the notification of the Government of India, in the Ministry of Finance ( Department of Revenue ) , No. 3 /2006- Central Excise, dated the 1st March , 2006 , number G.S.R. 93 ( E) , dated the 1st March , 2006 , namely :--
In the said notification ,--
(i) in Table, after S. No. 40 and entries relating thereto , the following entry shall be inserted, namely :-

1" "41. 1901 Food preparations put up in unit containers and intended for free distribution toeconomically weaker sections of the society under a programme duly approved by the Central Government or any State Government .
( ii) after the Explanation , the following Annexure, shall be inserted , namely:---

Condition No.
1.
Ifthe inanufacturer of the food preparations produces a certificate from an officer not below the rank of the Deputy Secretary to the Government of India or not below the rank of the Deputy Secretary to the State Government concerned to the effect that such food preparations have been distributed free to the economically weaker sections of the society under a programme duly approved by the Central Government or the State Government concerned , within five months from the date of clearance of such goods or within such further period as the Deputy Commissioner of Central Excise or the Assistant Commissioner of Central Excise, as the case may be , having jurisdiction may allow in this regard . "
