सा.का.नि. 164(अ).- केन्द्रीय सरकार, रुग्ण औद्योगिक कंपनी ( विशेष उपबंध ) अधिनियम, 1985 ( 1986 का 1 ) की धारा 36 की उप- धारा ( 2 ) के खंड ( क ) के साथ पठित उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए औद्योगिक और वित्तीय पुनर्निर्माण अपीलीय प्राधिकरण ( अध्यक्ष और अन्य सदस्यों के वेतन और भत्ते तथा सेवा शर्तें ) नियम, 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम औद्योगिक और वित्तीय पुनर्निर्माण अपीलीय प्राधिकरण ( अध्यक्ष और अन्य सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें ) संशोधन नियम , 2006 है ।

(2) ये नियम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. वित्तीय पुनर्निर्माण अपीलीय प्राधिकरण ( अध्यक्ष और अन्य सदस्यों के वेतन और भत्ते तथा सेवा शर्तें ) नियम , 1987 के नियम 10 में, उप-नियम ( 6 ) के पश्चात् निम्नलिखित उप - नियम अन्तःस्थापित किया जाएगा, अर्थात्:-

" ( 7 ) अध्यक्ष या कोई सदस्य जो सरकारी निवास नहीं प्राप्त करते हैं और प्राईवेट निवास में वास करते हैं, वह अपने निवास में उपभोग किए गए जल और विद्युत के मुद्दे प्रभारों की प्रतिपूर्ति के हकदार होंगे , जो कि बारह हजार रुपए वार्षिक से अधिक नहीं होगी। "

NOTIFICATION

New Delhi , the 13th March, 2006

G.S.R. 164 (E) .-In exercise of the powers conferred by Sub - section ( 1) read with clause (a) of Sub- section (2) of Section 36 of the Sick Industrial Companies ( Special Provisions ) Act, 1985 ( 1 of 1986) , the Central Government hereby makes the following rules , further to amend the Appellate Authority for Industrial and Financial Reconstruction (Salaries andAllowances and Conditions of Service of Chairman and Other Members ) Rules , 1987, namely :-

1. (1) These rules may be called the Appellate Authority for Industrial and Financial Reconstruction (Salaries and Allowances and Conditions of Service of Chairman and Other Members ) Amendment Rules , 2006 .

(2) These rules shall come into force on the date of their publication in the Official Gazette .

2. In rule 10 of the Appellate Authority for Industrial and Financial Reconstruction (Salaries and Allowances and Conditions of Service of Chairman and other Members ) Rules , 1987, after Sub - rule (6 ) , the following sub - rule shall be inserted, namely:-

" (7) The Chairman or Member, who do not avail the Government accommodation and resides at private residence, shall be entitled to reimbursement of charges on account of water and electricity consumed at his residence not exceeding rupees twelve thousand per annum . "
