सा.का.नि. 165(अ) .-केन्द्रीय सरकार, रेल अधिनियम, 1989 ( 1989 का 24 ) की धारा 60 की उप - धारा ( 1 ) और उप- धारा ( 2 ) के खंड (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रेल यात्री ( टिकट रद्दकरण और किराए का प्रतिदाय ) नियम, 1998 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम रेल यात्री ( टिकट रद्दकरण और किराए का प्रतिदाय ) संशोधन नियम , 2006 है .
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे.
2. रेल यात्री ( टिकट रद्दकरण और किराए का प्रतिदाय ) नियम , 1998 में, -
(1) नियम 9 के स्थान पर , निम्नलिखित नियम रखा जाएगा, अर्थात्:-
" 9. किसी आरक्षित, आर.ए.सी. या प्रतीक्षा सूचीबद्ध टिकट पर यात्रा स्थगित करना या यात्रा पहले करना -
(1) यात्रा स्थगित करनाः
( क) पुष्टिकृत टिकटें : पुष्टिकृत_टिकटों पर, उसी या किसी उच्चतर श्रेणी में, उसी दिन किसी पश्चात्वर्ती गाड़ी में या अगले किसी दिन , उसी गतव्य स्थान या उससे आगे के किसी गंतव्य स्थान के लिए , यात्रा स्थगित करने की अनुमति दी जाएगी , परन्तु यह तब जब कि:

(i) जिस गाड़ी में नया आरक्षण मांगा गया है उसमें पुष्टिकृत या आर.ए.सी. या प्रतीक्षा सूचीबद्ध स्थान उपलब्ध हो;
(ii) कार्य घंटों के दौरान और उस गाड़ी , जिसमें टिकट मूल रूप से बुक किया गया है , के निर्धारित प्रस्थान समय से कम से कम 24 घंटे पहले टिकट अभ्यर्पित किए जाने पर , उस श्रेणी जिसके लिए आरक्षण मांगा गया है, के लिए नई आरक्षण फ़ीस संदत्त की गई हो;
(iii) कार्य घंटों के दौरान तथा उस गाड़ी, जिसमें टिकट मूल रूप से बुक किया गया है , के निर्धारित प्रस्थान समय से 24 घंटे तथा 4 घंटे पहले के बीच टिकट अभ्यर्पित किए जाने पर , रद्दकरण प्रभार के रूप में पहले से बुक किए गए टिकट के 25% किराए का संदाय किया गया हो;
(iv) कार्य घंटों के दौरान तथा उस गाड़ी , जिसमें टिकट मूल रूप से बुक किया गया है, के निर्धारित प्रस्थान समय से 4 घंटे पूर्व तथा उस गाड़ी के वास्तविक प्रस्थान के बाद नियम 6 (ⅰ ) ( ग ) में उल्लिखित अधिकतम समय सीमा ( अर्थात 3/6/12 घंटे , जो दूरी पर निर्भर करेगा) के बीच टिकटें अभ्यर्पित किए जाने पर, रद्दकरण प्रभार के रूप में पहले से बुक किए गए टिकट के 50% किराए का संदाय किया गया हो;
(ख) आर.ए.सी. तथा प्रतीक्षा सूचीबद्ध टिकटेंः आर.ए.सी. तथा प्रतीक्षा सूचीबद्ध टिकटों पर उसी या उससे उच्चतर श्रेणी में, उसी दिन किसी पश्चात्वर्ती गाड़ी में या किसी पश्चात्वर्ती दिन की गाड़ी में, उसी गंतव्य स्थान या उससे अधिक दूरी वाले गंतव्य स्थानों के लिए , यात्रा स्थगित करने की अनुमति दी जाएगी परन्तु यह तब जब कि: -
(i) जिस गाड़ी में नया आरक्षण मांगा गया है उसमें पुष्टिकृत या आर.ए.सी. या प्रतीक्षा सूचीबद्ध स्थान उपलब्ध हो;
(ii ) टिकट , कार्य घंटों के दौरान तथा उस गाड़ी , जिसमें टिकट मूल रूप से बुक किया गया है , के वास्तविक प्रस्थान के बाद नियम 6 (i ) ( ग ) में उल्लिखित अधिकतम समय- सीमा ( अर्थात 3/6/12 घंटे , जो कि दूरी पर निर्भर करेगा) तक अभ्यर्पित किया गया हो.
(iii ) लिपिकीय प्रभार का भुगतान किया गया हो.
(2) यात्रा का पहले किया जाना : पुष्टिकृत , आर.ए.सी. तथा प्रतीक्षा सूचीबद्ध टिकटों पर , उसी या उससे उच्चतर श्रेणी में, उसी दिन किसी पूर्ववर्ती गाड़ी या उससे किसी पहले दिन चलने वाली गाड़ी में, उसी गंतव्य स्थान या उससे आगे के गंतव्य स्थान के लिए , यात्रा की तारीख को पहले करने की अनुमति दी जाएगी , परन्तु यह तब जब किः-
(क) जिस गाड़ी में नया आरक्षण मांगा गया है , उसमें पुष्टिकृत या आर.ए.सी. या प्रतीक्षा सूचीबद्ध स्थान उपलब्ध हो;

(ख) आरक्षण कार्यालय के कार्य घंटों के दौरान , तथा उस गाड़ी जिसमें आरक्षण मांगा गया है के निर्धारित प्रस्थान से कम से कम 6 घंटे पहले या आरक्षण चार्ट तैयार होने से पहले, जो भी पश्चातवर्ती हो, टिकट अभ्यर्पित किया गया हो;
(ग) पुष्टिकृत टिकटों पर यात्रा पहले करने की दशा में , उस श्रेणी जिसमें आरक्षण मांगा गया है के लिए नए आरक्षण फ़ीस का भुगतान किया गया हो; तथा
(घ) आर.ए.सी. तथा प्रतीक्षा सूचीबद्ध टिकटों पर यात्रा पहले करने की दशा में, लिपिकीय प्रभार का संदाय किया गया हो;
(3) यदि मूल रूप से बुक की गई यात्रा के किराए तथा संशोधित यात्रा के किराए में कोई अंतर होता है तो उपर्युक्त नियम 9 उपनियम ( 1 ) और उपनियम (2) के उपबंधों के अध्यधीन किराए के अंतर का यथास्थिती प्रतिदाय या उसकी वसूली की जाएगी, जैसा भी मामला हो ..
(4) उपर्युक्त उप- नियम ( 1 ) और ( 2 ) के अधीन यात्रा स्थगित करना या यात्रा पहले करना केवल एक बार ही अनुज्ञात किया जाएगा .
(5) सामान्य गाड़ी टिकट यात्रा स्थगित/ पहले करने पर , तत्काल प्रभारों का भुगतान करने पर भी तत्काल कोटा के लिए लागू नहीं होंगे .
(6) यदि वह टिकट, जिस पर यात्रा में उपर्युक्त उप- नियमों ( 1 ) या ( 2 ) के अधीन फेर फार किया गया है , रद्द की जाती है तो रद्दकरण प्रभारों का संदाय निम्नानुसार किया जाएगाः-
(क) यात्रा स्थगित या पहले करते समय मूल आरक्षण के लिए टिकट रद्द करने पर जो रद्दकरण प्रभार संदेय हो , और
(ख) परिवर्तित आरक्षण टिकट को नया आरक्षण मानते हुए जो रद्दकरण प्रभार देय हैं.
(ग) उन दशाओं में , जहां यात्रा में उपांतरम करते समय 25% या 50% रद्दकरण प्रभार वसूल किया गया था, ( क) में उल्लिखित रद्दकरण प्रभार पुनः वसूल नहीं किए जाएंगे और केवल (ख ) में उल्लिखित रद्दकरण प्रभार वसूल किए जाएंगे .
नियम 17 के, उप- नियम (4) में, -
(II )
(1) जाएगा; और पैरा (ii) की अंतर्वस्तु का विलय उप - नियम (4) के पैरा (i ) के अन्त में किया
(ii) निम्नलिखित पैरा को पैरा (ii) में अंतःस्थापित किया जाएगा , - THE GAZETTE OF INDIA : EXTRAORDINARY

"खोए/ न मिल रहे आरक्षित/आर.ए.सी. टिकटों के बदले , आरक्षण चार्ट तैयार होने से पहले जारी किए गए दूसरे टिकट पर, उप नियम (3 ) (ⅰ) के अधीन लिया गया 10 % या 25% किराया , प्रति यात्री सामान्य लिपिकीय प्रभार काट कर , यात्रा समाप्त होने पर गंतव्य स्टेशन पर पी.आर.एस. केंद्र से , प्रतिदेय होगा . प्रतिदाय , पी.आर.एस. से यह सत्यापन करने के पश्चात कि किसी ने संबन्धित खोए/न मिल रहे टिकट पर प्रतिदाय नहीं लिया है , किया जाएगा. गाड़ी पहुंचनें के 3 दिनों तक, आरक्षण कार्यालय के कार्य- घन्टों के दौरान, दूसरा टिकट प्रस्तुत करने पर, प्रतिदाय स्वीकार्य होगा. "
(III) नियम 4 में " स्टेशन मास्टर अनारक्षित, प्रतीक्षा सूचीबद्ध के रद्दकरण के लिए 10 रुपये प्रतियात्री लिपिक प्रभार पर निम्नलिखित रखा जाएगा : और रद्द आरक्षण (आर.ए.सी. ) टिकटों उदगृहीत कर सकेगा . " शब्दों के स्थान
"स्टेशन मास्टर अनारक्षित या आर.ए.सी. या प्रतीक्षा सूचीबद्ध टिकटों के रद्दकरण पर 20 रुपये प्रति यात्री लिपिकीय प्रभार के रुप में उदगृहीत करेगा , सिवाय दूसरी श्रेणी के अनारक्षित टिकटों के जहां 10 रुपये प्रति यात्री ही लिए जाएंगे ."
(IV) नियम 6 के उपनियम ( 1 ) के खंड ( क) में (i ) " पचास रुपए " के स्थान पर " सत्तर रुपए " , (ii) " तीस रुपए " के स्थान पर " साठ रुपए" , (iii ) " बीस रुपए " के स्थान पर " चालीस रुपए " और ( iv) " दस रुपए" के स्थान पर " बीस रुपए " शब्द रखे जाएंगे.

NOTIFICATION
New Delhi , the 20th March , 2006
G.S.R. 165 (E ) .--- In exercise of the powers conferred by sub - section ( 1 ) of Section 60 of the Railways Act , 1989 ( 24 of 1989) , the Central Government hereby makes the following rules further to amend the Railway Passengers (cancellation of ticket and refund of fare) Rules, 1998 , namely
1. (1) These rules may be called Railway Passengers (Cancellation of Ticket and Refund of Fare) fifth Amendment Rules , 2006.
(2) They shall come into force on the date of their publication in the official Gazette.

2. 1998, - In the Railway Passengers ( cancellation of ticket and refund of fare) Rules ,
(1) for rule 9, the following rules shall be substituted , namely: -
"9. Postponement or preponement of journey on a reserved , RAC or waitlisted ticket-
(1) Postponement of journey:
(a) Confirmed Tickets: Postponement of journey on confirmed tickets shall be allowed in the same or any higher class , by any subsequent train on the same day or any subsequent day, for same or any longer destination , provided that:
(i) confirmed or RAC or waiting list accommodation is available in the train in whichfresh reservation is required ;
(ii) fresh reservation fee for the class for which reservation is required is paid , in case of tickets surrendered during working hours and at least twenty four hours before the scheduled departure of the train in which originally booked ;
(iii) 25% fare of already booked ticket is paid as cancellation charges , in case of tickets surrendered during working hours and within twenty four hours and four hours before scheduled departure of the train in which originally booked;
( iv) 50% fare of already booked ticket is paid as cancellation charges , in case of the tickets surrendered during working hours and within four hours before the scheduled departure and upto the maximum time limits mentioned in rule 6 ( i) (c) (i.e. three or six or twelve hours , depending on distance) after actual departure of the train in which originally booked ;
(b): RAC and Wait listed Tickets : Postponement of journey on RAC and Wait listed Tickets shall be allowed in the same or higher class , by any subsequent train on the same or any subsequent day, for same or any longer destination , provided that -
(i) confirmed or RAC or waiting list accommodation is available in the train in which fresh reservation is required;
(ii ) ticket is surrendered during working hours and upto the maximum time limits mentioned in rule6 ( i) ( c) (i.e. 3 or six or twelve hours , depending ondistance) after actual departure of the train in which originally booked ;
( iii) clerkage charge is paid;

(2) Preponement of journey: Preponement of journey on confirmed , RAC and wait listed tickets shall be allowed in the same or any higher class , by any earlier train on the same day or any earlier day, for same or any longer destination , provided that: -
(a) confirmed or RAC or waiting list accommodation is available in the train in which fresh reservation is required;
(b) the ticket is surrendered during the working hours of the reservation office and at least six hours before the scheduled departure of the train in which reservation is required or before preparation of the reservation chart, whichever is later ;
(c) fresh reservation fee for the class for which reservation is required ispaid , in case of preponement on confirmed tickets; and
(d) clerkage charge is paid , in case of preponement on RAC and wait listed tickets;
(3) If there is difference in fares for originally booked journey and revised journey , the difference of fare shall be refunded or recovered , as the case may be , subject to the provisions of sub rule ( 1 ) and (2) of rule 9 above .
(4) Postponement or Preponement of journey under the sub- rule ( 1 ) or sub- rule ( 2) shall be allowed only once.
i (5) The Postponement or Preponement of normal train ticket journeys will not be applicable against Tatkal Quota even on payment of Tatkal charges .
(6) If the ticket , on which journey has been altered under the sub - rules (1 ) or (2) is cancelled , cancellation charges shall be payable as follows : -
(a) cancellation charges as would have been due if the ticket for original reservation had been cancelled at the time of postponement or preponement of journey, and
(b) cancellation charges due in respect of ticket for altered reservation asif this altered reservation is a fresh reservation.
(c) In cases where 25% or 50 % cancellation charges were realized at the time of modification of journey, the cancellation charges mentioned in clause ( a) shall not be levied again and the cancellation charges mentioned in clause ( b) only shall be levied . "
in rule 17 , in sub- rule (4 ) , -
(i) The contents of para (ii ) shall be merged in the end of para (i ) of sub - rule (4); and
(!!) The following para may be inserted in para (ii ) :

"The 10% or 25% , as the case may be , of fare collected under sub - rule (3) ( i) for issuing duplicate ticket before preparation of reservation chart, against lost ormisplaced reserved or RAC tickets , shall be refundable from PRS terminals at destination station on completion of journey, after deducting the usual clerkage per passenger. Refund shall be granted on verification from PRS that no one has taken refund on the concerned lost or misplaced ticket . Refund shall be admissible , on surrendering the duplicate ticket, during working hours of reservation office , upto three days of arrival of the train . "
( III) in rule 4, for the words "station master shall levy a clerkage of rupees ten per passenger for cancellation of unreserved or wait- listed and RAC tickets " , the following shall be substituted:
" station master shall levy a clerkage of rupees twenty per passenger for cancellation of unreserved or wait-listed or RAC tickets , except for second class unreserved tickets where the clerkage of rupees ten only shall be levied . "
( IV) in clause ( a) of sub- rule ( 1 ) of rule 6 , for the words ( i ) " Rupees fifty " , substitute the words " Rupees seventy" , (ii ) " Rupees thirty " , substitute the words " Rupees sixty ", ( iii ) " Rupees twenty ", substitute the words " Rupees forty " and (iv ) " Rupees ten" , substitute the words " Rupees twenty "
