सा.का.नि. 637( अ ) -केन्द्रीय सरकार, उपभोक्ता संरक्षण अधिनियम , 1986 ( 1986 का 68 ) की धारा 30 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उपभोक्ता संरक्षण नियम , 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: - :
संक्षिप्त नाम और प्रारंभ : (1 ) इन नियमों का संक्षिप्त नाम उपभोक्ता संरक्षण ( तीसरा संशोधन) नियम , 2006 है ।
(2) ये राजपत्रमें प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. उपभोक्ता संरक्षण नियम, 1987 के नियम 12 क में उप नियम (6) के स्थान पर निम्नलिखित उप नियम रखे जाएंगे, अर्थात्: -
"(6) चयन समिति, उपनियम (6क) के उपबंधों के अधीन रहते हुए सदस्य के पद के लिए अभ्यर्थियों की उपयुक्तता निर्धारित करेगी :
परंतु चयन समिति, यदि आवश्यक समझे, तो वह अभ्यर्थियों की संख्या पर निर्भर करते हुए चयन के लिए ऐसे अभ्यर्थियों की तुलनात्मक योग्यता और अनुभव के आधार पर उनकी छंटनी कर सकेगी ।
(6क) चयन समिति, जहां छंटनी की जा चुकी है, वहां ऐसे छंटनी किए गए अभ्यर्थियों में से सदस्य के पद के लिए अभ्यर्थियों की उपयुक्तता का निर्धारण निम्नलिखित रीति से करेगी, अर्थात् : -

(क) न्यायिक पृष्ठभूमि वाले अभ्यर्थियो की दशा में ऐसे अभ्यर्थियों द्वारा पारित निर्णयों और अन्य न्यायिक आदेशों
के आधार पर उनका निर्धारण करके :
(ख) केन्द्रीय सरकार या किसी राज्य सरकार या केन्द्रीय सरकार अथवा किसी राज्य सरकार के अधीन किसी
उपक्रम में कार्य करने का अनुभव रखने वाले अभ्यर्थियों की दशा में, ऐसे अभ्यर्थियों का, उनकी वार्षिक गोपनीय
रिपोर्टों और आवेदित पद के संबंध में उनके सुसंगत अनुभव के आधार पर निर्धारण करके ;
(1) अन्य दशाओं में छंटनी किए गए अभ्यर्थियों की उपयुक्तता का निर्धारण चयन समिति द्वारा अभ्यर्थियों के
उनके द्वारा व्यक्तिगत साक्षात्कार के आधार पर किया जाएगा :

परंतु इस उप नियन में किसी बात के होते हुए भी चयन समिति अभ्यर्थियों के किसी वर्ग या प्रवर्ग की
उपयुक्तता का निर्धारण करने के लिए, यदि आवश्यक समझती है तो अभ्यर्थियों के ऐसे वर्ग या प्रवर्ग को, सदस्य के
पद के लिए उनकी उपयुक्तता का निर्धारण करने हेतु साक्षात्कार के लिए बुला सकेगी । "

NOTIFICATION
New Delhi , the 13th October , 2006
G.S.R. 637 (E) . In exercise of the powers conferred by sub section (1 ) of section 30 of the Consumer Protection Act, 1986 (68 of 1986 ) , the Central Government hereby makes the following rules further to amend the Consumer Protection Rules , 1987 , namely: -
1. Short title and commencement- ( 1 ) These rules may be called the Consumer Protection (Third Amendment ) Rules , 2006.

(2) They shall come into force on the date of their publication in the Official Gazette.

(6) , the In rule 12A of the Consumer Protection Rules , 1987, for sub-rule following sub-rules shall be substituted , namely: -
" (6) The Selection Committee shall , subject to the provisions of sub - rule (6A) , assess the suitability of the candidates for the post ofMember:
Provided that the Selection Committee may, if it considers necessary, depending on the number of candidates, short list them on the basis of comparative merit and experience of such candidates for selection .
(6A) The Selection Committee shall assess the suitability of the candidates and where short listing is done, from among the short-listed candidates, for the post of Member in the following manner , namely: -
(a) in the case of candidates having judicial background, by assessing them on the basis of the judgements and other judicial orders passed by such candidates;
(b) in the case of candidates having experience of working under the Central Government or any State Government or an undertaking under the Central Government or a State Government ,by assessing such candidates on the basis of their Annual Confidential Reports and their experience relevant to the post applied for;
(c) in other cases , the suitability of the short listed candidates shall be assessed by the Selection Committee on the basis of personal interview conducted by it :
Provided that notwithstanding anything contained in this sub- rule , the Selection Committee may, for assessing the suitability of a class or category of candidates , if it considers necessary , call such class or category of candidates for interview for assessing their suitability for the post of Member . "
