सा.का.नि. 640( अ ) - केन्द्रीय सरकार पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) की धारा 6 और 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पर्यावरण ( संरक्षण ) नियम , 1986 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: - 1. ( 1 ) इन नियमों का संक्षिप्त नाम पर्यावरण ( संरक्षण ) दूसरा संशोधन नियम , 2006 है।
(2 ) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. पर्यावरण ( संरक्षण ) नियम, 1986 की अनुसूची-1 में,
(i ) क्रम संख्या में 87 " रेयन उद्योग के लिए उत्सर्जन विनियम " से संबंधित उप - पैरा ' ग ' के लिए निम्नलिखित उप- पैरा रखा जाएगा: --
"ग. ऐसे नए संयंत्रों/परियोजनाओं का विस्तार जो 1-6-1999 को या उसके बाद चालू किए जाने हों, के लिए ऐसे नए संयंत्रों या परियोजनाओं का विस्तार के लिए विद्यमान संयंत्रों , जो उपर्युक्त ( क ) के अंतर्गत आने वाले विद्यमान संयंत्रोंके लिए उत्सर्जन मानक उपर्युक्त ( ख ) में इंगित सीएस, और एच एस के लिए परिवेशी वायु क्वालिटी मानदंडों का अनुपालन करते हों, के अधीन होंगे । नए संयंत्र या परियोजनाओं के विस्तार रिट्रोफिटिंग्स लगाने के लिए पर्याप्त स्थान प्रदान करेंगे!
(टिप्पण : उपर्युक्त क और ख नए संयंत्रों और परियोजनाओं के विस्तार को भी लागू होंगे ) । " ;
( ii ) क्रम संख्या 89 में, " पटाखों के लिए ध्वनि प्रदूषण " , से संबंधित उप - पैराग्राफ ग के बाद निम्नलिखित उप - पैरा अंतःस्थापित किया जाएगा, अर्थात्: --
"घ. निर्यात के प्रयोजन हेतु पटाखों के ऊपर उप- पैराग्राफ क, ख और ग से छूट होंगी बशर्ते कि निम्नलिखित शर्तों का अनुपालन करते हों नामश :-
(i) विनिर्माता के पास कोई नियति आदेश हो;
(ii ) पटाखे उस देश के विहित स्तरों के अनुरूप होंगे जिन्हें इसका निर्यात किया जाता हो;
(iii ) वे विभिन्न पैकिंग कलर कोड में होंगे , और
( iv ) बॉक्स पर यह घोषणा अंकित होगी " भारत में बिक्री के लिए नहीं " या " केवल अन्य देशों में निर्यात के लिए । "

NOTIFICATION
New Delhi , the 16th October , 2006
G.S.R. 640 (E). In exercise of the powers conferred by Sections 6 and 25 of the Environment (Protection ) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Environment (Protection) Rules , 1986 , namely :--
1. (1) These rules may be called the Environment (Protection) Second Amendment Rules , 2006 .
(2) They shall come into force in the date of their publication in the Official Gazette .
2. In the Environment ( Protection) Rules , 1986 , in Schedule- I ,
(i) In serial number 87 relating to the "Emission Regulation for Rayon Industry ," for sub - paragraph c , the following sub -paragraph shall be substituted , namely :--
" c . For new plants / expansion projeets being commissioned on or after 1-6-1999
For new plants or expansion projects , the emission standards for existing plants covered in ( a) above shall apply subject to compliance of the ambient air quality norms for CS, and H₂S indicated in (b) above . The new plants or expansion projects shall provide adequate space for undertaking retrofittings.
(Note: a and b above also apply to new plants or expansion projects ). " ;
(ii) In serial number 89 relating to " Noise standards for fire crackers " , after sub -paragraph C , the following sub-paragraph shall be inserted , namely :-
"D. The fire crackers for the purpose of export shall be exempted from the sub - paragraphs A, B and Cabove, subject to the compliance of the following conditions , namely : --
(i) the manufacturer shall have an export order ;
(ii) the fire crackers shall conform ta the level prescribed in the country to which it is exported;
(iii) they shall have a different packing colour code , and
( iv) there shall be a deelaration on the box " not for sale in India " or " only for export in other countries ."
