का.आ. 1774(अ).- के 68) की धारा 11 के खंड़) की अधिसूचना र मार्च 1998 द्वारा ऊ दीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का गोन जारी की गई, भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय ( सड़क आंक का.आ. 78 (अ) तारीख 4 फरवरी, 1999 और का.आ. 267(अ ) तारीख 30 सा राज्य में राष्ट्रीय राजमार्ग सं . 5 के (आंध्र प्रदेश/ उडीसा सीमा से भुवनेश्वर) 233.00 कि. मी. से 8.00 कि. मी. , ( भुवेनश्वर बालासोर) 0.00 कि. मी. से 27.80 कि. मी . और (जगतपुर से चान्दीकोट 27.8 कि. मी . से 61.00 कि. मी. तक के भूखंड़ को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा थ
अतः, अब, के शेय सरकार, राष्ट्रीय राजमार्ग (राष्ट्रीय राजमार्ग सेक्शन और स्थायी पुल- लोक वित्तपोषित परियोजना उपयोग के लिए फीस) नियम, 1997 के नियम 3 , नियम 5 और नियम 11 और राष्ट्रीय राजमार्ग ( फीस की दर) नियम, 1997 के नियम 3 के उपनियम ( 2) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 19 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के तत्कालीन सड़क प वहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का. आ. 1223 (अ) तारीख 14 दिसम्बर, 2001 और धेसूचना संख्या का. आ. 147 (अ) तारीख 29 जनवरी , 2004 को उन बातों के सिवाए, अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, यह अधिसूचित करती कि उड़ीसा राज्य में राष्ट्रीय राजमार्ग संख्या 5 के 402.010 कि.मी. (नई वैनेज 297.00 कि.मी. ) से 5124 कि.मी. (नई चैनेज 227.00 कि.मी. ) ( भुवनेश्वर चटिया) तक के चार लेन वाले भूखंड़ के उपयोग के लिए याँत्रिक यानों पर फीस भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय तौर पर या प्रतिस्पर्द्धात्म निविदा के आधार पर जो नियुक्त किए जाएं प्राइवेट ठेकेदार के माध्यम से , इससे संलग्न अनुसूची में वि र्दिष्ट दरों पर शाश्वत आधार पर उद्गृहीत और संगृहीत की जाएगी । फीस का संग्रहण , इस अधिसूचन के राजपत्र में प्रकाशित होने की तारीख से तीस दिन के भीतर या उक्त चार लेन के भूखंड को यातायात के लिए खोले जाने की तारीख से तीस दिनों के भीतर इनमें से जो भी पश्चातवर्ती हो, प्रारम्भ किया जाए । फीस की दरें राष्ट्रीय राजमार्ग ( फीस की दर) नियम, 1997 के नियम 3 के उपनियम (3) के उपबं के अनुसार पुनरीक्षण के अध्यधीन है ।

उड़ीसा राज्य में राष्ट्रीय राजमार्ग संख्या 5 पर 402.010 कि.मी. ( नई चैनेज 297.00 कि.मी. ) से 53.124 कि.मी. (नई चैनेज 227.00 कि.मी. ), रो वसूल की जाने वाली फीस की दरेंः ( भुवनेश्वर चटिया ) तक के चार लेन के भूखंड के उपयोक्ताओं
यह फीस भूखंड़ के भीतर केवल एक स्थान पर ही संगृहीत की जाएगी ।

जब उसी यांत्रिक यान को राष्ट्रीय राजमार्ग के उक्त भूखंड को एक दिन में एक से अधिक बार पार करना हो तो उपयोक्ता के पास यह विकल्प होगा कि वह पहली बार ही गेट पार करते समय ऊपर अनुसूची में दी गई दरों पर अनेक बार चक्करों के लिए फीस का संदाय कर दे या यदि यान को पूरे मास में या उससे परे उक्त भूखंड का उपयोग बार बार करना पड़ता है तो यान का स्वामी पूर्वोक्त अनुसूची में उसको यथा विनिर्दिष्ट लागू एकल दरों के तीस गुणा के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
स्पष्टीकरण:- इस अधिसूचना के प्रयोजन के लिए " दिन " से चौबीस घंटे की निरंतर अवधि के रूप अभिप्रेत
2. निम्नलिखित प्रकार के यानों को अनुसूची में ऊपर विनिर्दिष्ट फीस से छूट प्राप्त होगी अर्थातः- (i) यान
( अ) जो " अंति महत्वपूर्ण व्यक्ति " प्रतीक वाले है । या सरकारी तौर पर निम्नलिखित के हैं:-
(क) भारत के राष्ट्रपतिः
(ख) भारत के उपराष्ट्रपतिः
(ग) राज्य के राज्यपाल या संघ राज्य क्षेत्र के उपराज्यपाल;
(घ) भारत के शासकीय दौरे पर उच्चपदस्थ विदेशी व्यक्ति;
(ड)
" सी डी " / " सी सी " नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद के सभापति या राज्य विधान सभा के अध्यक्ष या संघ या राज्य के मंत्री या लोक सभा भारत का राजपत्र असाधारण

या राज्य सभा या राज्य विधानमंडलों में विरोधी दल के नेता, जिनका दर्जा कैबिनेट मंत्री का हो, यदि, वे स्वयं यान में हों; या
(छ) संसद सदस्य, संपूर्ण देश में या राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद के सदस्य, अपने-अपने राज्यों में, यदि, वह, यथास्थिति, संसद या राज्य के संबंधित विधान- मंडल, द्वारा जारी पहचान पत्र प्रस्तुत करते हैं ;
(आ) शौर्य पुर कारों, जैसे परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चा का विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्क रूप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता है ;
(ii) ' रक्षा या, पुलिस यान, अग्नि शमन यान , एम्बुलेंस, अन्त्येष्टि यान , तार विभाग के 'यान , द्रीय सरकार और राज्य सरकार के कर्तव्यारूढ़ यान ।
3. फीस की दरें, श्रीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम , पता और टेलीफोन संख् जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए, पथकर चौकी से 500 मीटर पीछे, कर चौकी से 100 मीटर आगे और पथकर चौकी पर भी. सहजदृश्य रूप से और प्रमुख रूप से प्रदर्शित की जाएगी । संप्रदर्शन बोर्ड की ऊचांई और अक्षरों का आकार इस प्रकार लकों के लिए संप्रदर्शन बोर्ड का पढ़ना आसान हो, और ये अंग्रेजी , हिंदी और उस भूखंड़ अवस्थित है, की प्रादेशिक भाषा में स्पष्ट रूप से लिखे अथवा मुद्रित किए का होगा कि क्षेत्र जिसमें उ जाएंगें ।
4.
वाहन प्रकार में निम्नलिखित सम्मिलित होगें : -
i)
अनुसूची के क्रम संख्या 2 में की दशा में " मिनी बसें " और
ii) अनुसूची के क्रम संख्या 3 की दशा में ऐसे " बहुधुरी वाले यान" जो उक्त अनुसूची की क्रम संख्या 4 में सम्मिलित नहीं हैं ।
5. किसी ऐसे र त्रेक यान से फीस उदगृहीत और संगृहीत नहीं की जाएगी जो उक्त अनुसूची में सम्र्माित नहीं हैं ।

NOTIFICATION
NewDelhi , the 16th October, 2006
S.O. 1774 (E ) .-Whereas , the Central Government, vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 78 (E) , dated the 4th February, 1999, and S.O. 267 (E ) , dated the 30th March, 1998 , issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988 ) , entrusted the stretch from Km . 233.00 to Km . 418.00 from (Andhra Pradesh-Orissa border to Bhubaneshwar ) , Km. 0.00 to Km . 27.80 (Bhubaneshwar- Balasore) and from Km . 27.8- Km . 61.00 (Jagatpur to Chandikol ) of National Highway No. 5 in the State of Orissa to the National Highways Authority of India;
Now, therefore , in exercise of the powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956) , read with rules 3, 5 and 11 of the National Highways (Fees for the use of National Highway, Section and Permanent Bridge- Public Funded Project) Rules , 1997 and sub - rule (2) of rule 3 of the National Highways ( Rate of Fee) Rules , 1997, and in supersession of the notifications of the Government of India in the Ministry of Road Transport and Highways , number S.O. 1223 (E), dated the 14th December , 2001 and number S.O. 147(E) , dated the 29th January, 2004 except as respect things done or omitted to be done before such supersession, the Central Government hereby notifies that there shall be levied and collectedby the National Highways Authority of India departmentally or through private contractor who may be appointed on the basis of competitive bidding, a fee on mechanical vehicles for the use of the four - laned stretch from Km. 402.010 ( new chainage Kın . 297.00) to Km. 53.124 ( new chainage Km. 227.00) (Bhubaneshwar - Chattia) of National Highway No. 5 in the State of Orissa at the rates specified in the Schedule annexed hereto in perpetuity. The collection of fee shall commence withinthirty days from the date of publication of this notification in the Official Gazette or within thirty days from the date of opening of the said four - laned stretch to traffic , whichever is later . The rates of fee are subject to revision as per the provisions of sub - rule (3 ) of rule 3 of the National Highways (Rate of Fee ) Rules , 1997.
SCHEDULE
Rates of Fee to be Recovered from the users of Four - laned Stretch from Km . 402.010 (New Chainage Km . 297.00 ) to Km. 53.124 (new Chainage Km . 227.00 ), (Bhubaneshwar to Chattia) of National Highway No. 5 in the State of Orissa.
The fee shall be collected at single location only within the stretch .

Notes,-
Whenthe same mechanical vehicle has to cross the said stretch of the National Highway more than once in a day, the user shall have the option to pay the fee for the multiple trips at the rates given in the Schedule above while crossing the gate in the first trip itself or if the same mechanical vehicle has to use the said four - laned stretch frequently for the entire month , the vehicle owner may obtain a monthly pass on the payment of charges equivalent to 30 single rates applicable to it , as specified in the aforesaid Schedule .
Explanation. For the purposes of this notification , " day " means continuous period of twenty - four hours .
2. The following types of vehicles shall be exempted from the fee specified in the Schedule , namely :---
(i) vehicles,
(A) having " VIP" symbols , or officially belonging to
(a) the President of India;
(b) the Vice President of India;
(c) the Governor of a State or the Lt. Governor of a Union Territory;
(d) a Foreign Dignitary on State visit to India ;

(e) a Feign diplomat stationed in India using cars with "CD "/ " CC " number plates ;
(f) the hairman of the Rajya Sabha or the Speaker of the Lok Sabha or the Chairman of a State Legislative Co cilor the Speaker of a State Legislative Assembly or a Minister for the Union or a State, or Leader of oposition in the Lok Sabha or Rajya Sabha or a State Legislature having the status of Cabinet Mi ster , if he is sitting in the vehicle ; or
(g) a a iss mber of Parliament, in the entire country, or a Member of the Legislative Assembly of a State or mber of Legislative Council of a State, in the respective State, if he produces his identity card d by the Parliament or concerned Legislature of the State , as the case may be;
(B) belonging to winner of a Gallantry award such as Param Vir Chakra , Ashok Chakra , Maha Vir Chakra , Kirti Chakra, Vir Chakra an Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Au ority for such award ,
( ii) Defence

3. The rates of fees , t number of the authority played 500 meters ahead display boards and size written or printed in Eng categories of vehicles exempted from payment of fee and the name, address and telephone whom complaints , if any, should be addressed , shall be conspicuously and prominently dis- f the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the letters being such that it is easy for drivers to read the display boards and they shall be legibly sh , Hindi and regional language of the area in which the stretch is situated .
