Ο.Ν. 97 ( Ε ) . Whereas , Section 61A of the Representation of the People Act, 1951 , provides that the giving and recording of votes by voting machines in such manner as may be prescribed , may be adopted in such constituencies as the Election Commission may, having regard to the circumstances of each case specify ; and आ.अ. 97( अ ).-यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61क में यह उपबंधित है कि मतदान मशीनों द्वारा मत ऐसी रीतिसे दिए और रिकार्ड किए जाएंगे जैसा कि भारत निर्वाचन आयोग ऐसे निर्वाचन क्षेत्र के लिए प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए निर्दिष्ट करे; तथा
2. यतः बिहार राज्य में आयोग ने 27 - भागलपुर और 31 - नालन्दा संसदीय निर्वाचन क्षेत्रों और झारखण्ड में 5 - कोडरमा संसदीय निर्वाचन क्षेत्र की परिस्थितियों पर विचार किया है और वह संतुष्ट है कि उपर्युक्त संसदीय निर्वाचन क्षेत्रों में मतदान के लिए पर्याप्त संख्या में इलेक्ट्रानिक वोटिंग मशीन उपलब्ध है , मतदान कर्मचारी इलेक्ट्रानिक वोटिंग मशीन के दक्षतापूर्वक संचालन करने के लिए प्रशिक्षित हैं तथा निर्वाचक भी इलेक्ट्रानिक वोटिंग मशीनों की कार्यप्रणाली से पूर्णतया परिचित हैं;
2. Whereas , the Commission has considered the circumstances in 27 - Bhagalpur and 31 - Nalanda Parliamentary Constituencies in Bihar and 5 - Koderma Parliamentary Constituency in Jharkhand , and it is satisfied thatsufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned. Parliamentary Constituency, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;
3. अतः , अब , भारत निर्वाचन आयोग एतद्वारा बिहार राज्य में 27- भागलपुर और 31- नालन्दा संसदीय निर्वाचन क्षेत्रों और झारखण्ड में 5-कोडरमा संसदीय निर्वाचन क्षेत्र को उन निर्वाचन क्षेत्रों के रूप में विनिर्दिष्ट करता है जिसमें 9 अक्तूबर, 2006 को अधिसूचित उक्त राज्य से लोक सभा के लिए चालू उप निर्वाचनों में , निर्वाचनों का संचालन नियम , 1961 के अधीन मत निर्धारित रीति से इलेक्ट्रानिक मतदान मशीनों के माध्यम से डाले और रिकार्ड किए जाएंगे जैसा कि इस विषय पर आयोग द्वारा समय - समय पर अनुपूरक अनुदेश जारी किए जाते हैं ।
3. Now, therefore , the Election Commission of India hereby specifies 27 - Bhagalpur and 31 - Nalanda Parliamentary Constituencies in Bihar and 5 - Koderma Parliamentary Constituency in Jharkhand , as the constituencies in which the votes at the currentby- elections to the House of the People from the said State notified on 9thOctober , 2006, shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules , 1961 , and the supplementary instructions issued by the Commission from time to time on the subject .
