सा.का.नि. 657( अ ) .-केन्द्रीय सरकार , सीमाशुल्क अधिनियम , 1962 ( 1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 39/96 -सीमाशुल्क, तारीख 23 जुलाई , 1996 , सा.का. नि. 291 ( अ ) , तारीख 23 जुलाई , 1996 , का निम्नलिखित और संशोधन करती है , अर्थात्ः-
उक्त अधिसूचना में , सारणी में , क्रम सं. 29 के पश्चात निम्नलिखत क्रम सं. तथा प्रविष्टियां अंतःस्थापित की जायेंगी , अर्थात

यदि, -
(क) उक्त माल का आयात प्रोजक्ट अस्त्रा के कर्मशाला केन्द्र , जो किसी ऐसे अधिकारी द्वारा जो भारत सरकार के रक्षा मंत्रालय में उप सचिव की पंक्ति से नीचे का न हो , अभिहित किए जायें, द्वारा किया जाता है ; और
रक्षा मंत्रालय के एस्ट्रा कार्यकम के प्रयोजनों के लिए अपेक्षित मशीनरी , उपस्कर , उपकरण , संघटक, अतिरिक्त पुर्जे जिग फिक्चर , डाई , औजार, उपसाधन , कम्प्यूटर साफ्टवेयर , कच्ची सामग्री , खपने वाली समग्री ।
(ख) ऐसे प्राधिकृत कर्मशाला के तहत प्रत्येक मामले में , आयात के समय उक्त माल की सुसंगत वर्णन सहित एक ऐसी सूची उपायुक्त सीमाशुल्क अथवा सहायक आयुक्त सीमाशुल्क के समक्ष प्रस्तुत करते हैं जो कार्यक्रम निदेशक , प्रोजक्ट अस्त्रा रक्षा अनुसंधान और विकास विभाग द्वारा सम्यक रूप से इस आशय के बारे में प्रमाणित हो कि उक्त माल प्रोजक्ट अस्त्रा रक्षा रिसर्च और डवलेपमेंट लाबोटरी , हैदराबाद, कार्यक्रम के लिए अपेक्षित है , तथा
( i ) उक्त माल का उपयोग केवल प्रोजक्ट अस्त्रा के लिए किया जायेगा और उस माल का भारत में विनिर्माण नहीं किया जाता है ; और
( ii ) वह माल जो कि उस सूची में वर्णित है उस का आयात भारत सरकार के रक्षा मंत्रालय के द्वारा प्राधिकृत है तथा उसका प्रयोग प्रोजक्ट अस्त्रा हेतु ही होगा ।

No. 110/2006- CUSTOMS
G.S.R. 657 (E) . In exercise of the powers conferred by sub - section ( 1 ) of Section 25 of the Customs Act , 1962 ( 52 of 1962) , the Central Government, being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue ) , No. 39/96- Customs , dated the 23rd July, 1996, G.S.R. 291 (E) , dated the 23rd July, 1996, namely: -
namely:- In the said notification , in the table , after serial number 29 , the following S.No. and entries shall be inserted,

"30 .
(a) the said goods are imported by authorised works centers ofProject ASTRA, as may be designated hy an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Defence ; and
Machinery , equipment , instruments , components , spares , jigs and fixtures , dies , tools , accessories , computer sof- ware , raw materials and consumables required for the purpose of Project ASTRA of the Ministry of Defence. (b) the authorised works centre produces to the Deputy Commissioner of Customs or the Assistant Commissioner of Customs , as the case may be , at the time of import , in each case , a list of the said goods with their relevantde- scription duly certified by the Project Director ' ASTRA ' , Defence Research and Development Laboratory, Hyderabad,to the effect-
(i) that the said goods in the list are required for Project ASTRA, and that they are not manufactured in India; and
(ii) the import of the said goods in the list is authorized by the Ministry of Defence under and for the purposes of Project ASTRA and shall be used only for Project ASTRA.
Explanation . Nothing contained in this exemption shall have effect on or after the 1st day of September , 2012. "

सा.का.नि. 658( अ ) केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 ( 1944 का 1 ) की धारा 5 क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि ऐसा करना लोकहित में आवश्यक है , भारत सरकार के वित्त मंत्रालय (राजस्व विभाग ) की अधसूिचना सं. 64/ 95- केन्द्रीय उत्पाद शुल्क, तारीख 16 मार्च , 1995 , सा.का.नि 256 ( अ ), तारीख 16 मार्च, 1995 , का निम्नलिखित संशोधन करती है , अर्थात्:-
(क) उक्त अधिसूचना में, सारणी में , क्रम सं. 23 के पश्चात् निम्नलिखत क्रम सं. तथा प्रविष्टियां अंतः स्थापित की जाएंगी , अर्थात (1)

उपकरण और स्टोर
यदि,
( i ) उनका प्रयोग भारत सरकार के रक्षा मंत्रालय के अधीन प्रोजक्ट अस्त्रा के सिस्टम एवं उप सिस्टम हेतु किया जाता है ।
( ii ) उक्त माल की निकासी से पूर्व, कार्यक्रम निदेशक, प्रोजक्ट अस्त्रा से इस आशय का एक प्रमाण पत्र कि ऐसे माल उक्त प्रोजक्ट अस्त्रा, रक्षा रिसर्च और डवलैपमेंट लाबोटरी कार्यक्रम के लिए आशयित है , उचित अधिकारी को प्रस्तुत किया जाता है ।
( iii ) यदि उपरोक्त प्रयोग उस माल के उत्पादन की फैक्ट्री से अन्यत्र हुआ है तब माल का उत्पादक, माल की निकासी के पांच माह में या उपायुक्त , केन्द्रीय उत्पाद शुल्क अथवा सहायक आयुक्त , केन्द्रीय उत्पाद शुल्क द्वारा इस संबंध में प्रदान की गई अवधि के भीतर, कार्यक्रम निदेशक , अस्त्रा द्वारा जारी प्रमाणपत्र जिसमें कि उस माल के उस संस्थान में प्राप्ति की तारीख दी गई हो तथा यह सत्यापित किया गया हो कि वह माल प्रोजेक्ट अस्त्रा हेतु प्रयोग किया गया है । "
(ख) उक्त अधिसूचना में तीसरे परंतुक के पश्चात्, निम्नलिखित परंतुक अंतःस्थापित किया जायेगा , अर्थात्ः- " उक्त सारणी के क्रम सं. 24 के परंतुक में , यह अधिसूचना 1 सितम्बर , 2012 या उसके पश्चात् लागू नहीं होगी. "

In exercise of the powers conferred by sub - section ( 1) of Section 5A of the Central Excise Act, 1944 ( 1 of 1944) , the Central Government, being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , No. 64/ 95-Central Excise , dated the 16 March, 1995 , G.S.R. 256(E ) , dated the 16 March , 1995 , namely: --

Equipment and stores
(i) used for the systems and sub - systems of project ASTRA ofthe Government of India in the Ministry of Defence ;

(ii) before clearance of the said goods , a certificate from the Project Director ASTRA, Defence Research and Develop- ment Laboratory , Hyderabad, in the Ministry of Defenceto the effect that the goods are intended for the aforesaid use is produced to the proper officer; and
(iii) the aforesaid use is elsewhere than in the factory of pro- duction of the said goods , the manufacturer produces within five months from the date of clearance or within such ex- tended period as the Deputy Commissioner of Central Excise , or the Assistant Commissioner of Central Excise , as the case may be , may allow in this regard, a certificate from the said Project Director , ASTRA, indicating the date of receipt of the said goods hy that organisation and certifying that they have been actually put to the aforesaid use .
(b) in the said notification after the third proviso , the following proviso shall be inserted. namely:
"Provided also that in respect of S.No. 24 of the said Table , nothing contained in this notification shall apply on or after the 1st day of September, 2012."
