2006 संसद् द्वारा अधिनियमित कर दिया गया है और राष्ट्रपति की अनुमति के पश्चात् उसे 18 अगस्त, 2006 को प्रकाशित कर दिया गया है ;
और संसद् (निरर्हता निवारण) संशोधन अधिनियम , 2006 की धारा 2 के खंड ( ii) द्वारा 4 अप्रैल, 1959 से यथा अंतःस्थापित संसद् (निरर्हता निवारण ) अधिनियम , 1959 की धारा 3 के खंड (ट) द्वारा दिल्ली ग्रामीण विकास बोर्ड के अध्यक्ष के पद को, अन्य पदों के साथ, ऐसे पद के रुप में घोषित किया गया हैं , जिसका धारक संसद् का सदस्य चुने जाने के लिए और सदस्य होने के लिए निरर्हित नहीं होगा;

In re:
Alleged disqualification of Sh . Sajjan Kumar , Member of Parliament , under Article 102 (1) (a) of the Constitution
Reference Case No. 48 of 2006
[Reference from the President under Article 103 (2 ) of the Constitution]
OPINION
This is a reference , dated 10-4-2006 , from the President of India, under Article 103 (2) of the Constitution, seeking the opinion of the Election Commission on the question whether Shri Sajjan Kumar, has become subject to disqualification for being Member of Parliament ( Lok Sabha ) under Article 102 ( 1 ) ( a ) of the Constitution. 2 The above mentioned reference arose out of a petition , dated 28th March, 2006 from Shri Vijay Jolly, Member of Legislative Assembly, National Capital Territory of Delhi. In the petition , the petitioner has raised the question of alleged disqualification of Shri Sajjan Kumar ( respondent) on the ground that he was appointed on 11-10-2004 as Chairman, Delhi Rural Developinent Committee which, according to the petitioner, is an office of profit under the Government within the meaning of Article 102(1 )(a) . In the petition, the petitioner has wrongly described the body as ' Delhi Rural Development Committee instead of the correct name ' Delhi Rural Development Board' , Copy of the Order of appointment of the respondent annexed to the petition mentions about his appointment as Chairman of ' Delhi Rural Development Board' .

3. The Commission issued notice on 02-05-2006, under Section 146 of the Representation of the People Act, 1951 , to the respondent asking him to file his reply by 22-05-2006 . On 20-05-2006 , the respondent , through Shri Anil Kumar Sharma, Advocate , submitted an application in reply to the Commission's notice dated 02-05- 2006. He stated that for filing a detailed and comprehensive reply , he needed to collect certain documents and required more tiine . He requested the Commission to grant extension of time by atleast four weeks to enable him to file detailed /comprehensive written statement along with relevant documents as directed by the Commission . The Commission considered the request and granted him time upto 21-6-2006.
4. The respondent submitted written statement on 18-6-2006 denying the allegations against him and praying to be heard on the reference through his lawyer . He stated that he had not drawn any salary or remuneniration on account of his appointment to the said office.
5 . While the matter was under consideration of the Commission for further enquiry, the Parliament (Prevention of Disqualification ) Amendment Act, 2006, amending the Principal Act of 1959 , was enacted by the Parliament and notified after the Presidential assent on 18.8.2006 . A copy of this Amendment Act was received from the Ministry of Law and Justice on 21.8.2006 . By the Amendment Act , the office of Chairman of the Delhi Rural Development Board, among others , has been declared under Section 3 ( k) of the Principal Act, as an office the holder of which shall not be disqualified for being chosen as , and for being, Member of Parliament . This amendment to the Principal Act has been brought into force with retrospective effect from 4th April , 1959 .
6. The above mentioned Amendment Act of 2006 has a direct bearing on the present reference cases . As mentioned above , the provisions of clause (k) of Section 3 of the Principal Act of 1959 have been brought into force with effect from 4.4.1959 . It is a settled position that under Article 102( 1 ) (a ) , the Parliament is empowered to declare , with retrospective effect , an office to be an office the holder whereof shall not be disqualified . The decision of the Supreme Court in Smt . Kanta Kathuria vs. M. Manak Chand Surana [ 1970 (2 ) SCR 838 ] upholds this constitutional position. In the past also , the Commission has taken cognizance of similar laws passed by the legislatures with retrospective effect , even as enquiry into the references concerned was in progress. In the reference case (No. 4 of 1980) regarding alleged disqualification of Sh . Gaya Lal and 23 other members of the Haryana Legislative Assembly , during the pendency of the reference before the Commission, the Haryana State Legislature amended the Haryana 8
THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II -SEC. 3(ii)]
State Legislature (Prevention of Disqualification ) Act , 1974, twice by virtue of which the offices held by the said MLAs were brought under the exempted categories . In that case , the Commission, in its opinion dated 21-05-1981 held the view that the disqualifications , if any , stood removed in their cases and the reference became infructuous. Similarly , in a reference case (No. 2 (G ) of 2005. ) relating to alleged disqualification of Shri Mohd. Azam Khan for membership of Uttar Pradesh Legislative Assembly . the State Legislature passed an amendment to the Uttar Pradesh State Legislature (Prevention of Disqualification) Act , 1971 , during the pendancy of the proceedings before the Commission. In that matter also , the Commission tendered its opinion to the effect that disqualification , if any , stood removed in view of the amended provisions of the law. Again, in another recent case { Reference Case Nos . 65( G) to 70 ( G) 2006 ) on the petition of Shri Y. Mangi Singh regarding alleged disqualification of 6 MLAs of Manipur, the Commission took note of the Amendment Act passed by the Manipur State Legislature , exempting the offices concerned from disqualification , and opined that the reference had been rendered infructuous . The present case is similar in facts and circumstances to the above referred cases and the amended provision of law removing the disqualification, if any , of the respondent, squarely apply in this case .
7. Having regard to the above constitutional , legal and factual position, the Commission is of the considered view that the question of alleged disqualification of Shri Sajjan Kumar raised in the petition referred to in paragraph 2 above has now become infructuous as the alleged disqualification , if any , stands removed with retrospective effect by virtue of the Parliament ( Prevention of Disqualification) Amendment Act 2006. Accordingly, the reference from the President referred to in paragraph 1 above is returned with the Commission's opinion to the effect that the Shri Sajjan Kumar is not subject to disqualification under Article 102 ( 1 ) ( a) on account of his appointment to the office of Chairman of the Delhi Rural Development Board, as alleged in the petition .
