फा. सं. 01 /89/ 180-विविध-65 /एएम 05 /पीसी-1 ( ए ).-विदेश व्यापार नीति , 2004-2009 के पैराग्राफ 2.4 और प्रक्रिया पुस्तक ( खण्ड 1 ) के पैरा 1.1 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, महानिदेशक , विदेश व्यापार एतद्वारा प्रक्रिया पुस्तक (खण्ड-1 ) में निम्नलिखित संशोधन करते हैं :---
1. पैरा 2.32.2 (2 ) के अन्त में निम्नलिखित जोड़ा जाएगा :
" इसके अतिरिक्त , धातु अपशिष्ट और स्क्रैप की सभी आयात खेपों के साथ यह दर्शाता हुआ पूर्व- पोतलदान निरीक्षण प्रमाण- पत्र होना चाहिए कि :
(i) खेप में किसी भी प्रकार का हथियार , गोला बारूद, सुरंग , शेल्स, कारतूस , रेडियो एक्टिव सम्मिश्रण या कोई अन्य विस्फोटक सामग्री प्रयुक्त अथवा अन्यथा किसी भी रूप में नहीं है ।
(ii ) इस प्रकार के वर्गीकरण हेतु अन्तर्राष्ट्रीय स्तर पर स्वीकृत मानदण्डों के अनुसार आयातित मद ( मदें) धातु अपशिष्ट/ स्क्रैप/पुराने/खराब हैं ।
प्रमाण- पत्र का प्रपत्र पूर्व- पोतलदान एजेन्सियों द्वारा जारी किया जाएगा । ऐसे प्रमाणपत्र जारी करने के

लिए प्राधिकृत एजेंसियों के नाम और इन एजेन्सियों के प्राधिकरण के लिए प्रक्रिया 1-4-2007 से लागू की जाएगी , जिसे यथा समय अलग से अधिसूचित किया जाएगा ।
2. पैरा 2.32.2 ( घ ) का अन्तिम पैरा संशोधित करके निम्नानुसार पढ़ा जाएगा :
" पंजीकृत स्रोतों से आयात की नई प्रणाली 1 अप्रैल , 2007 से प्रभावी होगी । तथापि , ऐसे मामलों में जहां लदान बिल की तारीख 31 मार्च, 2007 अथवा इससे पहले है , तो आयात की अनुमति समय -समय पर यथा- संशोधित और सार्वजनिक सूचना सं. 1 , दिनांक 8 अप्रैल , 2005 द्वारा अधिसूचित प्रक्रिया पुस्तक (खण्ड-1 ) के पैरा 2.32 के पूर्व पोतलदान निरीक्षण व्यवस्था के आधार पर होगी , जब तक कि पंजीकृत स्रोतों से आयात की नई प्रणाली लागू नहीं होती । "
3. पैरा 2.32.2 (ङ) संशोधित करके निम्नानुसार पढ़ा जाएगा :
" पंजीकृत आपूर्तिकर्ताओं से केवल सीधे आयातों की अनुमति होगी । तथापि, आयात सौदों से संबंधित सभी दस्तावेजों में , आयातक के साथ - साथ निर्यातक के नामों का भी उल्लेख करना होगा । समुद्र में बिक्री की अनुमति नहींहोगी । "
4. इसे लोकहित में जारी किया जाता है ।

PUBLIC NOTICE

F. No. 01 / 89/ 180- Misc. 65/AM 05/PC- I (A) .- In exercise of the powers conferred under Paragraph 2.4 of the Foreign Trade Policy , 2004-09 and Paragraph 1.1 of Handbook ofProcedures (Vol . 1 ) , the Director General of Foreign Trade hereby makes the following amendments in the Handbook of Procedures (Vol . 1) .
1. The following shall be added at the end of para
2.32.2(a):
"Inaddition , all import consignments ofMetallic Waste and Scrap must accompany a Preshipment Inspection Certificate stating that:
( The consignment does not contain any type ofarms , ammunition , mines , shells , cartridges , radio active contaminated or any other explosive material in any form either used or otherwise .
(i) The imported item(s) is actually a metallic waste/ scrap / seconds/defective as per the internationally accepted parameters for such a classification .
The format of the certificate to be issued by the Preshipment Agencies , Names of the
[PARTI-SEC. 1 ]
Agencies authorized to issue such certificates and procedure for authorization ofthese agencies to be made operational with effect from 1-4-2007 , will be notified separately in due course .
2. Last Para of Paragraph 2.32.2 (g ) will be amended to read as follows:
"The new system of import from registered sources willcome into effect from 1st April, 2007. However , in cases where Bill ofLading is dated 31stMarch , 2007 or before, imports will be allowed on the basis ofPre- Shipment Inspection regime in terms ofPara 2.32 of the Handbook of Procedures (Vol . 1) , notified vide Public Notice No. 1 dated 8th April, 2005 and as amended from time to time , till the new system of import from registered sources comes into effect . "
3. Paragraph 2.32.2 (e) will be amended to read as follows:
"Onlydirect imports from registered suppliers will be allowed. However, in all documents relating to import transactions , name of importer as well as exporter will be indicated No high sea sale would beallowed ."
4. This issues in public interest .
