आ.अ. 100(अ).-यतः , आयोग ने बिहार के 27 - भागलपुर तथा 31 नालन्दा संसदीय निर्वाचन क्षेत्रों से 9 अक्तूबर , 2006 की अधिसूचनाओं क्रमशः 100/बिहार- लो.स./ 1/2006 तथा 100/बिहार- लो.स./2 /2006 के द्वारा लोक सभा के उप - निर्वाचनों को अधिसूचित किया है;
यतः , उपरोक्त निर्वाचन क्षेत्रों की निर्वाचक नामावलियों को अर्हता की तारीख मान कर पुनरीक्षित कर दी गई है ;
यतः, जिला निर्वाचन अधिकारी तथा जिला स्तर पर पुनरीक्षण का कार्य करने वाले अन्य कार्मिक एक के बाद एक होने वाले वर्ष 2005 में बिहार विधान सभा का साधारण निर्वाचन तथा उसके बाद वर्ष 2006 के प्रारंभ में बिहार राज्य के पंचायत निर्वाचन कार्य मेंव्यस्त थे तथा राज्य के कुछ भागों में भारी वर्षा तथा बाढ़ जैसी स्थिति होने से 1-1-2006 की अर्हता की तारीख के संदर्भ में निर्वाचक नामावलियों का पुनरीक्षण नहीं किया जा सका;
यतः , आयोग ने 1-1-2007 अर्हता तिथि के संदर्भ में निर्वाचक नामावलियों के पुनरीक्षण के कार्यक्रम की घोषणा में, अन्य बातों के साथ निर्वाचक नामावलियों के अंतिम प्रकाशन की तिथि15 मार्च, 2007 घोषित की है तथा;
यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 151 क के अधीन 27 - भागलपुर तथा 31 - नालन्दा संसदीय निर्वाचन क्षेत्रों में निर्वाचन 16-11-2006 तक कराया जाना है तथा;
अतः , अब लोक प्रतिनिधित्व अधिनियम , 1950 ( 1950 का 43 ) की धारा 21 की उप- धारा ( 2 ) के अनुसरण में आयोग , एतद्वारा , यह निदेश देता है कि विद्यमान निर्वाचक नामावलियाँ अर्थात् अर्हता तारीख 1-1-2005 के संदर्भ में पुनरीक्षित निर्वाचक नामावलियाँ, उपरोक्त संसदीय निर्वाचन क्षेत्रों के अन्तर्गत आने वाले विधान सभा निर्वाचन क्षेत्रों के लिए उक्त संसदीय निर्वाचन क्षेत्रों से उप- निर्वाचनों के संचालन के लिए निर्वाचक नामावलियाँ होंगी ।

ORDER
New Delhi , the 19th October , 2006
Ο.Ν. 100(E) . Whereas, the Commission has notified bye - elections to the Lok Sabha from 27 - Bhagalpur and 31-Nalanda Parliamentary Constituencies of Bihar vide its notifications No. 100/BR - HP/1/2006 and 100/BR -HP/2/2006 both dated 9th October , 2006 respectively; and
Whereas, the electoral rolls of the said constituencies stand revised with 1-1-2005 as qualifying date; and
Whereas , the revision of clectoral rolls with reference to 1-1-2006 as qualifying date could not be undertaken as District Election Officers and other personnel who participate in the revision of rolls at District level had been engaged in two successive general elections to Bihar Legislative Assembly in 2005 immediately followedby Panchayat elections in Bihar in early 2006 and further due to heavy rains and flood like situation in some parts of the State ; and Whereas, the Commission has announced the programme for revision of electoral rolls with reference to 1-1-2007 as qualifying date, providing inter-alia date of final publication of electoral rolls on 15th March , 2007; and
Whereas, bye- elections from 27 - Bhagalpur and 31 - Nalanda Parliamentary Constituencies have to be held by 16-11-2006 under Section 151A ofthe Representation of People Act, 1951;
Now, therefore, the Commission in pursuance of Sub - section (2) of Section 21 of the Representation of the People Act,1950(43 of 1950) , hereby , directs that the existing electoral rolls i.e. the electoral rolls revised w.r.t. to 1-1-2005 as the qualifying date , in respect of the Assembly Constituencies comprised within the said Parliamentary Constituencies shall be the electoral rolls for the conduct of bye - elections from the said Parliamentary Constituencies .
