सा.का.नि. 661 (अ).- केन्द्रीय सरकार, वन्य जीव (संरक्षण ) अधिनियम, 1972 (1972 का 53) की धारा 38ड की उपधारा (4) के साथ पठित धारा 63 की उपधारा (1 ) के खंड (छत्त्) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रीय व्याघ्र संरक्षण प्राधिकरण के अध्यक्ष, उपाध्यक्ष, सदस्य और सदस्य सचिव की वेतन, भत्ते और नियुक्ति की अन्य शर्तों को विनियमित करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ (1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय व्याघ्र संरक्षण प्राधिकरण (वेतन, भत्ते और नियुक्ति की अन्य शर्तें) नियम, 2006 है ।
(2 ) ये नियम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हों,
(क) " अधिनियम" से वन्यजीव (संरक्षण) अधिनियम, 1972 (1972 का 53 ) अभिप्रेत है ;
(ख) " अध्यक्ष" से व्याघ्र संरक्षण प्राधिकरण का अध्यक्ष अभिप्रेत है ;
(ग) " निधि" से धारा 38 थ की उपधारा (2) के अधीन गठित व्याघ्र संरक्षण प्राधिकरण निधि अभिप्रेत है;
(घ) " सदस्य" से व्याघ्र संरक्षण प्राधिकरण का सदस्य अभिप्रेत है ;
(ङ) " सदस्य सचिव" से व्याघ्र संरक्षण प्राधिकरण का सदस्य सचिव अभिप्रेत है ;
(च) " धारा " से अधिनियम की धारा अभिप्रेत है ;
(छ) "व्याघ्र संरक्षण प्राधिकरण " से धारा 38 ठ के अधीन गठित राष्ट्रीय व्याघ्र संरक्षण प्राधिकरण अभिप्रेत है ;

(ज) " उपाध्यक्ष " से व्याघ्र संरक्षण प्राधिकरण का उपाध्यक्ष अभिप्रेत है ;
3. अध्यक्ष, उपाध्यक्ष और सदस्यों के यात्रा और अन्य भत्ते (1 ) अध्यक्ष, उपाध्यक्ष और सदस्य व्याघ्र संरक्षण । प्राधिकरण के कार्यों के संबंध में उनके द्वारा की गई यात्राओं के संबंध में यात्रा भत्ते और दैनिक भत्तों, जो क्रमशः । संघ के मंत्री, संघ के राज्य मंत्री और भारत सरकार के सचिव को अनुज्ञेय दर से प्राप्त करने के हकदार होंगे ।
(2) उपधारा (1 ) में किसी बात के होते हुए भी अध्यक्ष या कोई अन्य सदस्य, जो कोई संसद् सदस्य है, यथास्थिति, संसद् (निर्रहता निवारण ) अधिनियम , 1959 ( 1959 का 10 ) की धारा 2 के उपखंड (क) में परिभाषित भत्तों से भिन्न कोई पारिश्रमिक प्राप्त का हकदार नहीं होगा या अन्य भत्तों, यदि कोई हों, उपगत करता है, तो ऐसा निर्रहता से बाहर होगा ।
4. व्याघ्र संरक्षण प्राधिकरण के पुनर्गठन पर सदस्य सचिव की नियुक्ति (1 ) केन्द्रीय सरकार, राजपत्र में अधिसूचना द्वारा, व्याघ्र संरक्षण प्राधिकरण के पुनर्गठन पर सदस्य सचिव की नियुक्ति करेगी , जो ऐसी शक्तियों का प्रयोग करेगा और ऐसी कर्तव्यों का अनुपालन करेगा जो उसे अधिनियम के अधीन उसे समनुदेशित की गई है और प्राधिकरण द्वारा समनुदेशित की गई हो ।
(2) किसी व्यक्ति को सदस्य सचिव के रूप में नियुक्त होने के लिए वह वन्य महानिरीक्षक या भारतीय वन सेवा में समतुल्य रैंक का अधिकारी होगा, जो वन आरक्षिती या वन्यजीव प्रबंधन में कम से कम दस वर्ष का अनुभव रखता हो ।
5. सदस्य- सचिव की पदावधि और सेवा की अन्य शर्तें : व्याघ्र संरक्षण प्राधिकरण का सदस्य-सचिव अधिनियम की धारा 38 ढ की उपधारा (1 ) के परतुंक के उपबंधों के अधीन होगा, 18,400-500-22,400रु. वेतनमान का वेतन का हकदार होगा और ऐसे भत्तों, छुट्टी, भविष्यनिधि, पेंशन और अन्य सेवानिवृत्त लाभों, सरकारी आवास और चिकित्सा सुविधाओं, जो तत्समान वेतनमान के समूह ' क ' के केन्द्रीय सरकार के कर्मचारियों को तत्समय अनुज्ञेय हों, का भी हकदार होगा ।

New Delhi , the 25th October , 2006
G.S.R. 661 (E ) . In exercise of the powers conferred by clause ( gii) of sub - section ( 1 ) of section 63 read with sub - section ( 4) of section 38M of the Wild Life (Protection) Act , 1972 (53 of 1972) , the Central Government hereby makes the following rules regulating the salaries , allowances and other conditions of appointment of the Chairperson , the Vice-Chairperson , Member and Member- Secretary of the National Tiger Conservation Authority, namely: -
1. Short title and commencement.- (1 ) These rules may be called the National Tiger Conservation Authority ( Salaries , Allowances and other Conditions of Appointment ) Rules , 2006 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions. In these rules , unless the context otherwise requires , - 3

(a) " Act " means the Wild Life (Protection) Act, 1972 (53 of 1972 ) ;
(b) " Chairperson " means the Chairperson of the Tiger Conservation Authority ;
(c) "Fund" means the Tiger Conservation Authority Fund constituted under sub- section (2) of section 38Q;
(d) " member " means a member of the Tiger Conservation Authority;
(e) " Member - Secretary " means the Member - Secretary of the Tiger Conservation Authority;
( f) " section" means section of the Act;
(g) " Tiger Conservation Authority " means the National Tiger Conservation Authority constituted under section 38L ;
(h) " Vice - Chairperson " means the Vice-Chairperson of the Tiger Conservation Authority.
3. Travelling and other allowances to the Chairperson , Vice- Chairperson and members . ( 1 ) The Chairperson, Vice- Chairperson and members shall be entitled to travelling allowances and daily allowances in respect of journeys performed by them in connection with the work of the Tiger Conservation Authority at the rates as are admissible to a Union Minister , Union Ministers of State and a Secretary to the Government of India respectively.
(2) Notwithstanding anything contained in sub -rule ( 1 ) , the Chairperson or any other member , who is a Member of Parliament, shall not be entitled to any remuneration other than the allowances , defined in clause ( a) of section 2 of the Parliament (Prevention of Disqualification) Act , 1959 ( 10 of 1959 ) or as the case may be, other than the allowances , if any, receive without incurring such disqualification.
4. Appointment of Member- Secretary on re- constitution of the Tiger Conservation Authority. ( 1 ) The Central Government shall , by notification in the Official Gazette , appoint a Member- Secretary of the Tiger Conservation Authority on its re- constitution, who shall exercise such powers and perform such duties as are assigned to him under the Act and those assigned by the Authority .
(2) A person to be appointed as Member - Secretary shall be an Inspector General of Forests or an Officer of equivalent rank in the Indian Forest Service, having at least ten years experience in a tiger reserve or wildlife management .
5. Terms and other conditions of service of Member- Secretary. The Member- Secretary of the Tiger Conservation Authority , subject to the provisions contained in the proviso to sub- section ( 1 ) of section 38N of the Act , shall be entitled to the salary in the pay scale of rupees 18400-500-22400 / - and shall also be entitled to such allowances , leave , provident fund, pension and other retirement benefits , official accommodation and medical facilities as are for the time being admissible to the officers of the Central Government belonging to Group ' A' of the corresponding scale of pay .

सा.का.नि. 662(अ) .- केन्द्रीय सरकार, वन्य जीव (संरक्षण) अधिनियम, 1972 (1972 का 53 ) की धारा 63 की उपधारा ( 1 ) के खंड (छझ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए धारा 38 ठ की उपधारा (2) के खंड (घ ) के अधीन नियुक्त किए जाने वाले राष्ट्रीय व्याघ्र संरक्षण प्राधिकरण के विशेषज्ञों और वृत्तिक सदस्यों की अर्हताएं और अनुभव विनिर्दिष्ट करते हुए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ (1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय व्याघ्र संरक्षण प्राधिकरण (विशेषज्ञों या वृक्षिक सदस्यों की अर्हताएं और अनुभव) नियम, 2006 है ।
(2) ये नियम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं : इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हों,
(क) "अधिनियम" से वन्यजीव ( संरक्षण) अधिनियम, 1972 ( 1972 का 53) अभिप्रेत है ;
(ख ) "विशेषज्ञ या वृत्तिक सदस्य " से अधिनियम की धारा 38 ठ की उपधारा (2) के खंड (घ) के अधीन नियुक्ति व्याघ्र संरक्षण प्राधिकरण का कोई सदस्य अभिप्रेत है ;
(ग) "व्याघ्र संरक्षण प्राधिकरण " से अधिनियम की धारा 38 ठ के अधीन गठित राष्ट्रीय व्याघ्र संरक्षण प्राधिकरण अभिप्रेत है ;
3. विशेषज्ञ या वृत्तिक सदस्यों की अर्हताएं और अनुभव, --
:
(1) कोई व्यक्ति, व्याघ्र संरक्षण प्राधिकरण का विशेषज्ञ या वृत्तिक सदस्य के रूप में नियुक्त होने का तभी पात्र होगा , यदि वह निम्नलिखित अर्हताएं रखता हो--
(क) (i ) उसने किसी मान्यताप्राप्त विश्वविद्यालय से कला या विज्ञान में स्नातकोत्तर डिग्री या समतुल्य में पांच वर्षीय पाठ्यक्रम पूरा किया हो ;
(ii) उसके पास किसी मान्यताप्राप्त संस्थान या विश्वविद्यालय से इंजीनियरी या प्रौद्योगिकी अथवा स्थापत्यकला में स्नातकस्तर की उपाधि हो ; या
(iii) उसके पास किसी मान्यताप्राप्त विश्वविद्यालय से विधि में उपाधि या समतुल्य हो ; या
( iv) वह चार्टर्ड एकाउंटेंट संस्थान या लागत तथा संकर्म लेखाकार संस्थान या कंपनी सचिव संस्थान या अथवा बीमांकक संस्थान का अध्येता हो ; या
(v) उसके पास विश्वविद्यालय की कोई डिग्री है और उसने कार्मिक और प्रशिक्षण विभाग द्वारा स्थापित या मान्यताप्राप्त किसी अकादमी में सफलतापूर्वक प्रशिक्षण पूरा किया हो ; और
(ख) उसके पास वन्य संरक्षण और व्याघ्र आरक्षिति में निवास कर रहे व्यक्तियों के कल्याण का पन्द्रह वर्ष का अनुभव हो ; संबंधित विधा में दस वर्ष के सुसंगत अनुभव के साथ डाक्टर की उपाधि हो ।
(2) ऐसे किसी व्यक्ति पर, जो अधिमानतः सत्तर वर्ष से कम आयु का है, विशेषज्ञ या वृत्तिक सदस्य के रूप में नियुक्तिके लिए विचार किया जाएगा ।
(3) विशेषज्ञ या वृत्तिक सदस्यों की पात्रता का अवधारण, व्याघ्र संरक्षण प्राधिकरण में चयन के लिए उनके प्रवर्ग और पात्रता का मूल्यांकन इन नियमों से उपाबद्ध सारणी और परिशिष्ट के अनुसार किया जाएगा ।
4. विशेषज्ञ या वृत्तिक ( गैर सरकारी सदस्य) के रूप में सेवा की शर्तें : - 5

गैर सरकारी सदस्यों की दशा में व्याघ्र संरक्षण प्राधिकरण में विशेषज्ञ या वृत्तिक सदस्य के रूप में सेवा करने के लिए निम्नलिखित शर्तें लागू होंगी :
(i) व्यष्टिक हैसियत में सेवा करने वाले गैर सरकारी सदस्य, अपने संस्थागत या संगठनात्मक संबंधन को विचार में लाए बिना व्याघ्र संरक्षण प्राधिकरण में केवल वृत्तिक या विशेषज्ञ सदस्य के रूप में सेवा कर सकेंगे ;
(ii) अन्य सभी शर्त ( iii) और शर्त ( iv) में वर्णित संस्थानों या संगठनों के प्रतिनिधियों के रूप में सेवा. करेंगे ;
(iii) ऐसे वृत्तिकों वाला कोई स्वैच्छिक संगठन, जो विशिष्ट रूप से अलाभ के आधार पर पहले से, सतत विकास संबंधी विषयों पर समुदाय, अन्य संगठनों या सरकारी अभिकरणों को विभिन्न सेवाएं , जिसके अंतर्गत अनुसंधान भी है, प्रदान करने में लगा हुआ है ।
(iv) किसी ऐसे स्वैच्छिक संगठन से, जो पहले से संबंधित क्षेत्र में सतत विकास संबंधी विभिन्न कार्यक्रमों के कार्यान्वयन में लगा हुआ है, कुछ वृत्तिक संबंधी कार्यों की अपेक्षा की जा सकेगी या अपेक्षा नहीं की जा सकेगी ।
स्पष्टीकरण- इन नियमों के प्रयोजन के लिए "गैर सरकारी " एक ऐसा व्यक्ति है जो वर्तमान में किसी भी स्तर पर (केन्द्रीय , राज्य या स्थानीय स्तर) किसी सरकारी पद का, चाहे वह सिविल या न्यायिक सेवा में हों अथवा किसी पद के लिए निर्वाचित हो, (विश्वविद्यालयों या स्वायत्त संस्थाओं में संकाय पद धारण करने वाले व्यक्तियों को छोड़कर) धारक नहीं है ।
5. विशेषज्ञ या वृत्तिक सदस्य की पदावधिं कोई विशेषज्ञ या वृत्तिक सदस्य तीन वर्ष की अवधि के लिए पद धारण करेगा और उसकी पदावधि व्याघ्र संरक्षम प्राधिकरण की अवधि तक सह- विस्तारी होगी और वह पुनर्नियुक्ति का पात्र होगा:
करेगा । परंतु कोई भी सदस्य उस रूप में लगातार दो अवधियों से अनधिक की अवधि के लिए पद धारण नहीं 6. वित्तीय या अन्य हितों की घोषणा प्रत्येक व्यक्ति, व्याघ्र संरक्षण प्राधिकरण के विसेषज्ञ या वृत्तिक सदस्य के रूप में अपनी नियुक्ति पर इन नियमों से उपाबद्ध प्ररूप 1 में यह घोषणा करेगा कि उसका ऐसा कोई वित्तीय या अन्य हित नहीं है जिससे प्राधिकरण के सदस्य के रूप में उसके कृत्यों पर प्रतिकूल प्रभाव पड़ने की संभावना हो ।
7. किसी सदस्य को प्राधिकरण से अस्थायी रूप से विवर्जित करना या उसे हटाना यदि व्याघ्र संरक्षण प्राधिकरण का कोई गैर सरकारी सदस्य अधिदेश में बाधाएं डालता है या सार्वजनिक कथनों अथवा ऐसी अन्य कार्रवाईयों द्वारा प्राधिकरण के अधिवेशनों को विफल करने या उसके उद्देश्यों को प्राप्त करने में बाधा डालने का प्रयास करता है उसे प्राधिकरण के अध्यक्ष द्वारा प्राधिकरण के अधिवेशनों में हाजिर होने से विवर्जित कर दिया जाएगा और बार- बार ऐसा व्यवहार किए जाने की दशा में वह प्राधिकरण के सदस्य के पद से हटाए जाने का दायी होगा :
परंतु सदस्य के रूप में ऐसे हटाए जाने के पूर्व उसे सुने जाने का युक्तियुक्त अवसर दिया जाएगा ।

NOTIFICATION
New Delhi , the 25th October , 2006
G.S.R. 662 (E) . In exercise of the powers conferred by clause (gi) of sub- section (1 ) of section 63 of the Wild Life (Protection) Act, 1972 (53 of 1972 ) , the Central Government hereby makes the following rules specifying the qualifications and experience of experts or professional members of the National Tiger Conservation Authority , to be appointed under clause (d ) of sub - section (2) of section 38L, namely: -
1. Short title and commencement - ( 1) These rules may be called the National Tiger Conservation Authority ( Qualifications and Experience of Experts or Professional Members ) Rules , 2006.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions - In these rules , unless the context otherwise requires , -
(a) "Act" means the Wild Life (Protection) Act , 1972 ( 53 of 1972);
(b) " expert or professional member ' means a member of the Tiger Conservation Authority, appointed under clause (d) of sub -section (2) of section 38L of the Act ;
(c) " Tiger Conservation Authority " means the National Tiger Conservation Authority constituted under section 38L of the Act .
3. Qualifications and experience for expert or professional members.-
(1) A person shall be eligible to be appointed to the Tiger Conservation Authority as an expert or professional member , if the following qualifications are met -
(a) (
i) having completed a five years course leading to a masters degree in arts or science of a recognised University or equivalent; or
(ii) having graduate level degree in engineering or technology or architecture , from a recognised Institute or University; or
(iii) having degree in law from a recognised University or equivalent ; or
(iv) a fellow of the Institute of Chartered Accountants or Cost and Works Accountants or Company Secretaries , or Actuaries ; or
(v) having a University degree and successfully completed the training in an academy established or recognised by the Department of Personnel and Training; and
(b) having fifteen years of experience in conservation of wildlife and welfare of people living in tiger reserve ; or having a doctoral degree in concerned discipline with at least ten years of relevant experience .
(2) A person preferably below the age of seventy years shall be considered for appointment as an expert or professional member .
(3) The determination of eligibility of expert or professional members , their category and evaluation of eligibility and experience for selection in the Tiger Conservation Authority shall be made in accordance with the Tables and Appendix annexed to these rules .

4. Conditions for serving as an expert or professional ( non - official members) .-
The following conditions for serving as an expert or professional member in the Tiger Conservation Authority shall apply in the case of non - official members :
(i) Non- official members serving in individual capacity , irrespective of their institutional or organisational affiliation , may only serve as professional or expert member in the Tiger Conservation Authority ;
(ii) All others shall serve as representatives of institutions or organisations described in conditions (iii ) and (iv) .
(iii) A Voluntary Organization having professionals , who are primarily engaged in providing, typically on non - profit basis , various services , including research , to the community, other institutions , or Government agencies , on sustainable development matters .
(iv) A Voluntary Organization which is primarily engaged in the implementation of various sustainable development programs in the field , may or may not requiring some professional inputs .
Explanation. For the purpose of these rules, " non - official " is a person who is presently not a holder of a Government post at any level ( Central , State or Local level) , whether in civil or judicial service or elected to any office ( excluding persons holding faculty positions in Universities or autonomous institutions) .
5. Tenure of expert or professional member. An expert or professional member shall hold office for a period of three years , and his term of office shall be coterminus with the term of the Tiger Conservation Authority , and he shall be eligible for re- appointment:
Provided that no member shall hold office as such for more than two consecutive terms .
6. Declaration of financial or other interest . Every person, on his appointment as the expert or professional member of the Tiger Conservation Authority shall give a declaration in Form - I annexed to these rules , that he does not have any financial or other interest as is likely to affect prejudicially his functions as a member of the Authority .
7. Debarring a member temporarily or his removal from Authority. If a non official member of the Tiger Conservation Authority obstructs the meeting , or attempts through public statements or such other actions to frustrate the meetings or in achieving the objectives of the Authority , he shall be temporarily debarred by the Chairperson of the Authority from attending the meetings of the Authority and in case of such recurring behaviour , he shall be liable to be removed as a member of the Authority:
Provided that before such removal , as a member he shall be given a reasonable opportunity of being heard .
