सा.का.नि. 666 (अ) - भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63) की धारा 37 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय सरकार एतद्वारा भारतीय मानक ब्यूरो नियम, 1987 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है; अर्थात : -
1. (1 ) इन नियमों को भारतीय मानक ब्यूरो (संशोधन) नियम, 2006 कहा जाएगा ।
(2) ये राजपत्र में प्रकाशन की तारीख से लागू होंगे ।
2. भारतीय मानक ब्यूरो नियम, 1987 के नियम 3 में उप नियम (1 ) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्: -
'(1 ) ब्यूरो में निम्नलिखित सदस्य होंगे , अर्थात् : -
(क) ब्यूरो पर प्रशासनिक नियंत्रण वाले केंद्रीय सरकार के मंत्रालय अथवा विभाग के प्रभारी मंत्री ब्यूरो के पदेन अध्यक्ष होंगे ।
(ख) ब्यूरो पर प्रशासनिक नियंत्रण वाले केंद्रीय सरकार के मंत्रालय अथवा विभाग में राज्य मंत्री अथवा उप मंत्री, यदि कोई हो, ब्यूरो के पदेन उपाध्यक्ष होंगे और जहां कोई ऐसा राज्य मंत्री अथवा उप मंत्री न हो वहां ऐसा व्यक्ति ब्यूरो का उपाध्यक्ष होगा जो केंद्रीय सरकार द्वारा नामित किया जाए ।

(ग) ब्यूरो पर प्रशासनिक नियंत्रण वाले भारत सरकार के मंत्रालय अथवा विभाग के प्रभारी सचिव, पदेन;
(घ) ब्यूरो के महानिदेशक, पदेन;
(ड. ) दो संसद सदस्य जिसमें से एक लोक सभा से और एक राज्य सभा से होगा ।
(च) ब्यूरो से संबंधित महत्वपूर्ण विषयों को देख रहे केंद्रीय सरकार के मंत्रालयों और विभागों का प्रतिनिधित्व करने वाले तीन व्यक्ति;
(छ) पांच प्रतिनिधि राज्य सरकारों और संघ राज्य क्षेत्रों के पांच जोनों से चक्रानुक्रम आधार पर एक- एक प्रतिनिधि जो निम्नानुसार होंगे -
(i) मंत्रिपरिषद वाले राज्यों और संघ राज्य क्षेत्रों के मामले में गुणवत्ता और मानकों पर प्रशासनिक नियंत्रण वाले विभाग के प्रभारी मंत्री; और
(ii) जिन संघ राज्य क्षेत्र में मंत्रिपरिषद न हो उनके मामले में यथास्थिति प्रशासक अथवा मुख्य कार्यकारी पार्षद;
(ज) केंद्रीय सरकार के मत से अपने प्रचालन में सक्रिय और प्रभावी मान्यताप्राप्त उपभोक्ता संगठनों का प्रतिनिधित्व करने वाले या सरकार के मत से उपभोक्ता के हितों का प्रतिनिधित्व करने में सक्षम दो व्यक्ति;
(झ) किसानों अथवा किसान एसोसिएशनों में से नामांकित किए जाने वाला एक व्यक्ति जिसके बारे में सरकार का यह मत हो कि वह किसानों के हितों का प्रतिनिधित्व करने में सक्षम है;
(ञ) उद्योग और व्यापार तथा उनके एसोसिएशनों और सार्वजनिक क्षेत्र के उपक्रमों का प्रतिनिधित्व करने वाले पांच व्यक्ति जिनका चयन निम्नानुसार होगा : -
(i) अखिल भारतीय स्तर के तीन उद्योग एसोसिएशनों अथवा संघों के अध्यक्ष;
(ii) ब्यूरो के महत्व के विषयों से संबंधित एक केंद्रीय अथवा राज्य सार्वजनिक क्षेत्र के उपक्रम का मुख्य कार्यकारी;
(iii) सार्वजनिक क्षेत्र को छोड़कर एक औद्योगिक संगठन जिसे राजीव गांधी राष्ट्रीय गुणवत्ता पुरस्कार मिला हो, का अध्यक्ष या प्रबंध निदेशक;
(ट) ब्यूरो के लिए महत्वपूर्ण विषयों से संबंधित वैज्ञानिक और अनुसंधान संस्थानों, तकनीकी, शैक्षिक और व्यवसायिक संगठनों का प्रतिनिधित्व करने वाले तीन व्यक्ति;

3. उक्त नियम के नियमों 5 में, -
(क) उप नियम (2) के स्थान पर निम्नलिखित्त प्रतिस्थापित किया जाएगा, अर्थात : - *(2) ब्यूरो की प्रति वर्ष कम से कम एक बैठक आयोजित की जाएगी । यदि अध्यक्ष जरूरी समझे तो अपने विवेक से एक वर्ष में एक से अधिक बैठक बुला सकता है । '
(ख) उप नियम (6) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात : - *(6) कोरम पांच सदस्यों से मिलकर बनेगा परन्तु यदि कोई बैठक कोरम की कमी के कारण स्थगित हो जाती है तो कामकाज के संचालन के लिए स्थगित की गई बैठक कोरम को ध्यान में रखे बिना उस तारीख को बुलाई जा सकेगी जो मूल बैठक की तारीख से सात दिनों के बाद की न हो'
4. उक्त नियमों के नियम 6 में,
उप नियम (2) के लिए निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थातः-
(क)
(2) कार्यकारी समिति में पदेन अध्यक्ष के रूप में महानिदेशक और निम्नलिखित श्रेणियों का प्रतिनिधित्व करने वाले नौ अन्य सदस्य होंगे जिनको केंद्रीय सरकार के पूर्वअनुभोदन से भारतीय मानक ब्यूरो द्वारा नियुक्त किया जाएगा, अर्थात : -
(i) मंत्रालय/विभाग, जिसका भारतीय मानक ब्यूरो पर प्रशासनिक नियंत्रण हो, का अपर सचिव और वित्तीय सलाहकार तथा अपर सचिव/ संयुक्त सचिव ;
( ii) ऊपर (i ) से इतर केंद्रीय सरकार के किसी मंत्रालय अथवा विभाग का प्रतिनिधित्व करने वाला एक व्यक्ति;

(iii) मान्यताप्राप्त उपभोक्ता संगठन का प्रतिनिधित्व करने वाला एक व्यक्ति;
(iv) उद्योग, व्यापार ओर उनके एसोसिएशनों का प्रतिनिधित्व करने वाला एक व्यक्ति;
वैज्ञानिक और अनुसंधान संस्थानों का प्रतिनिधित्व करने वाले दो व्यक्ति; और (v)
(
vi) सार्वजनिक क्षेत्र के उपक्रमों और तकनीकी, शैक्षिक अथवा व्यावसायिक संगठनों का प्रतिनिधित्व करने वाले दो व्यक्ति'
(ख) उप नियम (5) के लिए निम्नलिखित प्रतिस्थापित किया जाएगा , अर्थात : - "(5) भारतीय मानक ब्यूरो द्वारा कार्यकारी समिति के किसी सदस्य के त्यागपत्र देने और हटाए जाने के कारण हुई रिक्ति को केंद्रीय सरकार के पूर्व अनुमोदन से रिक्ति की तारीख से तीन माह की अवधि के भीतर भरा जाएगा , और 4

(11) उप नियम ( 10 ) के लिए निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात : - '( 10) कार्यकारी समिति की बैठक के लिए कोरम की संख्या तीन होगी '

NOTIFICATION
New Delhi , the 26th October , 2006
G.S.R. 666 (E ) . In exercise of powers conferred by section 37 of the Bureau of Indian Standards Act 1986 (63 of 1986) , the Central Government hereby makes the following rules further to amend the Bureau of Indian Standards Rules , 1987 , namely: -
1. (1) These rules may be called Bureau of Indian Standards (Amendment ) Rules , 2006.
(2) They shall come into force on the date of their publication in the official gazette.
2. In rule 3 of the Bureau of Indian Standards Rules , 1987 , for sub- rule ( 1 ) the following shall be substituted, namely: -
"( 1 ) The Bureau shall consist of the following members , namely: -
(a) the Minister in charge of the Ministry or Department of the Central Government having administrative control of the Bureau who shall be ex - officio President of the Bureau ,
(b) the Minister of State or a Deputy Minister , if any , in the Ministry or Department of the Central Government having administrative control of the Bureau who shall be ex- officio Vice- President of the Bureau , and where there is no such Minister of State or Deputy Minister , such person as may be nominated by the Central Government to be the Vice- President of the Bureau;

(c) the Secretary to the Government of India in charge of the Ministry or Department of the Central Government having administrative control of the Bureau ex- officio ,
(d) the Director General of the Bureau , ex - officio,
(e) two Members of Parliament of whom one shall be from the House of the People and one from the Council of States;
(f) three persons representing the Ministries and Departments of the Central Government dealing with important subjects of interest to the Bureau ;
(g) five representatives one each from five zones of State Governments and the Union Territories on rotation basis who shall be, -
(i) the Minister in charge of the Department having administrative control over quality and standards in the case of States and Union Territories having a Council ofMinisters ; and
(ii) the Administrator or the Chief Executive Councilor , as the case may be, in the case of Union Territories , not having a Council of Ministers;
(h) two persons either representing recognized Consumer Organizations which in the opinion of the Central Government are active and effective in their operations , or are in the opinion of that Government are capable of representing consumer interests ;
(i) one person, who, in the opinion of the Central Government , is capable of representing farmers ' interests , to be nominated from amongst farmers or farmers associations ;
(j ) five persons representing the industry and trade and their associations and public sector enterprises to be chosen as follows: -
(i) Presidents of three industry associations or federations ofall - India level ;
(ii) Chief Executive of one Central or State Public Sector Enterprise related to subjects of importance to the Bureau;
(iii) Chairman or Managing Director of one industrial organization other than the public sector who is awardee for the Rajiv Gandhi National Quality Award;
(k) three persons representing the scientific and research institutions , technical , educational and professional organizations related to subjects of importance to the Bureau."

3. In rule 5 of the said rules , -
(a) for sub - rule ( 2) the following shall be substituted , namely:-
"(2) At least one meeting of the Bureau shall be held every year . The President may at his discretion convene more than one meeting in a year if he considers it necessary. " ,
(b) for sub - rule (6) the following shall be substituted, namely: -
"(6) Five members shall form the quorum, provided that if any meeting is adjourned for want of quorum, the adjourned meeting may be called on a date not later than seven days from the date of the original meeting to transact the business regardless of the quorum" .
4. In rule 6 of the said rules ,
(a) for sub - rules (2) , the following shall be substituted , namely: -
"(2) The Executive Committee shall consist of the Director General as ex- officio Chairman and nine other members , representing the following categories , to be appointed by the Bureau of Indian Standards, with the prior approval of the Central Government , namely:
(i) Additional Secretary & Financial Adviser and Additional Secretary / Joint Secretary of the Ministry/ Department having administrative control of the Bureau of Indian Standards ;
one person representing a Ministry or Department of Central Governinent other than at (i) above ; (ii)
(iii) one organization; person representing recognized consumer
(iv) one person representing industry, trade and their associations;
two persons representing scientific and research institutions ; and (v)
(vi) two persons representing public sector enterprises and technical, educational or professional organizations . " , भाग II- खण्ड 3(i) ]

(b) for sub- rule (5) the following shall be substituted, namely: -
"(5) The vacancy caused on resignation and termination of a member of the Executive Committee shall be filled within a period of three months from the date of occurrence by the Bureau of Indian Standards with the prior approval of the Central Government. " , and
(c) for sub - rule (10) the following shall be substituted, namely: -
" (10) The quorum for a meeting of the Executive Committee shall be three".
