का.आ. 1874( अ ) -केन्द्रीय सरकार ने , कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) की धारा 27 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केरल राज्य में एण्डोसल्फान का प्रयोग प्रतिषिद्ध करने के लिए , कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) में भारत सरकार की अधिसूचना सं. का. आ. 1533 ( अ) , तारीख 25 अक्तूबर , 2005 द्वारा प्रारूप आदेश प्रकाशित किया था जिसमें ऐसे सभी व्यक्तियों से , जिनके उससे प्रभावित होने की संभावना थी उस तारीख से जिसको उक्त अधिसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा देने के , पैंतालीस दिन की अवधि के अवसान के पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां 25 अक्टूबर, 2005 को जनता को उपलब्ध करा दी गई थीं ;
और उक्त प्रारूप ओदश के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा सम्यक् रूप से विचार किया जा चुका है :
अतः अब, केन्द्रीय सरकार, कीटनाशी अधिनियम, 1968 (1968 का 46) की धारा 28 के साथ पठित धारा 27 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करने का प्रस्ताव करती है, अर्थात्:-

इस आदेश का संक्षिप्त नाम केरल राज्य में एण्डोसल्फान के प्रयोग का प्रतिषेध है ।

(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।

2. केरल राज्य में, एण्डोसल्फान का प्रयोग इस अधिसूचना के प्रकाशन की तारीख से ऐसे समय तक रोके रखा जाएगा जब तक कि पाडरे ग्राम में स्वास्थ्य संबंधी समस्याओं के लिए उत्तरदायी कारकों की पहचान करने वाले महामारी-विचार संबंधी अध्ययन के परिणाम उपलब्ध नहीं होते और केन्द्रीय सरकार द्वारा उन पर विनिश्चय नहीं किया जाता ।
3. केरल राज्य की सरकार कीटनाशी अधिनियम, 1968 (1968 का 46) में अंतर्विष्ट उपबंधों और उनके अधीन बनाए गए नियमों के अनुसार इस आदेश के निष्पादन को कार्यान्वित करने के लिए अपनी अधिकारिता में ऐसे सभी कदम उठाएगी , जैसा वह उचित समझे ।
4. यह स्पष्ट किया जात है कि यह आदेश केरल राज्य में एण्डोसल्फान के प्रयोग पर रोक लगाने के लिए माननीय केरल उच्च न्यायालय के उनके निर्णय 2002 के ओ.पी.सं. 20716, 2001 के ओ.पी.सं. 29371 वी. , 2001 का ओ.पी.सं. 16300, 2002 का ओ.पी.सं. 17026 और 2004 की रिट पिटीशन ( सि) सं0 24110 , तारीख 17 मार्च, 2006 में के निर्देशों परं प्रतिकूल प्रभाव डाले बिना है ।

NOTIFICATION
New Delhi , the 31st October , 2006
S.O. 1874(E ) .-Whereas the Central Government, in exercise of the powers conferredby sub-section (2) of Section 27 of the Insecticides Act , 1968 (46 of 1968) published a draft order for prohibiting the use of Endosulfan in the State of Kerala vide notification of the Government of India in the Ministry of Agriculture ( Department of Agriculture and Cooperation) number S.O. 1533 ( E) , dated the 25th October, 2005, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period offorty- five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And whereas , copies of the said Gazette were made available to the public on the 25th October , 2005;
And whereas the objections and suggestions received from the public in respect of the said draft Order were duly considered by the Central Government ;

Now therefore , in exercise of the powers conferred by sub -section (2) of section 27 read with section 28 of the Insecticides Act, 1968 (46 of 1968) , the Central Government hereby makes the following Order namely: -
ORDER
1. (1) This Order may be called the Prohibition of use of Endosulfan in the State of Kerala .
(2) It shall come into force on the date of its publication in the Official Gazette.
2. Theuse of Endosulfan in State of Kerala shall be kept on hold from the date of publication of this notification till such time that the results of the epidemiological study to pin - point the factors responsible for the health problems isvillage Padre become available and a decision thereon is taken by the Central Government.
3. The State Government of Kerala shall take all such steps in its jurisdiction as it may deem fit for carrying out execution of this Order as per the provisions contained in the Insecticides Act, 1968 (46 of 1968) and the rules framed thereunder.
4. It is hereby clarified that this order for putting on hold of the use of Endosulfan in the State of Kerala is without prejudice to the directions of the Hon'ble High Court of Kerala in their judgment in O.P.No.20716 of 2002 , O.P. No.29371 of 2001 V, O.P. No. 16300 of 2001 , O.P. No. 17026 of 2002 and WP (C) No.24110 of2004 dated the 17th March , 2006.
