सं. डी.ई. 14-2006.-दन्त चिकित्सक अधिनियम , 1948 ( 1948 का 16 ) की धारा 20 के साथ पठित धारा 10क के द्वारा प्रदत्तं शक्तियों का प्रयोग करते हुए, भारतीय दन्त परिषद्, केन्द्रीय सरकार के अनुमोदन से " भारतीय दन्त परिषद् ( नए दन्त कालेजों की स्थापना, दन्त कालेजों में अध्ययन अथवा प्रशिक्षण के नये अथवा उच्चतर पाठ्यक्रम खौलना और प्रवेश क्षमता बढ़ाना ) विनियम, 2006" संबंधी प्रधान विनियम, 2006 में संशोधन करते हुए निम्नलिखित विनियम बनाती है, अर्थात्
1. संक्षिप्त नाम और प्रारम्भ: --
( i ) इन विनियमों को भारतीय दन्त परिषद् ( नए दन्त कालेजों की स्थापना , दन्त कालेजों में अध्ययन अथवा प्रशिक्षण के नए अथवा उच्चतर पाठ्यक्रम खोलना अथवा प्रवेश क्षमता बढ़ाना ) ( तीसरा संशोधन ) विनियम, 2006 कहा जाएगा ।
( ii ) ये सरकारी राजपत्र में प्रकाशन की तारीख से लागू होंगे ।
2. ( i ) प्रधान विनियमों की धारा 17 की उप- धारा ( 3 ) को निम्नलिखित से प्रतिस्थापित किया जाए
( 3 ) अध्ययन अथवा प्रशिक्षण का नया अथवा उच्चतर पाठ्यक्रम खोलने की अनुमति इस विनियम के अंतर्गत एक वर्ष की अवधि के लिए दी जाएगी तथा भारतीय दन्त परिषद् द्वारा निरीक्षण के पश्चात् इसका नवीकरण वार्षिक आधार पर किया जाएगा । वार्षिक नवीकरण की यह प्रक्रिया तब तक चलती रहेगी जब तक संबंधित पाठ्यक्रम में छात्रों का प्रथम बैच अंतिम वर्ष की परीक्षा में नहीं बैठ जाता । यह दन्त कालेज की जिम्मेदारी होगी कि वह अगली शैक्षिक सत्र के शुरू होने के छह महीने पहले परिषद् को ऐसे नवीकरण के लिए आवेदन करे ।
( ii ) प्रधान विनियमों में धारा 23 की उप- धारा ( 4 ) के पश्चात् निम्नलिखित नई उप - धारा ( 4 क ) जोड़ी जाएगी:--
(4क) अध्ययन अथवा प्रशिक्षण के उच्चतर पाठ्यक्रम में प्रवेश क्षमता बढ़ाने के मामले में उपर्युक्त अनुमति एक वर्ष की अवधि के लिए दी जाएगी तथा भारतीय दन्त परिषद् द्वारा निरीक्षण करने के पश्चात् वार्षिक आधार पर इसका नवीकरण किया जाएगा । वार्षिक नवीकरण की यह प्रक्रिया तब तक चलती रहेगी जब तक संबंधित पाठ्यक्रम में बढ़ाई गई प्रवेश क्षमता में दाखिल छात्रों का प्रथम बैच अंतिम वर्ष की परीक्षा में नहीं बैठ जाता तथा जहां कहीं आवश्यक हो, कार्य निष्पादन बैंक गारंटी का नवीकरण नहीं हो जाता । यह दन्त कालेज की जिम्मेदारी होगी कि वह अगले शैक्षिक सत्र के शुरू होने के छह महीने पहले परिषद् को ऐसे नवीकरण के लिए आवेदन करे ।

NOTIFICATION
New Delhi , the 2nd November , 2006
No DE . 14-2006.-In exercise of the powers conferred by Section 10A read with Section 20 of the Dentists Act, 1948 (16of1948), the Dental Council of India, with the previous approval of the Central Government, hereby makes the following regulations to amend the Principal Regulations , 2006 called " Dental Council of India ( Establishment of New Dental Colleges , Opening ofNew or Higher Course of Study or Training and Increase ofAdmission Capacity in Dental Colleges) Regulations , 2006", namely:-
1.
Short title and commencement :-
(i) These Regulations may be called the Dental Council of India ( Establishment of New Dental Colleges , Opening ofNew or Higher Course of Study or Training and Increase of Admission Capacity in Dental Colleges ) (3rd Amendment) Regulations , 2006 .
(i) They shall come into force from the date of their publication in the Official Gazette .
2 (1) In the Principal Regulations , the existing Sub - section (3) of Section 17 be substituted with the following:-
'(3 ) The permission granted under this regulation for starting of new or higher course of study or training will be granted for a period of one year and will be renewed on yearly basis after inspection by Dental Council of India . This process of renewal of permission will continue until the first batch of students appears in Final Year Examination of the concerned Course . It shall be the responsibility of the Dental College to apply to the Council for such renewal six months before the beginning of the next academic session . '
(1) In the Principal Regulations , after Sub- section (4) of Section 23 , the following new Sub -section (4A) be inserted :----
'(4) In the case of higher course of study or training , the above perinission to increase the admission capacity will be granted for a period of one year and will be renewed on yearly basis after inspection by Dental Council of India. This process of renewal ofpermission will continue until the first batch of students with increased admission capacity appears in Final Year Examination of the concerned Course and revalidation , ifnecessary, ofthe performance bank guarantee . It shall be the responsibility of the dental college to apply to the Council for such renewal six months before the beginning of the next academic session. '
